Meta already cut the price of ad-free Facebook and Instagram in Europe: in November 2024, it announced a 40% reduction, to €5.99 a month for the first account on the web or €7.99 on iOS and Android. The dispute has since moved beyond price. EU regulators challenged Meta’s original “consent or pay” model, and they are still assessing whether the newer free option for less-personalized ads gives users a meaningful choice.
What Meta’s European choices mean
Meta’s model has three broad routes, though users may not see them in the same order or at the same time:
- Free with personalized ads: users do not pay, and Meta uses personal data to tailor advertising.
- Free with less-personalized ads: ads remain, but Meta says it relies more on contextual information—such as what someone is viewing during a session—and a limited set of data points, including age, location, gender and ad interactions. This is not an ad-free option. Meta described this choice when it announced its price change: Meta’s November 2024 announcement.
- Paid with no ads: Meta’s subscription removes ads covered by the offer. It does not mean Meta stops processing all information about the account, device or use of its services. Meta’s earlier explanation concerned information being used for ads, not a blanket end to data processing: Meta’s explanation of its EU ad-processing approach.
The substance and presentation of the options matter as much as their existence. The European Commission’s objection has focused on whether users can choose a genuinely equivalent service using less personal data, and whether consent to personalized advertising is freely given.
What the ad-free subscription costs
Meta’s November 12, 2024 announcement cut the first-account price from €9.99 to €5.99 a month on the web and from €12.99 to €7.99 on iOS and Android. The announcement also listed charges for additional accounts after the initial period.

These are Meta’s announced rates, not a guarantee of the price every user will see at checkout in August 2026. Country, platform, taxes, account setup and later changes can affect the offer. The original European offer covered the EU, EEA and Switzerland. The UK is a separate case: in September 2025, Meta announced a UK ad-free subscription at £2.99 a month on the web or £3.99 on iOS and Android, following discussions with the UK Information Commissioner’s Office. Why the European Commission challenged the model
Meta introduced its original “consent or pay” arrangement in November 2023. Users were asked to consent to the combination of personal data for personalized advertising or pay for an ad-free version. The Commission’s concern was not simply that the subscription cost too much. It examined whether refusing personalized ads left users with a sufficiently equivalent service that used less personal data, and whether the choice to consent was genuinely free.
On April 23, 2025, the Commission formally found that Meta’s original model breached Article 5(2) of the Digital Markets Act (DMA). In its view, Meta had not offered users the required specific choice of a service using less personal data while otherwise remaining equivalent. The DMA is the Commission’s main enforcement framework in this dispute because Meta is designated a gatekeeper and the case concerns how it uses personal data across services. The GDPR governs personal-data processing and consent more broadly; the Unfair Commercial Practices Directive may also be relevant to concerns about misleading or pressuring interface design. These legal frameworks overlap, but the April 2025 DMA finding should not be mistaken for a final ruling on every question under data-protection or consumer law.

The Commission said it would assess implementation, user uptake and effects after the January 2026 change. Its acknowledgment of Meta’s undertaking is not blanket approval of the revised design or a declaration that every compliance issue is resolved.

Why the January 2026 choice is still contested
BEUC, the European Consumer Organisation, argued in March 2026 that the revised model still failed to secure free, specific, informed and unambiguous consent and could continue to breach the DMA, GDPR and Unfair Commercial Practices Directive. Its analysis raised concerns that the less-personalized option was not presented upfront and on the same level as the other choices, that consent remained unclear or pressured, and that users selecting less-personalized ads could receive a degraded experience. These are BEUC’s allegations and analysis, not a new final Commission ruling.
BEUC’s account of the concerns is available in its March 2026 statement and detailed analysis. The exact prompt and order a particular user sees can change, so those critiques should not be treated as proof that every account receives an identical screen.

Meta’s defense and the advertising trade-off
Meta argues that EU law and a July 2023 Court of Justice of the European Union judgment recognize that a subscription can be a way to obtain consent. That judgment did not automatically validate Meta’s precise interface, prices or implementation; the Commission assessed the company’s specific model under the DMA. Meta also argues that requiring a free less-personalized service goes beyond what the law requires and that such ads are less effective commercially. Those are Meta’s legal and business positions, not findings by the Commission.
For advertisers, the dispute creates a tension: Meta seeks to preserve personalized advertising, while regulators want users to have a meaningful alternative that relies on less personal data. If more users choose less-personalized ads, advertisers may have weaker targeting and measurement. Meta says its less-personalized product uses almost 90% less data and produces poorer engagement and advertising outcomes; those are company claims, not independent measurements. Meta has also cited a company-commissioned analysis estimating that its platforms were linked to €213 billion in EU economic activity and 1.44 million jobs in 2024. What to check before choosing
If you are deciding between the options, focus on what the checkout screen and current terms say for your country and accounts. A headline monthly price does not by itself establish the cost for multiple linked accounts or every applicable tax, and a mobile purchase may be priced differently from a web purchase.
- Confirm whether the choice is available in your location: EU, EEA, Switzerland and UK arrangements are not interchangeable.
- Check which Facebook and Instagram accounts are covered through Accounts Center and whether additional accounts cost extra.
- Choose based on the distinction that matters to you: no ads, fewer-personalized ads that still include advertising, or free access with personalized ads.
- Read the current subscription terms and privacy controls. “No ads” is not the same as “no data collection” or “no processing.”
- Do not assume that every user, including minors, receives the same choices or is eligible on the same terms; confirm the rules shown for the account.
Is the dispute over?
No. As of August 18, 2026, the Commission’s December 2025 announcement described monitoring of Meta’s new choice, while BEUC’s March 2026 analysis continued to challenge the implementation. The available developments establish neither a final Commission finding that the January model complies nor a later ruling resolving the dispute. Meta’s appeal of the 2025 decision is part of its challenge to the Commission’s interpretation; the existence of a revised model alone does not settle that case.
