Meta is not being broken up. Judge James Boasberg ruled for Meta on November 18, 2025, finding that the Federal Trade Commission had not proved Meta currently held monopoly power in the legally relevant market. The FTC appealed on January 20, 2026, so the dispute remains active, but Instagram and WhatsApp have not been ordered sold as of August 16, 2026.
What the FTC case was about
Federal Trade Commission v. Meta Platforms, Inc. began in 2020, when the FTC alleged that Facebook—now Meta—illegally maintained a monopoly in “personal social networking services.” The agency focused on Meta’s purchases of Instagram in 2012 and WhatsApp in 2014, arguing that both companies were important competitive threats that Meta acquired instead of defeating in the market. The FTC’s case history is available on its official case page.
The legal issue was not simply whether Meta was large or popular. The FTC had to prove monopoly power in a defined market and show that Meta unlawfully maintained that power through exclusionary conduct, including the acquisitions.
Why a breakup was discussed
If the FTC had won, it could have asked the court for structural relief. Possible remedies included selling Instagram, selling WhatsApp, selling one of them, or requiring interoperability so users and competing services could connect more easily with Meta’s platforms.

A request for divestiture was not the same as an order to sell either service. First, the FTC needed to establish liability. Only then would the judge decide which remedy, if any, was necessary and workable. The FTC’s post-trial position is set out in its post-trial filing; contemporary coverage of the remedy debate appears in Ars Technica’s trial report.
Meta’s defense: the market is broader and changing
Meta argued that the FTC defined the market too narrowly by concentrating on services used mainly to connect friends and family. In Meta’s view, people and advertisers also choose among TikTok, YouTube and other services for short-form video, creators, entertainment, discovery and messaging.
That distinction mattered. A narrowly defined personal-social-networking market could make Meta appear dominant, while a broader social-media or attention market would include more substitutes. Meta also said its products had changed substantially since the acquisitions and that regulators had reviewed and approved the transactions when they occurred. Prior approval was relevant context, but it did not automatically prevent later antitrust scrutiny.

What happened during the 2025 trial
The bench trial lasted roughly six to seven weeks and ended on May 27, 2025. Chief Executive Mark Zuckerberg testified. The FTC relied on internal documents, acquisition strategy and evidence about competition among Facebook, Instagram and WhatsApp. Meta presented evidence about rapid changes in online services and pressure from TikTok and YouTube. Judge Boasberg allowed post-trial briefing rather than ruling immediately. Ars Technica and the FTC case record describe the trial arguments and procedure.

On November 18, 2025, Judge Boasberg ruled for Meta. The court concluded that the FTC had not proved that Meta currently possessed monopoly power in the relevant market. The primary legal holding is in the district-court opinion.

The ruling does not mean the court found that Meta never had market power or that every historical allegation was benign. It means the FTC did not meet its burden on the present monopoly-power claim required for the judgment it sought. Why the FTC appealed
The FTC filed its notice of appeal on January 20, 2026. In its appeal announcement, the agency maintained that Meta used acquisitions of serious rivals to preserve monopoly power for more than a decade.
The appeal challenges the court’s treatment of the relevant product market, Meta’s alleged monopoly power, competition from newer services and the weight given to current market conditions. Those are the FTC’s appellate arguments, not a final appellate finding. The appeal is listed as D.C. Circuit case 26-5028. No appellate decision establishing a final outcome had been identified by August 16, 2026.

If Meta wins the appeal
The district-court judgment would generally remain in place, ending this case unless another procedural step changes the result. That would not prevent separate antitrust investigations or cases involving different conduct.

If the FTC wins some or all of the appeal
The D.C. Circuit could reverse, vacate or remand the judgment with instructions. That would not automatically order Meta to sell Instagram or WhatsApp. The district court would likely need a further liability or remedy proceeding, depending on the appellate instructions.
If the parties settle
A settlement could impose conduct rules, interoperability obligations or another remedy without requiring the exact divestiture the FTC initially sought. Any settlement would need to specify how data, accounts, infrastructure, advertising systems and technical responsibilities are handled.

For now, day-to-day operations are unchanged by this case: there is no court-ordered separation of Instagram, WhatsApp and Meta. A future divestiture could produce separate owners, policies, advertising systems, moderation structures or data practices. Interoperability could make it easier to connect with competing services, but it could also raise privacy, security and moderation questions.

A breakup would not automatically close accounts, erase photos or messages, end every integration or guarantee better privacy. Those effects would depend on a detailed remedy and transition orders that do not currently exist.
What this means for advertisers and developers
Advertisers could eventually face separate sales organizations, targeting rules, measurement systems, APIs and campaign workflows. Some cross-service efficiencies might disappear, while independent services could create more negotiating options. Developers could see changes to authentication, data access and interoperability requirements.
These are scenarios, not current requirements. The FTC litigation produced no operational blueprint for separating Meta’s businesses.
Why the case matters for digital antitrust
- Market definition: Courts must decide whether personal networking, video discovery, messaging and broader social media are one market or distinct products.
- Time frame: Digital markets can change dramatically between an acquisition, a lawsuit and a trial, raising questions about which period best measures competition.
- Old acquisitions: A regulator’s earlier review does not make later scrutiny impossible, but it affects the evidence and remedy debate.
- Remedy design: Divestiture may create independent competitors but require complex separation of infrastructure, employees, data and advertising systems. Interoperability may reduce switching costs without a sale, yet creates technical and governance challenges.
Bottom line for readers
The FTC’s 2025 trial created a real possibility that Instagram or WhatsApp could eventually be separated from Meta, but that possibility never became a breakup order. Meta won in district court in November 2025, and the FTC’s January 2026 appeal keeps the legal dispute alive. As of August 16, 2026, Meta remains intact and no appellate ruling has required a sale.
