Status: Congress introduced House and Senate bills in 2025 to restrict DeepSeek on federal agency technology, but the official congressional records cited here show them as introduced measures referred to committee—not enacted federal law. They do not establish a nationwide ban on personal use.
Is DeepSeek banned in the United States?
The federal proposals discussed here would apply to executive-agency information technology, not to everyone in the country. Their introduced text does not prohibit Americans from installing or using DeepSeek on personal phones or computers.
Separate state-level restrictions exist. Kansas enacted a measure addressing DeepSeek and other AI platforms controlled by a country of concern on state-owned devices and networks; Oklahoma issued a state-device ban standard; and Virginia’s Executive Order 46 directed restrictions involving DeepSeek on state government devices or government-maintained systems. Those actions are distinct from federal legislation and have their own scope.

The Congress.gov action records show committee referrals, not passage by either chamber or a presidential signature. The two bills are proposals; introduction alone does not put their restrictions into effect. See the House action record and the Senate action record.

What would the bills require?
The introduced bills direct the Office of Management and Budget (OMB), consulting with the General Services Administration, CISA, the intelligence community and the Department of Defense, to develop standards and guidelines requiring agencies to remove covered applications from federal information technology. The House text sets a deadline of 60 days after enactment for OMB to develop those standards and guidelines; that clock would not start simply because the proposal was introduced. The House bill text and Senate bill text describe the proposed requirements.
Which services are covered?
The House text defines the covered application to include DeepSeek and successor applications or services developed or provided by High Flyer, as well as successor services provided by an entity owned by High Flyer. That definition reaches beyond one current app version, but it does not automatically encompass every Chinese AI product.

Exceptions and safeguards
The proposed standards must provide exceptions for law-enforcement activities, national-security interests and activities, and security researchers. Agencies would have to document risk-mitigation measures for authorized use under an exception.
What might a restriction mean for agency technology?
The legislation gives OMB the job of setting standards and guidelines; it does not itself supply a technical implementation manual. Depending on those later standards, agencies might remove desktop or mobile apps, block browser access on agency networks, limit use through agency accounts, or use endpoint and mobile-device-management controls. App removal alone would not necessarily block web access.

The introduced text does not automatically settle every edge case. Whether an agency could use a related model through an API, a cloud host or a third-party vendor would depend on the eventual agency rules and applicable procurement and security requirements.
Employees, personal devices and contractors
The proposal targets executive agencies and their information technology; it does not, by itself, create a blanket prohibition for every federal contractor’s personally owned device. Contracts or agency security policies may impose additional restrictions.

Employees should follow their agency’s current rules rather than infer permission from the bill’s proposed scope. A personal phone enrolled in a bring-your-own-device program, or used to access government email or systems, may be subject to employer security controls even though the bill is not a general ban on personal use.

- Kansas: The Legislature’s HB 2313 page marks the measure as signed by the governor. It addresses DeepSeek and other AI platforms controlled by a country of concern on state-owned devices and networks.
- Oklahoma: The state’s DeepSeek Ban Standard restricts the app on state-owned devices.
- Virginia: Executive Order 46 directed restrictions involving DeepSeek on state government devices or government-maintained systems.
These examples concern state systems. They do not establish that Congress enacted a corresponding federal rule, and the specific coverage differs by state action.

Why did lawmakers propose a restriction?
Lawmakers framed the proposal around government data handling, cybersecurity and the risk that sensitive prompts or information entered into an AI app could be exposed. Their concerns also involve questions about Chinese ownership or control. These are policy and security rationales, not proof that DeepSeek unlawfully collected U.S. government data or that a breach occurred.
