Counterfeit-chip risk rises when legitimate supply tightens, but there is no single, worldwide semiconductor shortage in 2026. Current pressure is concentrated in AI infrastructure, selected memory, automotive and industrial parts, power devices, server components and high-end MLCCs. Buyers pushed outside franchised channels may encounter genuine but unauthorized inventory—or used, relabeled, substituted, damaged or counterfeit devices.
The practical rule is simple: treat the gray market as a sourcing channel that requires proof, not as a synonym for counterfeit. The older headline behind this story dates to October 6, 2021; it is historical context, not evidence of a 2026 market-wide flood.
Gray market, counterfeit and black market are different
U.S. federal procurement rules distinguish products sold outside an authorized territory or dealer from counterfeit goods, which include unauthorized reproductions, substitutions, alterations, false markings and used parts represented as new. See the VAAR definitions and related federal rule.

CISA identifies microchips and integrated circuits among common gray-market materials and warns that products advertised as new and authentic may instead be used, refurbished or counterfeit (CISA overview).

Why shortages create an opening for counterfeiters
- Authorized stock becomes unavailable or allocation-controlled.
- Line-down costs, missed schedules and customer penalties make speed appear more valuable than certainty.
- Spot-market prices rise, attracting brokers and opportunistic sellers.
- Procurement searches expand to independent distributors, marketplaces, excess inventory and parallel-import channels.
- Old, rejected, lower-grade or used devices can be relabeled and sold into the gap.
A historical U.S. Department of Commerce study linked counterfeit infiltration with shortages, high aftermarket prices, weak inventory accountability and reliance on gray-market parts (BIS report). Its age means it demonstrates the mechanism, not a current prevalence rate. CISA’s current guidance recommends vendor risk management, authorized sourcing, inspection and testing (CISA supply-chain guidance).
Where supply is tight in 2026
Industry reports through August 18, 2026 describe a split market rather than a universal shortage. AI-server demand is receiving allocation priority, affecting selected CPUs, PCBs, power ICs and BMC ICs. Memory and other AI-adjacent components remain constrained in some categories. TrendForce reported high-end MLCC lead times reaching about 20 weeks in June 2026 and forecast greater shortage risk in the second half of the year; these are category-specific market reports, not manufacturer-wide production statistics (April server report, June MLCC report, second-half outlook). Sourceability likewise described generally normalizing supply alongside severe AI-related pockets of tightness (Sourceability market analysis; Q2 highlights).

Availability must be checked by exact manufacturer part number, suffix, package, grade, region and date. A normal lead time for a consumer component says little about an automotive-qualified or high-power variant.
What a counterfeit chip may be
- A completely fabricated device with copied markings.
- A lower-specification or different manufacturer’s device relabeled as a more expensive part.
- A used or pulled chip cleaned and sold as new.
- A rejected or out-of-specification device resold as qualified stock.
- A genuine device with falsified date code, lot number, country-of-origin or grade marking.
- An authentic chip damaged by moisture, heat, electrostatic discharge or contamination.
- A mixed lot in which only some units are counterfeit or recycled.
Documented concealment methods include laser re-marking, chemical removal of original marks, repackaging, false serialization and package substitution. Infineon warns that counterfeit, recycled and relabeled products can closely resemble genuine parts and advises buying from Infineon or authorized distributors (Infineon guidance).

Why a suspicious part can pass a basic test
A counterfeit may have the correct dimensions, plausible markings and enough functional similarity to pass continuity checks or a low-stress prototype. It can fail only at temperature, voltage, frequency, load, endurance or environmental extremes. A commercial-grade device may work where an automotive or industrial-grade part is required; a correct part family may still have the wrong die revision, memory density, speed bin or reliability rating.
That delayed-failure pattern is especially dangerous in aircraft, medical equipment, vehicles, power systems, industrial controls and safety-critical infrastructure. A successful power-on test is evidence of limited behavior—not proof of authenticity or long-term fitness.

Verification checklist before accepting independent inventory
Qualify the supplier
- Record the legal company name, physical address, operating history and manufacturer authorization status.
- Request established OEM or EMS references, quality certifications and documented counterfeit-avoidance procedures.
- Require written return, quarantine and failure-investigation terms.
Match the lot to the paperwork
- Verify the exact manufacturer part number, suffix, package, date code, lot code and country of origin.
- Reconcile reel or tray identifiers, quantities, invoices, packing lists and certificates of conformance.
- Request chain-of-custody records, original packaging evidence and moisture-control documentation.
- Check whether the part is obsolete, recalled, restricted or end-of-life unless engineering has explicitly approved it.
Control the transaction
- Investigate prices far below authorized-channel levels and pressure to pay before documentation.
- Do not treat “factory sealed” or a certificate of conformance as independent proof.
- Forbid substitutions without written engineering approval and retain a contractual right to reject unverifiable parts.
Use a layered authentication plan

No single test detects every counterfeit mode. Sampling plans should reflect lot size, application criticality, failure cost and the confidence level the buyer needs.

Independent sourcing can be reasonable for obsolete parts, legacy repairs, emergency maintenance, small production runs, authorized aftermarket components or excess inventory with a verifiable chain of custody. It is not reasonable to accept undocumented inventory simply because it is cheaper or arrives sooner.

For a safety-critical design, require engineering approval, lot quarantine, sample testing, a documented fallback if the lot fails and contractual allocation of liability. Compare the total risk-adjusted cost—testing, scrap, redesign, recalls and downtime—not just the quoted unit price.
What failure can cost
- Intermittent field failures and difficult root-cause investigations.
- Production stoppages, recalls, warranty and replacement expense.
- Loss of customer confidence and manufacturer warranty or support.
- Regulatory, contractual and product-liability exposure.
- Security or system-behavior changes caused by a substituted device.
- Demand-forecast distortion and opaque inventory records, risks AMD highlights in its 2026 filing (AMD filing).
Broadcom likewise warns about unauthorized, open-box, as-is and non-warranty sales and may end support for gray-market or counterfeit products (Broadcom statement).
A procurement decision tree
- Is the exact part available from the original component manufacturer or a franchised distributor? If yes, use that route whenever application criticality or warranty matters.
- If not, can the seller prove authorization, provenance and intact handling? If no, quarantine the offer rather than treating it as equivalent stock.
- Is the application safety-critical or difficult to requalify? If yes, prioritize redesign, an approved alternate or a controlled aftermarket program.
- Can the organization fund testing and absorb a failed lot? If no, independent sourcing is not a controlled risk.
- Has engineering approved the part and the test plan? Release inventory only after documented acceptance criteria are met.
The strongest default is an approved-vendor list, dual sourcing, forecasts and safety stock for vulnerable families, prequalified independent suppliers for obsolescence, incoming inspection and a written counterfeit-response plan.
The Bottom Line
The gray market is not inherently counterfeit, but shortage-driven urgency reduces the distance between a legitimate alternative source and a dangerous unknown. The more critical the application, the less acceptable undocumented inventory becomes.
