Microsoft’s $242 Million Cortana Patent Verdict Explained—and the Settlement That Followed

A Delaware jury awarded IPA Technologies $242 million in a Cortana-related patent case, but Microsoft later settled. Here is what the verdict, patent, defenses and dismissal mean.

A Delaware federal jury awarded IPA Technologies $242 million on May 10, 2024, after finding Microsoft liable for infringing software-architecture patent claims asserted against Cortana-related systems. Microsoft challenged the verdict, and the parties later settled in June 2024. The settlement amount was not publicly disclosed, so the $242 million jury award should not be described as Microsoft’s confirmed final payment.

What the jury decided

The case was IPA Technologies Inc. v. Microsoft Corp., Civil Action No. 1:18-cv-00001-RGA, in the U.S. District Court for the District of Delaware. On May 10, 2024, the jury found Microsoft liable for infringing claims 50, 53 and 54 of U.S. Patent No. 7,069,560 and awarded IPA Technologies $242,000,000. Reuters reported the verdict, while the trial result and asserted claims were detailed in Law360’s coverage.

That was a jury verdict, not necessarily the amount Microsoft ultimately paid. Post-trial motions and a later settlement changed the practical outcome of the case.

What patent was involved?

Patent No. 7,069,560 is titled “Highly scalable software-based architecture for communication and cooperation among distributed electronic agents.” In plain English, it describes a software framework in which autonomous electronic agents can cooperate to complete tasks across a distributed system.

The patent therefore was not simply a patent on recognizing speech, answering a question, or displaying a digital assistant. The dispute focused on specified software-architecture claims and how accused systems handled requests through client devices and server infrastructure.

The lawsuit originally also asserted U.S. Patent No. 6,851,115. Before trial, the court granted Microsoft summary judgment of non-infringement on all asserted claims of that patent. The jury’s $242 million decision concerned the ’560 patent.

Why Cortana was part of the lawsuit

IPA accused technology used with Microsoft’s Cortana assistant. The litigation described Windows 10 client devices with Cortana embedded and Microsoft server systems that processed Cortana commands. Two Cortana implementations were identified in the case as the Legacy Architecture and the Cortex Architecture.

The alleged infringement concerned how those client and server components worked together under the patented distributed-agent architecture. It was not a finding that Microsoft copied Apple’s Siri branding or reproduced an entire competing product. The court record is available in the District of Delaware opinion, and a Bloomberg Law summary describes the accused Cortana systems.

Who sued Microsoft?

The plaintiff was IPA Technologies Inc., described in reporting as a subsidiary of patent-licensing company Wi-LAN. IPA had acquired the relevant patents from SRI International’s Siri-related business.

That history explains why headlines sometimes connect the case with Siri, but Apple did not sue Microsoft in this action. Apple acquired Siri Inc. in 2010; the patent asserted in Delaware was owned and litigated by IPA Technologies. Reuters’ verdict report describes the ownership history.

Microsoft’s defenses and proposed reduction

Microsoft denied infringement and argued that the patent claims were invalid. It also challenged the way IPA proved infringement and calculated damages.

  • Microsoft argued that IPA had not shown Cortana’s server software performed every required step of the claimed method.
  • It attacked IPA’s damages expert as relying on an unreliable methodology.
  • It argued that the damages instructions given to the jury were legally defective.
  • It contended that $242 million was grossly excessive.

In a post-verdict motion, Microsoft asked the court to throw out the verdict or reduce the award to approximately $1.95 million as an alternative. Law360 reported those requests, and Bloomberg Law summarized Microsoft’s legal arguments. After the verdict, Microsoft said it remained confident it had never infringed IPA’s patents and intended to appeal, according to Reuters.

Did the patent’s expiration matter?

Yes. The ’560 patent expired in January 2019, according to Bloomberg Law. Expiration did not automatically eliminate a claim for damages based on alleged infringement while the patent was enforceable. It did, however, mean the patent could not ordinarily support a forward-looking injunction requiring Microsoft to stop using the invention after expiration.

Did Microsoft ultimately pay $242 million?

That has not been established by the cited public reporting. Microsoft and IPA Technologies settled the lawsuit in June 2024, and the Delaware court dismissed the case. The parties did not disclose the settlement’s financial terms in the Reuters settlement report.

The legally precise sequence is:

  1. A jury returned a $242 million infringement verdict.
  2. Microsoft challenged the verdict and proposed eliminating it or reducing damages to about $1.95 million.
  3. The parties later settled, and the case was dismissed.

Unless a later court filing or company disclosure identifies the amount, it is not accurate to say Microsoft definitely paid the full $242 million.

Did the verdict shut down Cortana?

No public shutdown order resulted from this verdict. The case involved historical Cortana implementations and a patent that had already expired. The subsequent settlement and dismissal also do not establish that the lawsuit caused Microsoft to discontinue Cortana or that current Microsoft products infringe the patent.

Microsoft’s broader product decisions about Cortana should be kept separate from this litigation. A patent-infringement verdict can concern past use of a patented architecture without requiring a product ban, particularly when the patent has expired.

How this case fits broader patent litigation

IPA’s patent campaign also involved other large technology companies. Reuters reported that Amazon defeated IPA’s lawsuit in 2021, while litigation involving Google was still ongoing when Reuters covered the Microsoft verdict. Those cases provide context for IPA’s broader enforcement effort but do not change the Microsoft-specific result.

What the headline gets right—and leaves out

  • Right: A real Delaware jury awarded IPA Technologies $242 million after finding Microsoft liable for patent infringement.
  • Incomplete: The verdict concerned three claims in one patent, not every aspect of Cortana or voice-assistant technology.
  • Important qualification: The patent had expired in January 2019, and the case later ended in a settlement and dismissal.
  • Not established: The public reports cited here do not show that Microsoft paid the full $242 million.
  • Not implied: Apple was not the plaintiff, and the verdict was not a Cortana shutdown order.

Bottom line

The $242 million figure was a genuine May 2024 jury award against Microsoft over specified claims in IPA Technologies’ distributed-agent software patent. Microsoft disputed both infringement and damages, then settled the case in June 2024. Because the settlement terms were not disclosed, the jury’s award is not the same thing as a confirmed final payment.
