Right to Disconnect: What Countries Grant It in 2026?

No country grants a simple, unconditional right to ignore work contact after hours. Here is what the EU baseline, France, Ireland, Luxembourg, Australia and Canada actually provide, with dates and limits.

No country grants a simple, unconditional right to ignore work contact after hours. Laws described as a “right to disconnect” differ in who they cover, what they require of employers, and how they are enforced. As of October 2026 there is no official worldwide list dated to this year. The best-documented country count is Eurofound’s June 2023 snapshot of EU member states, which found nine with legislation. Outside Europe, Australia has the clearest statutory individual right, with staged start dates in 2024 and 2025 and an “unreasonable refusal” limit. Canada’s federal position remains a policy debate. Treat any single “countries in 2026” total as provisional.

What the phrase covers

“Right to disconnect” is shorthand for rules that govern work communication and availability outside working hours. Those rules are not all the same kind of legal instrument, so one label can describe very different protections. Five types appear in the evidence:

  • An individual right to refuse. A worker may decline contact outside hours, subject to conditions. Australia is the clearest example.
  • A statutory right tied to telework. Coverage is linked to remote or teleworking arrangements. The European Commission’s comparative study places Greece, Italy and Slovakia in this group.
  • A duty to negotiate or set rules. The employer must bargain over, or adopt a charter setting out, how the right is exercised. France works this way.
  • A code of practice. Guidance without formal legal status, which courts may nonetheless take into account. Ireland’s 2021 code is the main example in the sources.
  • A policy debate. Recommendations under consideration that have not become law. Canada’s federal advisory committee report falls here.

None of these is an unconditional ban on after-hours contact. What a worker can actually do depends on which instrument applies and on the conditions attached to it.

  • Exceptions: urgent contact, job role, on-call work, or a refusal that is judged unreasonable.
  • Enforcement: sanctions, dispute resolution, or general working-time remedies. The European Commission’s comparison found that sanctions vary between the countries it reviewed.

European Union: the June 2023 baseline

Eurofound’s report on implementation at company level states: “In June 2023, nine Member States had legislation providing a right to disconnect.” It is the most useful dated comparison of EU national approaches available for this article, but it is a snapshot. National texts may have been amended since 2023, so it should not be read as a 2026 count.

The European Commission’s comparative study adds two distinctions. The first is coverage: it ties the statutory right to telework in Greece, Italy and Slovakia, while Belgium, Croatia, France, Ireland, Portugal and Spain do not limit it exclusively to teleworkers. The second is implementation: the Commission describes collective bargaining, individual agreements and workplace policies as routes to applying the rules, and says sanctions differ from one country to another.

France: a negotiation duty, not a blanket ban

Since 1 January 2017, companies in France must hold mandatory collective negotiation on how employees fully exercise their right to disconnect, framed around quality of life and working conditions. The French Ministry of Labour’s page “Le droit à la déconnexion,” published 4 December 2025, states this in French. The following English rendering is this article’s own translation: “Since 1 January 2017, mandatory collective bargaining within companies must address the arrangements for the full exercise by the employee of their right to disconnect, under quality of life and working conditions.”

If no collective agreement is reached, the employer’s charter should allow the right to be applied effectively. The practical result is company-level arrangements rather than a rule that stops every message. A French employee should check the company’s agreement or charter first, because that document is where the working rules are set.

Ireland: a code with no formal legal status

Ireland adopted a Code of Practice in 2021. Eurofound reports that the code has no formal status in law, but a court may use it when deciding a case. It therefore sits outside the statute book: it can shape how a dispute is decided without being a statute in its own right. A 2026 peer-reviewed article on selected European models draws the same line between statutory measures and Ireland’s code.

Luxembourg: a 2026 fine date that is not yet verified

A 2026 secondary update on European remote work reports that specific employer regimes have applied in Luxembourg since July 2023, and that administrative fines of €251 to €25,000 take effect from 1 July 2026. Both dates have passed as of October 2026. This article could not confirm the fine detail against the official text on Legilux, Luxembourg’s official gazette, or against inspection guidance. Treat the fine range as reported rather than confirmed, and check Legilux before relying on it.

Australia: the clearest statutory individual right

Australia’s Fair Work Act gives employees a right to refuse contact outside working hours. The Fair Work Ombudsman’s summary, “New right to disconnect laws” (updated 26 August 2025), puts it this way: “Employees have the right to refuse employer or third-party contact outside of working hours.” The reference to third parties matters: the right is not limited to messages from the employer itself.

The right is not absolute. Employees may refuse unless the refusal is unreasonable. Reasonableness is assessed by reference to the following considerations:

  • the purpose of the contact;
  • how far the contact disrupts non-work time;
  • whether the employee receives extra pay or compensation for being available or working outside hours;
  • the nature of the employee’s role;
  • the employee’s personal circumstances.

The staged start dates in the status table apply to different employers, so check your employer’s size category before assuming which date applies. The sources reviewed do not state how disputes are enforced; the Fair Work Ombudsman’s guidance is the place to check that point.

Canada: a federal debate, not an enacted right

At the federal level, an advisory committee report records a policy debate and differing stakeholder recommendations on a right to disconnect. It is a report, not an enacted federal right. Existing protections in the Canada Labour Code on hours of work, rest and compensation still apply to federally regulated workplaces, but they are not a named right to disconnect. Provincial and territorial rules are separate, and the sources reviewed do not cover them, so a worker in a province should look up that province’s employment standards directly.

Can my employer contact me after work?

The evidence does not support one answer across countries. Whether an employer may contact you outside hours depends on where you work, which instrument applies, and what your contract and workplace policy say. A practical check:

  1. Identify your country and whether the rule is a statute, a code, a negotiation duty or only a proposal, using the status table above.
  2. In Australia, confirm your employer’s size category and the start date that applies to you, then apply the refusal considerations listed above.
  3. In France, ask for your company’s agreement or charter on the right to disconnect. If none exists, the employer’s charter should set out how the right is applied.
  4. In Ireland, read the Code of Practice alongside your employer’s policy, since a court may take the code into account.
  5. Check your employment contract for on-call duties or standby pay, because these are among the considerations in Australia’s test.
