Apple’s iCloud “Trapping” Case Explained: What the 40 Million UK-User Claim Means in 2026

The UK iCloud case has been allowed to proceed, but Apple has not been found liable. Here is what the up-to-39.7-million-user claim means, who may be covered and what alternatives can—and cannot—replace.

Short version: Which? alleges that Apple unfairly favoured iCloud on iPhones and iPads, making competing services unable to offer an equivalent complete device-backup service. The UK Competition Appeal Tribunal (CAT) allowed the collective claim to proceed on June 17, 2026, but has not decided whether Apple broke competition law or whether anyone is owed compensation. Up to 39.7 million people may fall within the proposed class. The current opt-out or opt-in deadline stated by Which? is October 8, 2026.

What Apple is accused of doing

The claim was announced by the consumer organisation Which? on November 14, 2024. It alleges that Apple abused a dominant position under UK competition law, including section 18 of the Competition Act 1998. The claim also refers to the former EU Article 102 framework for the period before 2021.

These are allegations, not a judicial finding. According to the CAT’s summary and Which?’s public explanation, the alleged conduct has four connected parts:

Preferential integration of iCloud

iCloud is built into iOS and iPadOS for device backups, Apple Photos, Messages and other Apple services. Which? argues that this privileged position gives iCloud an advantage over ordinary storage apps.

Restrictions on competing full backups

The proposed claim says technical restrictions prevent rival providers from storing certain significant categories of iPhone and iPad data. In Which?’s formulation, someone seeking a comprehensive device backup can use iCloud, but cannot obtain an equivalent service from a competing cloud provider.

Insufficient information about alternatives

Which? alleges that Apple did not clearly explain that other providers could be used for particular types of storage, nor the limits of those alternatives.

Commercial pressure and alleged overcharging

The claim says users are steered towards paid iCloud plans after the free allowance is exhausted, and that they paid more, or received less free storage, than they would have in a competitive market.

“Trapped” is campaign and litigation language. It does not mean that a user is legally unable to cancel iCloud or install Google Drive, OneDrive or Dropbox. The narrower dispute is whether Apple’s technical design and integration make those alternatives materially less useful for a complete iPhone or iPad backup.

Why ordinary cloud storage is not the same as an iCloud device backup

A price comparison alone can be misleading. Services may overlap, but they do not necessarily protect or restore the same data.

A third-party app can therefore be a sensible replacement for photos or documents without being a replacement for the complete backup-and-restore function at issue in the case.

Apple’s response and likely defences

In reporting on the 2024 claim, Apple rejected the suggestion that its iCloud practices were anticompetitive and said it would vigorously defend any legal action. Apple said nearly half of its customers do not need or pay for an iCloud+ subscription, that it works to make data transfers easy, and that its prices are in line with other cloud-storage providers. Those statements are Apple’s position, not findings independently established by the CAT. The response was reported by MacRumors.

Apple’s substantive arguments may include that iCloud is an integrated privacy, security and reliability service rather than a generic storage product; that restrictions protect users or reflect technical design; and that competitors remain free to offer file, photo and synchronisation apps. Consumers can also use computers, local backups and other cloud services for some categories of data. The sources available do not show that the CAT has accepted or rejected those arguments on their merits.

What has happened in court?

The case is substantially further along than the original 2024 headline, but it has not been won.

The CAT case page contains the procedural timetable. A CPO is permission for the claim to go ahead. It is not a ruling that Apple is liable, that iCloud is unlawful, or that every class member suffered loss.

How large is the proposed claim?

Early coverage rounded the proposed class to 40 million people. Which? later described it as up to 39.7 million UK iCloud users. The figure is an estimate of the potential class, not a final count of people who will receive money.

The claim has been described as worth approximately £3 billion. An earlier report referred to an average potential payment of about £70 per eligible customer. That was an illustrative estimate tied to the original claim, not a promised payout. Individual losses, total damages and distribution will depend on the legal findings and evidence.

Who may be included?

According to Which?’s explanation after the CPO, the proposed class is defined by iCloud use, dates and residence—not simply by owning an Apple device.

Check the official Which? claim information and CAT notices for the current process. Do not rely on social-media posts or unsolicited claims agents.

Do you have to have paid for iCloud?

Not necessarily, but this remains contested. The CAT’s May 6, 2026 strike-out judgment considered “Non-Purchasing Customers”—people who did not pay for iCloud during the relevant period but might argue that the service was worth more to them than it would have cost in a competitive market.

A majority declined to remove that part of the case at the preliminary stage, describing it as a novel legal issue better assessed at trial. One judge dissented. The decision keeps non-paying users in the case for now; it does not establish that they suffered recoverable loss or will receive compensation.

What should users do now?

  1. Check the official class information. Confirm your iCloud use, relevant dates and UK residence status through Which?’s official claim process.
  2. Act by October 8, 2026 if you need to opt out or opt in. Being automatically included is not the same as being required to opt out to receive any eventual award.
  3. Protect your accounts. No legitimate claim process should require your Apple password. Avoid sites demanding upfront fees, payment details or account credentials.
  4. Audit iCloud storage before changing plans. Review what is using capacity, including backups, photos and family members’ data. If your data exceeds the lower allowance after a downgrade, syncing and backups may stop or become restricted.
  5. Make an independent backup. A Mac or PC backup can reduce reliance on cloud storage. Apple’s current guidance is at support.apple.com/108771. Keep more than one copy where possible and protect local backups from theft, loss and hardware failure.
  6. Decide by function, not just price. Establish whether you need a complete device restore, photo protection, document synchronisation, family sharing, cross-platform access or an offline copy.

Can another service replace iCloud?

Google Photos and Google Drive

These are useful for photos, files and cross-platform access, particularly in Android, Windows or Google-service households. They do not automatically recreate Apple’s complete iPhone or iPad backup and one-click restoration model. See Google One plans and Google Photos.

Microsoft OneDrive

OneDrive suits Microsoft 365 subscribers and Windows households needing document storage, synchronisation and camera uploads. It is not a full substitute for Apple Messages, app-data preservation or complete device restoration. See Microsoft’s OneDrive plans.

Dropbox

Dropbox is strong for file sharing, collaboration and multi-platform synchronisation, but is not designed as a complete iCloud device-backup replacement. See Dropbox plans.

Local Mac or PC backup

A local backup provides independence from a cloud provider but requires a computer, adequate disk space, routine maintenance and protection against loss or failure. One disk in one location is not a complete resilience strategy.

NAS or self-hosted storage

A NAS can offer control and capacity, but requires maintenance, secure remote access and an off-site backup plan. It is usually unsuitable for someone seeking a hands-off phone backup.

For Apple users who value seamless device backup, Apple Photos integration and family sharing, iCloud may remain the simplest option. Someone who mainly needs documents, photos or cross-platform access may reasonably use another provider, while keeping a separate local backup for important data. Apple’s UK iCloud page is apple.com/uk/icloud.

What happens next?

The CAT’s next listed case-management conference is on November 27, 2026. The trial is listed for the first available date in October 2028 and is expected to last about nine weeks. Until the tribunal decides liability, causation and loss, there is no confirmed breach, payout or individual entitlement.
