What to Do When Your Mortgage Servicer Raises Your Escrow Payment

Compare the new escrow analysis with your tax and insurance bills, check how any shortage is being collected, and use the servicer’s written dispute process if the figures appear wrong.

If your mortgage servicer raises your escrow payment, compare the new escrow analysis with your property-tax bill, insurance renewal, and prior account history. A higher tax bill or premium can explain the increase; a prior-year shortage can add a temporary repayment amount. If the figures do not make sense, ask the servicer for an explanation and, if you suspect an error, send a written notice of error or request for information to its designated address. Keep making your scheduled mortgage payments while the servicer responds.

Why did my escrow payment go up?

Your mortgage payment may include principal and interest, an escrow deposit, and sometimes fees. An escrow account holds money to pay bills such as property taxes and homeowners insurance. When those bills rise, the servicer may increase the monthly escrow deposit. A shortage from the prior year may add a separate, temporary repayment amount. Other causes of a payment change can include a temporary buydown ending, a new fee, or a servicing mistake. Compare the itemized statements to see which part changed before assuming the entire increase is escrow. The CFPB explains common reasons a mortgage payment can change; escrow requirements are set out in Regulation X, 12 CFR § 1024.17.

How to check the annual escrow analysis

The annual statement should let you compare what the servicer expected with what actually happened. Regulation X requires it to show the current and prior monthly payment and escrow portions, deposits and disbursements during the prior computation year, the ending balance, and how a shortage or surplus will be handled. It must also explain relevant differences between the prior projection and actual account history.

  1. Separate the payment components. Compare your old and new mortgage statements. Identify whether the change is in escrow, principal and interest, or a fee. Ask the servicer to clarify any unexplained item.
  2. Verify the bills behind the projection. Compare the projected property-tax amount with the current bill from your local tax authority, and the insurance amount with your policy renewal or premium notice. Check for a change in the assessed value, tax amount, premium, or coverage.
  3. Reconcile the account history. Match the analysis’s deposits and tax or insurance payments against your records. Check the ending balance and any explanation for why actual activity differed from the previous projection.
  4. Identify the balance issue. A shortage means the balance is below the target balance; a deficiency means the balance is negative; a surplus means it is above the target. The repayment rules differ, so check which term the analysis uses.
  5. Ask for missing details. Request the annual escrow analysis, the tax and insurance figures used, the account history, the shortage calculation, and the date the new payment takes effect. The CFPB recommends contacting the servicer about suspected escrow problems.

Can the servicer make me pay an escrow shortage all at once?

Federal rules distinguish a shortage from a negative-balance deficiency and provide different options depending on the amount and whether the borrower is current. For these provisions, a borrower is current when the servicer receives payments within 30 days of the due date; a borrower in default may be treated differently. State law or the loan documents may also require a lower escrow cushion than the federal maximum, which is generally one-sixth of estimated annual disbursements.

Deficiency equal to or greater than one month’s escrow payment The servicer may leave it in the account or collect it in two or more equal monthly payments.
Surplus of $50 or more The servicer generally must refund it within 30 days after the analysis.
Surplus below $50 The servicer may refund it or credit it against the next year’s escrow payments.

These are the options specified in 12 CFR § 1024.17. The annual statement should explain how the servicer is handling the balance. Do not assume the rules for a shortage below one month’s escrow payment allow the same collection method for a larger shortage.

How to dispute an escrow analysis

Start with a documented call if you need a quick explanation: note the date, representative, reference number, and requested correction. If that does not resolve the issue, send a written notice of error describing the suspected servicing or calculation mistake, or a written request for information seeking the escrow analysis and account details.

  1. Find the servicer’s designated address for notices of error or information requests on your mortgage statement or its website. It may differ from the payment address.
  2. Include identifying information for the borrower and loan. State the suspected error or requested information plainly, and attach relevant documents such as a tax bill or insurance renewal.
  3. Do not put the notice on a payment coupon. Keep a copy and proof of delivery.
  4. Continue making mortgage payments as scheduled while the servicer reviews the request.

The CFPB’s mortgage dispute guidance says servicers generally must acknowledge a written notice within five business days and respond within 30 business days, excluding weekends and legal public holidays. Rule-specific exceptions and extensions can apply. If the servicer does not respond or the issue remains unresolved, you can learn about next steps from the CFPB, including submitting a complaint.

What if the servicer did not pay a tax or insurance bill?

Contact the servicer immediately and send a copy of the bill with a notice of error. Also contact the tax authority or insurer promptly to confirm the amount due and avoid further escalation. Unpaid property taxes can lead to a tax lien. Federal rules generally require a servicer holding escrow funds to make covered disbursements on or before the deadline to avoid a penalty. If the problem is not corrected promptly, consider contacting an attorney or a HUD-approved housing counselor—especially if foreclosure is imminent or you have been served legal papers.
