The appeal argues that the Commission interpreted the Digital Markets Act (DMA) too broadly and imposed disproportionate, confusing requirements. Filing the case does not itself suspend the fine or the compliance order.
What Apple was fined for
On April 23, 2025, the European Commission found that Apple breached Article 5(4) of the DMA, the statute’s anti-steering obligation, and imposed a €500,000,000 fine. The Commission’s decision is recorded as Case DMA.100109 in EUR-Lex.

Anti-steering rules concern the route between a developer and its customer. Under the Commission’s finding, Apple’s App Store terms did not let developers freely:
- Tell users about offers available outside the App Store.
- Include links or other mechanisms directing users to an external purchasing channel.
- Complete transactions outside Apple’s in-app payment system.
- Communicate with users about alternative products, prices or subscription arrangements.

This is not a ruling that Apple is generally forbidden from charging a commission. The dispute concerns the combination of communication restrictions, limits on external links, conditions and fees attached to steered transactions, and Apple’s control over how external-purchase journeys work in practice.
What “anti-steering” means in practice
Consider a subscription app that sells access through Apple’s in-app billing. Its developer might also offer the same subscription on its website for a different price. Anti-steering rules determine whether the app can tell an iPhone user that the web offer exists, place a link to it, and let the user complete the purchase there.
A link that technically exists may still be ineffective if Apple’s design requirements, warnings, fees or contractual conditions make the external route commercially unattractive. That practical question—whether developers can meaningfully communicate and transact outside the App Store—is central to the case.
The legal basis: DMA enforcement, not a conventional antitrust fine
Article 5(4) of Regulation (EU) 2022/1925 requires designated gatekeepers to allow business users to communicate and contract with end users through means independent of the gatekeeper’s core platform service, including alternative offers. The Commission’s formal decision and cease-and-desist order are available in the decision PDF.

This is administrative DMA enforcement by the European Commission. It is legally distinct from the Commission’s 2024 music-streaming case against Apple under Article 102 of the Treaty on the Functioning of the European Union, summarized at EUR-Lex. It is also separate from US litigation involving Epic Games, and from rules on alternative app marketplaces and sideloading.
What the Commission ordered
Alongside the €500 million penalty, the Commission ordered Apple to stop the infringing conduct and bring its business terms into compliance with Article 5(4). The order is broader than simply permitting a second payment processor: developers must be able to communicate, steer users and support external transactions without conditions that effectively undermine those rights. The decision provides for possible periodic penalty payments if Apple does not comply.
The Commission said it considered the gravity and duration of the non-compliance. Its penalty explanation is in this Commission press document. The available materials do not establish a calculation based on a stated percentage of Apple’s worldwide revenue.
Why Apple is appealing
Apple filed an appeal at the EU General Court in 2025, as reported by ITPro. Apple’s arguments, which remain its position rather than established findings, include:

- The Commission’s interpretation of Article 5(4) goes beyond what the DMA requires.
- The €500 million penalty is unprecedented and disproportionate.
- The required App Store changes could damage privacy, security and user experience.
- The resulting rules are confusing or impractical for developers.
- Apple has already made extensive EU-specific changes to comply with the DMA.
Apple has separately argued that alternative payment and distribution arrangements can expose users to greater privacy and security risks. Those are Apple’s stated concerns, not a court finding that alternative payment systems are unsafe or that the Commission’s remedy is unlawful. Apple’s explanation is at Apple’s DMA statement.
Does the appeal pause the fine or the App Store requirements?
No automatic pause has been established. An appeal does not by itself erase the Commission’s decision or suspend its compliance order. Apple would generally need separate interim relief or a stay from the court for the operative requirements to be halted while litigation continues. The available sources do not show that Apple obtained such a stay, and they do not confirm whether the fine has been paid.
What EU developers face now
Apple’s EU developer documentation describes an evolving set of commercial choices. The terms are not necessarily identical to every remedy required by the Commission’s decision, because the Commission has separately assessed Apple’s compliance.

Why an external payment route may not be cheaper
- Third-party payment processing still has fees.
- The developer assumes more responsibility for fraud prevention, refunds, taxes and customer support.
- Leaving the app can reduce checkout completion.
- Accounts and entitlements must remain synchronized across web and app environments.
- Different prices or benefits can confuse customers using several devices.
For some subscription or digital-content businesses, avoiding an App Store payment charge may justify those costs. For others, Apple’s reach and integrated checkout may remain more valuable.
What users may notice
EU users may see more information about web offers, additional payment choices or links that leave the app. They may also encounter disclosures, redirects, separate account management and different prices between an app and a developer’s website. None of these changes guarantees lower prices: developers decide whether to pass any savings to customers, and experiences can differ by app, platform and business model.
The DMA’s geographic effect is also limited. The relevant obligations apply to Apple’s services in the European Union, so an app can have a different purchase flow for EU users than for customers elsewhere.

Spotify
Spotify has been a prominent critic and complainant in the broader dispute over Apple’s App Store and music-streaming rules. That history helps explain the policy debate, but the €500 million penalty is a DMA proceeding rather than the Commission’s separate 2024 Article 102 music-streaming decision.

Epic Games
Epic’s alternative-payment litigation in the United States concerns different statutes, courts and remedies. It should not be treated as a judgment on Apple’s EU DMA obligations.
Sideloading and alternative app marketplaces
Those are separate DMA obligations. The €500 million case is primarily about steering users to offers and transactions outside Apple’s in-app payment system, not a general requirement to allow every form of app distribution.
Latest status: the separate July 2026 gatekeeper ruling
On July 8, 2026, the General Court dismissed Apple’s challenges concerning its designation as a DMA gatekeeper for the App Store and iOS, while also addressing separate iMessage-related actions. The court release is available at curia.europa.eu.
That judgment confirms that Apple remains within the DMA gatekeeper framework and removes one possible challenge to the underlying designation. It did not, on the available court materials, decide Apple’s separate challenge to the €500 million anti-steering penalty. General Court judgments can be appealed to the Court of Justice of the European Union on points of law.
As of August 18, 2026, no verified final ruling on the €500 million fine appeal is identified in the available sources.
What happens next
- The General Court will review Apple’s legal and factual challenges to the Commission decision.
- The court will examine the interpretation of Article 5(4), the conditions Apple may impose, the evidence of ineffective steering, the proportionality of the penalty and the scope of the remedy.
- Either side may seek a further appeal to the Court of Justice on points of law after a General Court judgment.
- The Commission can continue monitoring compliance and use the DMA’s enforcement mechanisms, including possible periodic penalties for non-compliance.
- Apple’s EU business terms may continue to change while the litigation proceeds.
The Bottom Line
Apple’s appeal attacks both the Commission’s interpretation of DMA anti-steering rights and the €500 million penalty and remedy. It does not, by itself, restore Apple’s former EU App Store rules, suspend the compliance order or guarantee cheaper purchases for users.
