What to Look for When Choosing a Regulated Crypto Exchange

Check the exact legal entity, its official register entry and the activities its permissions cover before comparing an exchange’s services and fees.

Start with the country where you live and the exact legal entity that will provide the exchange service. Check that entity on the relevant regulator’s official register, confirm what activities its permissions cover, and compare the specific products and fees you plan to use. A register entry is evidence of recorded status and scope—not a blanket endorsement or a guarantee that a crypto investment is safe.

How do I check if a crypto exchange is regulated?

  1. Identify the jurisdiction. Check the rules that apply where you live and where the service is offered. Find the official regulator and register for that jurisdiction; there is no single global definition of a “regulated crypto exchange.”
  2. Find the legal entity. A trading brand may not be the name of the company that provides your service. Locate the firm’s legal name and, where available, its regulator reference number. Search for that entity rather than relying on a brand name, app listing, or a platform’s own claim.
  3. Use the regulator’s register. Search the official register and read the firm’s recorded status and permissions. Do not treat an entry as proof that every product is covered or that the regulator recommends the firm.
  4. Match the record to the service. Compare the register’s permitted activities and contact details with the service and contact information the exchange gives you. If the details do not match, pause and resolve the discrepancy with the regulator or the firm using independently verified contact information.
  5. Check the particular product and transaction. Confirm that the permission and applicable rules relate to what you intend to do, not just to some other activity offered by the same company.

How do I know if a crypto exchange is licensed in my country?

“Licensed” is often used loosely in marketing. The relevant question is whether the specific entity has the status and permissions required for the activity it provides in your jurisdiction. Different countries, regulators, activities, and assets can be treated differently, so a result in one country’s register does not establish permission everywhere.

Example: checking a UK firm with the FCA

For a UK check, the Financial Conduct Authority (FCA) says consumers can search the Financial Services Register by firm name or Firm Reference Number (FRN). Check the activities and services the firm may provide, then compare the register’s contact details with those supplied to you by the firm. The FCA’s consumer guidance says: “If you can’t find a firm on the FS Register, it’s unlikely the firm has permission to offer you crypto products and you should avoid using the firm.”

This is UK-specific guidance, not a rule for interpreting another country’s register. FCA guidance also says that firms providing certain in-scope cryptoasset services by way of business in the UK must register before starting. The UK financial promotions regime applies to firms marketing cryptoassets to UK consumers regardless of where the firm is based. The FCA’s examples distinguish that marketing rule from the question of whether an overseas business is carrying on business in the UK for the registration requirement. Example: U.S. securities-law scope

In the United States, the Securities and Exchange Commission (SEC) explains that federal securities laws apply to securities, including crypto assets when they are securities. It also notes that some crypto assets that are not securities may be subject to those laws when offered and sold as part of an investment contract. This illustrates why the asset and transaction matter; it is not a complete checklist for licensing a U.S. crypto exchange. See the SEC’s crypto asset investor information.

Does FCA registration mean a crypto exchange is safe?

No. Registration tells you something specific about a firm’s recorded status and, where shown, the scope of its permissions. It is not a recommendation, a guarantee against loss, or proof that every service the firm offers is suitable for you. The FCA tells firms not to imply that registration is an endorsement; its cryptoasset guidance sets out the UK regulatory context.

A register check also does not answer every question about an exchange’s security, financial condition, liquidity, customer service, or the risks of a particular crypto asset. Assess those issues separately; do not infer favorable answers from a registration entry.

What should I compare before opening an account?

Use the same checks for each candidate, and compare like with like. A practical comparison is limited to details you can verify in the official record and the exchange’s own service information:

What to compare What to verify Why it matters
Legal entity and register status Exact company name, reference number if available, and current entry in the relevant official register. A familiar brand name alone may not identify the firm providing the service.
Permission scope Activities and services recorded by the regulator, compared with the service you intend to use. A firm’s permission for one activity does not establish permission for every product or service it offers.
Identity and contact details Whether the register’s firm details and contact information match the details given to you. A mismatch is a reason to stop and verify who you are dealing with.
Products and services The specific crypto products and services available to you in your jurisdiction. Products can differ in legal treatment and risk; check the one you intend to use.
Fees The fee structure for the services and transactions you expect to use. Compare the actual service costs rather than relying on a broad “low fees” claim.
Jurisdiction and activity The country where the service is offered, your location, and the activity involved. Regulatory requirements depend on jurisdiction and activity, not just the exchange’s brand or headquarters.

The FCA’s guidance for firms applying to register identifies products and services, fee structures, customer base, and transaction flows as information relevant to an application. These are useful prompts for questions about an exchange, but application guidance is not evidence that any particular provider meets those standards. What should I do if the register and exchange details do not match?

  • Do not deposit funds or share more information while the discrepancy is unresolved.
  • Check that you searched the exact legal entity and the correct regulator’s register.
  • Use contact information independently obtained from the regulator’s official register to ask about the firm or its permissions.
  • Do not rely on a link, phone number, or explanation supplied by someone pressuring you to act quickly.
  • If the firm cannot be verified for the service in your jurisdiction, choose not to proceed until you can establish its status.

What a regulatory check cannot tell you

A register-based comparison can help establish which entity appears on a regulator’s record and what activities its permission covers. It cannot, by itself, rank exchanges or establish which has the strongest security, solvency, liquidity, support, or asset selection. Treat those as separate questions, and do not mistake regulatory status for protection from crypto-market losses.
