On January 28, 2019, the U.S. Department of Justice announced two separate federal indictments involving Huawei—not a single espionage charge. One case alleged that Huawei, affiliates and CFO Meng Wanzhou concealed an Iran-related relationship with Skycom from banks, leading to fraud, money-laundering and obstruction charges. The other alleged that Huawei employees stole trade secrets involving T-Mobile’s smartphone-testing robot, “Tappy,” and then obstructed the investigation.
The allegations are not convictions. Huawei’s corporate prosecution remained pending in 2026, while Meng resolved her personal U.S. case through a deferred-prosecution agreement.

The FBI summarized the combined headline as 23 criminal charges: 13 counts in the New York case and 10 in the Washington case. The indictments were separate proceedings in different districts with different factual theories. The FBI’s January 2019 summary and the Justice Department announcement describe the two cases.
What prosecutors alleged about Iran, Skycom and the banks
The Eastern District of New York indictment alleged a long-running scheme from roughly 2007 through 2017. Federal prosecutors said Huawei maintained a relationship with Skycom Tech Co. Ltd., which they described as an unofficial Huawei affiliate operating in Iran.

The alleged relationship with Skycom
According to the indictment, Huawei represented to banks that Skycom was a separate company while Huawei employees allegedly controlled or worked through it. The government’s theory was that this concealed relationship mattered to banks’ sanctions-compliance decisions. Huawei disputed the characterization; Skycom should not be described as Huawei itself without attribution. Why HSBC and other financial institutions were central
Prosecutors alleged that Meng made representations to HSBC and other financial institutions about Huawei’s relationship with Skycom. The indictment said Iran-related transactions then moved through U.S. financial institutions, exposing those banks to sanctions and other legal risks.
The prosecution therefore alleged more than simply that Huawei conducted business connected to Iran. Its central claim was that defendants deceived banks and the U.S. government, causing financial institutions to process transactions they might otherwise have rejected or handled differently. The charges included bank fraud, wire fraud, money laundering and obstruction. The original indictment is available as a Justice Department PDF, while the department’s case summary is at justice.gov.
What the T-Mobile “Tappy” case alleged
The Washington indictment concerned a commercial technology dispute, not a charge that Huawei had installed back doors in a telecommunications network. T-Mobile used a robot called Tappy to test smartphones’ durability and performance before launch.

The alleged effort to obtain Tappy information
According to prosecutors, Huawei employees sought confidential information about Tappy and obtained or attempted to obtain components, photographs and technical details. The government characterized the conduct as theft of trade secrets and related wrongdoing. The allegations covered activity in approximately 2012–2014, according to Justice Department materials.
The alleged obstruction
The indictment also alleged that Huawei personnel tried to conceal or limit the investigation after T-Mobile threatened legal action. That is legally distinct from the alleged acquisition of technical information: the government charged both the underlying trade-secret conduct and subsequent obstruction theories. The Justice Department’s announcement explains the Tappy allegations.
Why the announcement was often described as an espionage case
Huawei was already at the center of a broader U.S. dispute over 5G networks, Chinese technology policy and national security. That context made the January 2019 announcement sound like a general accusation of spying. But the indictments themselves alleged specific financial, trade-secret and obstruction offenses.

Those categories overlap politically, but they are not interchangeable. The January 2019 indictments did not, by themselves, prove that Huawei equipment contained back doors or that Huawei had conducted espionage in U.S. networks. Timeline: from Meng’s arrest to the 2026 case update
- 2007–2017: The New York indictment alleged the Iran-related financial scheme occurred over this period.
- 2012–2014: The Washington indictment alleged efforts to obtain Tappy information.
- December 1, 2018: Canadian authorities arrested Meng in Vancouver under a U.S. extradition request.
- January 16, 2019: A grand jury returned the Washington trade-secret indictment, according to Justice Department materials.
- January 28, 2019: The United States unsealed and announced the two indictments.
- February 13, 2020: DOJ announced a 16-count superseding indictment that added racketeering-conspiracy and additional trade-secret allegations.
- September 2021: Meng entered a deferred-prosecution agreement, and the United States withdrew its extradition request. She returned to China.
- June 17, 2026: Reuters reported that Judge Ann Donnelly ruled Meng’s admissions in the agreement could be used against Huawei at the company’s trial.
How the case expanded in 2020
In February 2020, DOJ announced a 16-count superseding indictment against Huawei and affiliates. It added racketeering-conspiracy and trade-secret-conspiracy allegations and broadened the alleged misconduct to technology from six U.S. companies. The superseding indictment also included allegations involving Iran and North Korea.
This was an expansion of the existing prosecution, not a wholly unrelated new case. The announcement is at justice.gov, and the filed document is the third superseding indictment PDF.
What happened to Meng Wanzhou?
Meng’s personal case followed a different procedural path from Huawei’s corporate prosecution. In September 2021, she entered a deferred-prosecution agreement with the Justice Department and signed a statement of facts that included an acknowledgment that she had misled a financial institution about Huawei’s Iran-related business, as reported by Reuters.

A deferred prosecution is not the same as a conviction
A deferred-prosecution agreement is a negotiated resolution in which prosecutors defer or agree to dismiss charges after specified conditions are met. It is not the same as a criminal conviction or a conventional guilty plea. Describing Meng simply as “convicted” or saying she “pleaded guilty” would therefore be inaccurate shorthand.
The United States withdrew its extradition request, and Meng returned to China. That resolved her personal U.S. proceeding; it did not automatically dispose of Huawei’s corporate case. Reuters’ account of the later evidentiary ruling is available at investing.com.

The federal prosecution of Huawei and affiliates remained an active matter in the Eastern District of New York in 2026. The case record is listed as United States v. Huawei Technologies Co., Ltd., 1:18-cr-00457 on GovInfo.
On June 17, 2026, Reuters reported that the court allowed Meng’s prior admissions to be used against Huawei at trial, a significant evidentiary ruling as the corporate prosecution moved toward trial. The latest available reporting should not be turned into a claim that Huawei was convicted: the company remained a defendant, and the case’s ultimate outcome required a verdict or other final disposition.

Huawei’s response and the legal status of the allegations
Huawei denied the allegations and characterized the U.S. action as politically motivated or legally flawed. The company said it would continue defending itself in the Eastern District of New York after Meng’s agreement. Its statement is available at Huawei’s media-statement page.
An indictment is a charging document. It means a grand jury found probable cause sufficient to charge; it is not a judicial finding that the defendant committed the crimes. Huawei and its affiliates remained presumed innocent unless prosecutors proved the charges beyond a reasonable doubt.
What the charges did—and did not—establish
- They did establish: the Justice Department brought specific federal criminal charges involving alleged financial deception, Iran-related transactions, money laundering, trade-secret theft and obstruction.
- They did not establish: that Huawei was guilty, that Huawei equipment contained back doors, or that the company had conducted network espionage in the United States.
- They did not merge the two cases: the Iran-related allegations and the Tappy allegations arose in different districts and concerned different conduct.
- They did not end with Meng’s return to China: her personal resolution and Huawei’s corporate prosecution were separate procedural matters.
Why the 2019 announcement mattered
The indictments marked a shift from regulatory restrictions and political warnings toward direct criminal prosecution of a globally important Chinese telecommunications company. Their significance rests on both the detailed allegations—alleged deception of banks and alleged theft of proprietary testing technology—and the wider U.S.–China technology confrontation surrounding Huawei’s role in communications infrastructure.
