On March 2, 2026, it denied Stephen Thaler’s petition in Thaler v. Perlmutter (No. 25-449), leaving a D.C. Circuit decision about one claimed autonomous AI image in place. A certiorari denial is not a Supreme Court merits opinion.
For creators, the operative distinction is human authorship. Under the U.S. Copyright Office’s January 2025 framework, a work that uses AI can still receive protection for qualifying human expression, creative selection or arrangement, and creative modifications. The analysis is fact-specific, and prompts alone generally are not enough under currently available technology.
What the Supreme Court actually did
The Supreme Court docket records a single action in Thaler’s case: “Petition DENIED” on March 2, 2026. The petition challenged the D.C. Circuit’s March 18, 2025 judgment.
- The denial leaves the D.C. Circuit judgment in effect for the dispute before that court.
- It does not explain why the justices declined review.
- It does not endorse every statement in the lower-court opinion or create a nationwide Supreme Court merits holding that settles every AI-art claim.
Calling the Court indifferent to creators is an editorial characterization of its refusal to hear the case, not a judicial finding about the value of AI art.

What Thaler’s case was about
The claimed work
Thaler sought registration for an image titled A Recent Entrance to Paradise. His application described the image as generated autonomously by his “Creativity Machine,” without human creative authorship. He repeatedly characterized the machine, rather than a person, as the creator.
The D.C. Circuit’s holding
The D.C. Circuit affirmed the Copyright Office’s refusal to register the work. For the work presented in that case, it read the Copyright Act and relevant precedent to require a human author. It also rejected a work-made-for-hire theory because, in its view, no copyrightable interest first existed in the machine-generated work to be transferred.
The court did not decide whether the Constitution independently requires human authorship. Nor did it decide the copyright status of every image made with a generative tool and some human creative involvement.

What the petition argued
Thaler’s petition argued that the 1976 Copyright Act does not require a traditional human contribution and that nonhuman authorship should be permitted. That was the petitioner’s position, not the law established by the Supreme Court.

The Copyright Office’s Part 2 report, published January 29, 2025, says existing law can address AI-generated outputs without a new copyright statute. Its framework separates material generated by a system from expression supplied or controlled by a human.
- Using AI to assist human creativity does not, by itself, eliminate copyright protection.
- Original human expression can be protected even when a finished work also contains AI-generated material.
- Human authors may claim protectable contributions, including creative selection, coordination or arrangement, and creative modifications that are perceptible in the output.
- Purely AI-generated material, or material over whose expressive elements the person lacked sufficient human control, is not protected under the Office’s framework.
- Authorship is decided case by case; there is no universal percentage of human content, number of edits, or prompt length that guarantees protection.
The Office reported receiving more than 10,000 public comments by December 2023 during its AI initiative. It also said it had registered hundreds of works incorporating AI-generated material, with protection covering the applicants’ human contributions. Those figures describe consultation and registration activity, not the percentage of AI works that qualify.

Autonomous output versus human contribution
These categories help explain why the Thaler judgment does not answer every creator’s question. They are analytical descriptions, not an automatic registration test.

Why prompts alone usually are not enough
The Office states: “Based on the functioning of current generally available technology, prompts do not alone provide sufficient control.” A prompt can communicate a concept, mood, subject or desired style, but the system may still choose the image’s specific composition, lighting, textures, spatial relationships and other expressive details.

It is whether the human contribution supplies copyrightable expression or exercises enough control over the expressive elements of the resulting work. A particular amount of prompting, manual cleanup or labor is not a safe harbor.

How protection can work in a mixed work
The Office’s discussion of Zarya of the Dawn illustrates partial protection. The human-authored text and the human’s creative selection, coordination and arrangement were registered, while the Midjourney-generated images were not treated as human-authored. A composite work can therefore contain protected and unprotected components.
That does not mean every collage, edit or layout containing generated material will qualify. The human contribution must be original, expressive and identifiable in the work, and the outcome remains dependent on the particular facts.

The Copyright Office’s March 2023 registration guidance says applicants should disclose AI-generated content that is more than de minimis and briefly describe the human author’s contribution. Before filing, check the Office’s current instructions because procedures can change.

- Identify the generated material. State which portions were produced by an AI system when that material is more than incidental.
- Describe your human contribution. Explain the original expression, selection, arrangement, coordination or modifications you created.
- Claim the right elements. Seek protection for the human-authored portions rather than representing purely generated material as your own authorship.
- Keep the description consistent. Your application should match the work submitted and the way you describe the creative process.
Registration does not turn unprotected machine-generated material into protected authorship. It records the human contribution you are claiming.
A practical recordkeeping checklist for creators
Documentation cannot guarantee registration, but it can make your authorship position clearer when you license, register or defend a work.
- Save dated drafts, source files and versions showing your original drawings, writing, compositing or edits.
- Keep prompt and generation records as a process history, without treating them as proof that prompting alone created copyright.
- Separate generated layers or components from your human-created layers where your software permits.
- Note which choices you made about selection, sequencing, arrangement, color, cropping, retouching and other expressive changes.
- Describe only the rights you can substantiate when licensing or selling the work.
- For a high-value project or a dispute, obtain advice from a U.S. copyright lawyer familiar with generative-AI workflows.
Questions this decision does not settle
Every degree of human interaction
The sources do not establish a bright-line rule for every workflow, model or future tool. Whether a person’s contribution amounts to authorship remains fact-specific, and generally available technology may change.
Copyright in AI training data
The Thaler dispute concerned authorship of an output. The legality of training an AI system on copyrighted works is a separate issue in the Copyright Office’s AI initiative and is not resolved by the certiorari denial.
Countries outside the United States
This account concerns U.S. federal copyright law. Other countries may apply different authorship standards, registration practices or rules for AI-assisted works.
What the provocative headline gets right—and wrong
It is fair to say the Supreme Court declined to engage with Thaler’s challenge. It is not accurate to convert that procedural decision into “the Supreme Court ruled that AI art cannot be copyrighted.” The lower-court ruling addressed an image presented as wholly machine-generated, while the Copyright Office’s current guidance recognizes potential protection for qualifying human contributions in AI-assisted works.
