Donald Trump’s November 12, 2024 announcement did not create a cabinet department. It presented Elon Musk and Vivek Ramaswamy as leaders of an outside-government advisory effort called the Department of Government Efficiency (DOGE). A later executive order, issued January 20, 2025, created a formal but temporary federal structure by renaming the United States Digital Service and establishing a DOGE organization within it. Those are separate steps, and treating them as the same institution produces a misleading picture of DOGE’s legal status.
What Trump announced on November 12, 2024
Trump’s president-elect announcement named Musk and Ramaswamy to lead DOGE and described an effort to dismantle bureaucracy, reduce excess regulations, cut expenditures and restructure federal agencies. It said the two would provide “advice and guidance from outside of Government” while partnering with the White House and the Office of Management and Budget (OMB). The announcement gave the work a target end date of July 4, 2026.

That wording matters. The announcement used “Department” as part of the initiative’s name, but it did not establish a new cabinet department through legislation or an executive order. Contemporary Associated Press coverage characterized the proposed group as not being a government agency and said its operating arrangements were unclear. AP also raised whether the group might be subject to the Federal Advisory Committee Act; that was a contemporaneous legal question, not a settled court ruling.
The spending figure in the announcement
Trump’s statement referred to $6.5 trillion in annual government spending. That is a figure asserted in the November 12 announcement, not an independently verified budget estimate established by the materials available for this article.

What “outside of Government” implied
The announcement’s language suggested an advisory relationship with the White House and OMB rather than ordinary federal employment. It therefore did not make Musk and Ramaswamy equivalent formal officials of a federal department. Musk’s accompanying comment that the effort would “send shockwaves through the system” was political messaging about the intended impact, not a description of legal authority.
What changed with Executive Order 14158
On January 20, 2025, Trump issued Executive Order 14158, creating a different and more formal arrangement. The order publicly renamed the United States Digital Service (USDS) as the United States DOGE Service (USDS), placed it in the Executive Office of the President, and established a temporary organization within it. It also directed agency heads to create DOGE teams.
The structure created by the order
- United States DOGE Service: the renamed USDS in the Executive Office of the President.
- Temporary DOGE organization: an organization established inside USDS rather than a new cabinet department.
- Agency DOGE teams: teams that executive-branch agencies were directed to establish.
- Technology mandate: the USDS administrator was assigned a software-modernization initiative covering federal software, networks and information-technology systems.
Section 1 of the order said it established the Department of Government Efficiency to implement the President’s DOGE agenda by modernizing federal technology and software. In institutional terms, however, the order’s operative design was a renamed service, a temporary organization and agency-level teams—not a newly created department comparable to the Departments of Treasury, Defense or Labor.
The scheduled sunset
The order set July 4, 2026 as the termination date for the temporary organization. It also specified that the sunset would not, by itself, terminate other authorities or provisions of the order. That distinction means the temporary organization’s end date was not automatically a termination date for every DOGE-related activity or legal provision.

Were Musk and Ramaswamy government officials?
Elon Musk
The Government Accountability Office (GAO) reported that Musk worked in the White House as a senior adviser and special government employee. According to administration officials cited by GAO, he did not hold a position in USDS. GAO described him as assisting USDS personnel, and Trump called him the leader of the overall effort in February 2025. Musk left his White House position in May 2025.
That record is different from saying Musk was the head of a cabinet department or a formal USDS officeholder. His role combined a White House position with work assisting the DOGE effort.
Vivek Ramaswamy
Ramaswamy was named alongside Musk in the November 2024 announcement, which presented both as leaders of the proposed outside-government initiative. The materials available here do not establish that he held an equivalent formal position in USDS after Executive Order 14158. The announcement’s joint branding should not be read as proof that both men occupied the same federal status.
How many people worked on DOGE?
GAO identified 206 people who held positions within the Executive Office of the President from January 20, 2025, through January 31, 2026, in the scope of its review. That is a defined GAO count, not a complete tally of everyone who advanced DOGE initiatives.

From proposed outside group to federal structure
The chronology is the clearest way to reconcile apparently conflicting descriptions:
- November 12, 2024: Trump announced Musk and Ramaswamy as leaders of an outside-government advisory effort called DOGE.
- January 20, 2025: Executive Order 14158 renamed USDS as the United States DOGE Service, created a temporary organization within it and directed agencies to form DOGE teams.
- May 2025: Musk left his White House position, according to GAO’s account.
- November 2025: OPM Director Scott Kupor said DOGE no longer existed as the centralized entity it had been, while saying its principles remained and that OPM and OMB would institutionalize changes.
- July 4, 2026: the temporary organization reached the termination date specified in the executive order.
As of September 28, 2026, the available evidence does not independently establish every operational detail after that sunset. It does establish that the temporary organization had a scheduled end date and that a senior OPM official had already described DOGE as no longer existing as the centralized entity it once was.
So was DOGE a real government department?
Not when Trump first announced it. The November 2024 announcement described an outside advisory effort and did not itself create a cabinet-level department. A federal DOGE-related structure was established later. Executive Order 14158 renamed USDS, placed the renamed service in the Executive Office of the President, created a temporary organization inside it and required agency DOGE teams.
