The United States has widened the licensing perimeter for advanced AI chips linked to China, including transactions involving overseas subsidiaries of Chinese companies. That is a significant tightening, but the evidence available through August 16, 2026 does not show one new, comprehensive law banning every AI accelerator from entering China.
The practical change is that a shipment’s destination may no longer be the decisive fact. The buyer’s Chinese headquarters or ultimate parent, ownership and control, end use, onward-transfer risk and the technology used to manufacture the product can all determine whether a U.S. license is required.
What changed in May and July 2026?
On May 31, 2026, the Bureau of Industry and Security (BIS) published guidance concerning entities headquartered in D:5 countries or Macau, including entities whose ultimate parent is headquartered there. The guidance is available at BIS’s May 31 guidance.
Reuters separately reported that Commerce moved to close a potential loophole involving advanced Nvidia chips shipped to subsidiaries of Chinese companies outside China. In practical terms, a company cannot assume that shipping to Malaysia, Singapore, the United Arab Emirates or another third country makes a transaction permissible. Compliance may require analysis of the Chinese parent, the actual end user, where the chips will be installed, whether they will support Chinese AI-model training or inference and the risk of diversion.
On July 14, Commerce Under Secretary Jeffrey Kessler said further AI and semiconductor regulation was coming. The reported remarks did not specify the products, dates, legal text or effective date. They were therefore a signal of future action, not a final rule. The report is at Investing.com’s Reuters coverage.
As of August 16, 2026, the most defensible description is an expansion and tightening of licensing and anti-diversion controls, alongside additional measures that remained under development or were reported rather than formally published.
Is this a ban or a licensing requirement?
“Export ban” is often used as shorthand for several different legal tools. A transaction can be restricted by:

- a license requirement with a presumption of denial;
- Entity List restrictions;
- end-use and end-user rules;
- foreign-direct-product rules;
- restrictions on U.S.-person support;
- anti-diversion certifications and monitoring; or
- destination and ownership-based controls.
A license requirement can operate like a ban when approvals are routinely denied, but it is not identical to a categorical prohibition. In January 2026, BIS changed its review policy to allow case-by-case consideration for certain shipments, subject to safeguards. The policy is described at BIS and in the Federal Register summary.

What case-by-case review means
Applications involving Nvidia H200, AMD Instinct MI325X and similar products could be considered individually if conditions are met. Reported conditions include customer-screening procedures, independent third-party testing in the United States, additional security commitments and assurances that exports will not reduce semiconductor capacity available to U.S. customers.
The Federal Register summary refers to a relevant category with total processing performance below 21,000 and total DRAM bandwidth below 6,500 GB/s. Those are regulatory measurements, not universal product labels or a permanent “China threshold.”
Which chips and technologies are implicated?
The rules address capabilities rather than a simple brand list. The main categories include:
- Nvidia’s advanced data-center GPUs, including Blackwell-class processors discussed in the overseas-subsidiary controversy;
- Nvidia H200 and AMD MI325X, whose eligibility can depend on case-by-case review;
- advanced-computing commodities covered by ECCNs such as 3A090 and 4A090, subject to technical notes and other provisions;
- servers containing controlled advanced-computing integrated circuits;
- high-bandwidth memory (HBM);
- semiconductor-manufacturing equipment; and
- chip-design and electronic-design-automation software.
BIS has used total processing performance, memory bandwidth, performance density and related measures. A product’s advertised “GPU speed” alone is not a reliable legal test. Controls can also reach software, technology, technical support and cloud access.
Why overseas companies and foundries matter
The Export Administration Regulations can reach transactions beyond a direct U.S.-to-China shipment. Depending on the item and facts, relevant provisions include U.S.-origin content, foreign-produced items subject to foreign-direct-product rules, controlled manufacturing equipment, U.S.-person support, end-use and end-user controls, and company-specific licensing restrictions. A Chinese AI company may design a processor and have it fabricated by a foundry outside mainland China. Lawmakers have urged tighter rules for contract manufacturers such as TSMC when they make advanced chips for overseas units of Chinese firms. That request was political advocacy, not itself a final rule; see the Reuters report.

What it means for Nvidia, AMD and the supply chain
Nvidia and AMD face a mixed regime rather than a complete shutdown of China sales. Restrictions reduce access to a major AI-compute market, while licenses can preserve some business at the cost of customer screening, testing, documentation and uncertainty.
Product designs built to fit an older performance limit can lose that advantage if policy shifts toward ownership, end use, memory bandwidth, performance density or anti-diversion requirements. Sudden changes can affect inventory, customer commitments, revenue forecasts and foundry planning.
For cloud providers and distributors, the key issue is not only who signs the purchase order. They may need to assess who ultimately controls the customer, where compute will be used, whether a restricted party can access it and whether onward transfers or in-country movement can be prevented.

What it means for China’s AI industry
The controls aim to slow access to frontier imported compute and advanced production capability, not to stop every Chinese AI activity. Likely responses include domestic accelerators, memory, packaging and manufacturing equipment; more efficient models; pooled or older-generation chips; stockpiles; and use of third-country or cloud infrastructure.
That distinction matters for investors. Reduced access can raise costs and slow scaling without eliminating China’s AI industry or its ability to develop alternatives. Enforcement quality, domestic substitution and access through indirect routes will influence the outcome.
How companies are expected to comply
BIS guidance says advanced-computing items can trigger licensing obligations when a party knows of military-intelligence or weapons-of-mass-destruction end uses, including AI-model training involving controlled commodities. The agency’s policy statement is at BIS.
A credible compliance program commonly includes:
- screening customers, beneficial owners, parents and Entity List entries;
- documenting end-user certificates and the intended installation location;
- checking whether a Chinese ultimate parent or controlled affiliate is involved;
- controlling physical access, cloud credentials and onward transfers;
- obtaining required testing or certifications;
- monitoring diversion and in-country movement;
- retaining records and audit trails; and
- reviewing servicing, technical assistance and cloud or Infrastructure-as-a-Service access separately from the hardware sale.
Compliance software can help with screening and workflow, but it cannot guarantee a license or replace transaction-specific EAR analysis. Enterprise providers such as Descartes Visual Compliance, E2open, Thomson Reuters ONESOURCE Global Trade and Kharon generally use sales-led pricing rather than published standard rates.

- Whether Commerce will publish a new ownership-based rule with specific effective dates.
- Whether cloud-compute and Infrastructure-as-a-Service access will receive additional restrictions.
- Whether foundries will face new obligations when manufacturing for Chinese-linked overseas units.
- Whether H200 and MI325X case-by-case licensing will continue under the same conditions.
- How China and affected companies may respond through domestic substitution, litigation, retaliation or alternative supply routes.
What this means for investors
The policy creates both a sales risk and a compliance opportunity. Chipmakers may lose addressable demand or face stranded inventory when eligibility changes. Foundries, equipment suppliers and cloud companies may incur screening and monitoring costs. At the same time, demand can grow for export-control software, legal advice, classification services and supply-chain due diligence.

Investors should distinguish a published rule from agency guidance, a reported enforcement move, a political request and a proposal. Those categories have different certainty, timing and financial effects.
Frequently Asked Questions
Can any Nvidia or AMD AI chip still be exported to China?
Not automatically. Certain H200, MI325X and similar applications were eligible for conditional case-by-case review in January 2026, while other products, buyers, end uses or routes may require a license or be denied.
Does shipping an AI chip to a third country avoid the China controls?
No. Chinese headquarters or ultimate ownership, the actual end user, installation location, end use, onward transfer and applicable foreign-direct-product or end-user rules can still make a license necessary.
Are the reported restrictions on Chinese data-center equipment the same as the AI-chip export controls?
No. The August 4, 2026 report concerned a draft import-security measure for Chinese data-center components entering the United States. It was separate from controls on exporting advanced AI chips and manufacturing technology.

The United States is broadening what counts as a China-linked AI-chip transaction, especially when overseas subsidiaries, ultimate parents, foundries or cloud access are involved. That is a tightening of licensing and anti-diversion controls—not proof of a universal ban on every AI accelerator or every Chinese AI company.
