Haliey Welch addressed the $HAWK memecoin fallout on December 20, 2024, saying she was cooperating with the legal team representing affected individuals and directing people who reported losses to Burwick Law. Welch was not named as a defendant in the lawsuit’s initial complaint, filed the day before. A later case description from Burwick Law says an amended complaint names her and others, but that is a plaintiff-side firm’s account—not a court finding of liability.
What Haliey Welch said about the lawsuit
In a post on December 20, 2024, Welch said she took the situation “extremely seriously” and was cooperating with the legal team representing people affected by $HAWK. She said she wanted to help uncover the truth, hold responsible parties accountable and resolve the matter. She directed people who experienced losses to Burwick Law. Who was sued initially—and what investors alleged
The original complaint was filed December 19, 2024, in the U.S. District Court for the Eastern District of New York. It named overHere Limited, Clinton So, Alex Larson Schultz and Tuah the Moon Foundation as defendants. Welch was not named in that initial filing. The complaint alleged that $HAWK was issued, promoted and sold as an unregistered security, and that Welch’s celebrity and connections were used to increase the token’s appeal. Those are allegations in a plaintiffs’ filing, not established findings that the token was a security or that any defendant broke the law. How the case description changed
Wolf Popper reported that on April 23, 2025, the court appointed Alexander Escobar lead plaintiff and Wolf Popper and Burwick Law co-lead counsel for the proposed class. That procedural appointment does not mean the court certified a class or decided the merits of the claims. Wolf Popper’s update describes the appointment.

A Burwick Law case page dated March 30, 2026 describes an amended complaint in In Re $HAWK Token Securities Litigation, case number 1:24-cv-08650-AMD-JRC, as naming Welch, her manager Johnnie Forster, 16 Minutes LLC and others, alongside parties named earlier. That page is the plaintiff-side firm’s description; it does not establish liability. The materials cited here do not verify the live docket or current procedural posture, so the amended-party list should not be treated as a court-checked statement of who is currently a defendant. What is known about $HAWK’s launch—and what the figures mean
Wolf Popper reported that $HAWK launched on December 4, 2024, reached a reported $491 million market capitalization shortly afterward, and had a $16.69 million presale valuation. Market capitalization is a token-price-based valuation, not a measure of money investors received or lost. Neither figure establishes damages or the amount of any person’s loss. These are figures reported by the plaintiffs’ co-lead counsel, not independently audited financial results. Wolf Popper’s account gives the figures and their context.

In a February 2025 report on a later interview, Fast Company said Welch recalled understanding the project as a “long-term coin,” trusting the person who brought the idea to her, and viewing that trust as her biggest mistake. Fast Company also reported her account that 3% of the tokens were initially available for trading, 17% were allocated to presale investors, presale investors raised $2.8 million, and two-thirds reportedly sold quickly. These are figures and recollections attributed to Welch’s interview, not independent verification of token supply, wallet activity, who sold, or the legality of any sale. Burwick Law’s March 30, 2026 page describes the case as pending, but it is a summary from a firm representing proposed investors. The cited material does not independently establish the case’s status on the court docket. For a current answer about parties, filings or the next court date, check the Eastern District of New York docket for case 1:24-cv-08650-AMD-JRC and the operative complaint. A proposed class action, lead-plaintiff appointment or amended complaint is not itself a judgment, proof of wrongdoing or confirmation that a class has been certified.
