Judge Yvonne Gonzalez Rogers did not dismantle Apple’s App Store or require alternative app stores on the iPhone. Her April 30, 2025 enforcement order targeted something narrower and economically important: Apple’s ability to restrict U.S. developers from telling customers about outside payment options or to impose an App Store-style commission on purchases Apple did not process. The Ninth Circuit upheld the contempt finding while allowing Apple to seek a reasonable, cost-based fee, and the Supreme Court has granted Apple’s appeal. The final legal position remains unsettled.
What changed—and what did not

The clean distinction is among distribution, payment and steering. Apple still largely controls distribution through the U.S. App Store. Developers gained more room to route payments elsewhere and to communicate that choice.
The April 30 order also referred Apple’s conduct for consideration of criminal-contempt proceedings. The Associated Press reported the ruling and referral at AP; contemporaneous coverage is also available from Reuters.
Why Epic sued Apple
In August 2020, Epic Games added an in-game payment mechanism designed to bypass Apple’s payment system and commission. Apple removed Fortnite from the App Store, and Epic sued.

The original 2021 decision was mixed. Judge Rogers largely rejected Epic’s federal antitrust theories, but found Apple’s anti-steering rules unlawful under California’s Unfair Competition Law and issued an injunction requiring Apple to let developers direct users toward outside payment options. The Supreme Court declined to take the parties’ broader appeals on January 16, 2024, leaving that injunction in force. How Apple tried to comply
Apple permitted links but imposed conditions that Epic said preserved the economic effect of anti-steering. The court filings describe requirements including prescribed link formats, limits on placement, warnings that Apple was not responsible for outside purchases, restrictions on dynamic links and account handoff, limits on how often a link could appear, and a commission of up to 27% on some resulting purchases.
Epic’s argument was practical: a link that is technically allowed but hidden, burdened with warnings or made uneconomic by a large fee may not be a meaningful alternative. Apple’s descriptions of those rules appear in its Supreme Court petition and appendix.

Why Judge Rogers found a willful violation
On April 30, 2025, Judge Rogers found that Apple had willfully violated the injunction. The order prohibited Apple from continuing the challenged restrictions and from collecting the relevant commission under the order then in effect. The court’s reasoning treated formal permission to include a link as insufficient if Apple’s surrounding rules made the alternative commercially unusable.
This was an enforcement ruling, not a declaration that Apple is an illegal monopoly under every theory Epic advanced. It addressed Apple’s conduct under the existing injunction.
What the Ninth Circuit changed
On December 11, 2025, the Ninth Circuit upheld the contempt finding but modified the remedy. Apple may seek a reasonable, cost-based fee associated with external purchases. That is different from automatically collecting the same commission charged for Apple’s own in-app-payment service. The appellate court also allowed some neutral design rules, including limits intended to prevent an external-payment button from being more prominent than Apple’s own purchase control when both are offered.

Does this apply to every app and every country?
No. Apple’s current App Review Guidelines specifically give the United States storefront different treatment: developers do not need an entitlement to include buttons, external links or other calls to action directing customers to alternative purchasing mechanisms. Many non-U.S. storefronts remain subject to regional rules and entitlements. See Apple’s App Review Guidelines.

- Physical goods and services: these generally use ordinary web or in-app commerce arrangements rather than Apple’s digital-goods billing system.
A U.S. link-out permission is not a worldwide license, and permission to link out is not the same as permission to run an alternative payment form directly inside the app.

Three different kinds of “external payment”
- Apple In-App Purchase: Apple processes the transaction under its normal rules.
- Link-out payment: the app sends the customer to a developer-controlled website.
- Alternative payment inside the app: a qualifying app uses another payment service directly in the app where Apple’s regional rules and entitlements allow it.

Prices may fall—or may not
Developers could save on some payment costs or offer a web-only discount, but the law does not require them to pass savings to customers. They may retain savings, spend more on billing operations or price the web and in-app options differently.
Refunds and subscriptions may move away from Apple
An outside purchase may no longer appear in the user’s Apple account, use the stored Apple payment method or be managed through Apple’s subscription screen. The developer generally becomes responsible for renewals, refunds, chargebacks, failed payments and access to the purchased entitlement. Apple’s documentation and prior warning language emphasize that outside purchases are managed by the developer rather than App Store billing: StoreKit documentation and the petition appendix.

Convenience and safety can differ
Web checkout may require a separate account, create purchase-portability problems and increase phishing or fraud exposure. Apple billing can be familiar and integrated, while an outside flow may offer a lower price but require a different support process.
Why a developer might still choose Apple billing
- Integrated checkout and a payment method many customers already trust.
- Apple-managed subscription controls and some refund workflows.
- Less need to build tax, fraud, chargeback and payment-support systems.
- Potentially better conversion for products whose customers prefer App Store billing.
Running billing independently shifts those responsibilities toward the developer. Teams evaluating a link-out strategy should calculate:
- Apple’s applicable fee versus processor and billing-software costs;
- tax and VAT calculation and remittance;
- fraud, chargebacks and refund workload;
- subscription-renewal and failed-payment recovery rates;
- account linking between a website purchase and an iOS account;
- customer-support capacity and geographic availability;
- whether regional rules permit the intended flow.
What happens next
The Supreme Court granted Apple’s petition on June 30, 2026, limited to one question. The docket set Apple’s opening merits brief deadline for September 14, 2026, with Epic’s response due November 13, 2026. The supplied docket record contains no Supreme Court merits ruling. Justice Elena Kagan denied Apple’s request to stay the lower-court order on May 6, 2026. That decision left the contempt-related changes in effect while further review proceeded; it did not decide the ultimate merits. The stay docket is at No. 25A1213.

The bottom line
Apple’s App Store has not been dismantled. Its control over payment routing and developer steering—especially for the U.S. storefront—has been weakened, while its ordinary distribution and App Review role remain. Consumers may see more payment choices and occasional discounts, but they may also encounter separate accounts, different refund paths and less familiar support. The Supreme Court’s pending appeal will determine how much of this change survives.
