Whether wine can be shipped to your state depends on the destination’s current law and on whether the seller is an eligible shipper—not simply on whether a winery will accept your order. States may limit who can ship, how much a person can receive, and what permits, taxes, delivery checks and carriers are required. The examples below show how those rules vary; they are not a complete, verified legal listing for all 50 states and Washington, D.C.
Can wine be shipped to your state?
There is no single nationwide permission that makes every winery, retailer or carrier eligible to ship wine to every state. A consumer order is possible only if the seller may legally ship to the destination and can meet that state’s requirements. Rules can distinguish wineries from retailers and may require the shipper to hold a state permit.
A Wineport reference table displays 42 jurisdictions as allowed, seven as restricted and two as prohibited across the 50 states and Washington, D.C. It attributes the table to Wine Institute data updated May 20, 2025, so those figures are a dated orientation—not a verified count of current law. The table labels Delaware and Utah prohibited, and Indiana, Louisiana, Mississippi, New Jersey, Oklahoma, Rhode Island and Wyoming restricted. The states below illustrate several different rule patterns. They do not establish the current rules for states not listed.

What to check before placing an order
- Confirm the destination rule. Use the alcohol regulator for the state where the wine will be delivered. A broad state table can help locate questions, but it may be out of date or omit details that apply to your order.
- Identify the seller’s legal category. Ask whether the seller is a winery, retailer or another type of shipper, and whether it holds the permit or license required for your state. A seller’s willingness to take payment does not prove it can legally fulfill the shipment.
- Check the quantity cap and its time period. Find out whether the limit is per person, household or consumer, and whether it applies monthly, annually or over another period. Do not assume a state with no stated cap in a summary has no limit.
- Ask who handles taxes and reporting. State rules may require the shipper to collect or pay taxes and submit reports. The Pennsylvania and Washington examples show that these obligations can be part of direct shipping even when an order is otherwise permitted.
- Confirm delivery and package conditions. Requirements may include age verification, an adult signature, delivery to a particular recipient, required wording on the package and use of an authorized carrier. Ask the seller how it will satisfy the destination’s rules.
Federal law does not create a general right to ship wine
Federal law, 27 U.S.C. § 124, provides a narrow conditional route when Federal Aviation Administration passenger restrictions are in effect for safety. It concerns wine purchased while the buyer is physically present at a winery and shipped to another state or Washington, D.C. The purchaser must verify legal age; the package must require an adult signature; the wine must be for personal use, not resale; and the purchaser must be allowed to carry it lawfully into the destination. This provision is not a general authorization for wineries or retailers to ship wine across state lines. Read the text of 27 U.S.C. § 124.

Direct-shipping summaries are snapshots, and status counts alone do not answer whether a particular seller can send a particular order. Wine Institute’s compliance page records later changes, including a Louisiana container-size update dated June 4, 2026, and a Wyoming update dated May 21, 2026. A 2023 Maine Legislature report, which described 46 states and Washington, D.C. as allowing some form of direct-to-consumer wine shipping at that time, is historical context rather than a current count. Check the relevant regulator and current statute for the destination state before relying on a summary.
