What Crypto Exchange Customer Protections Do—and Don’t—Cover

Crypto held at an exchange generally is not FDIC- or SIPC-protected if the platform fails. The actual protections depend on the asset, custodian, account terms, and applicable law.

For U.S. customers, crypto held at an exchange is generally not protected by FDIC deposit insurance or SIPC if the exchange fails. A platform’s regulatory status, bank relationship, or insurance claim does not by itself guarantee that customers will recover crypto after a hack, frozen withdrawals, or bankruptcy. The answer depends on what asset you hold, which legal entity holds it, and the account and custody terms.

Is my crypto exchange account FDIC insured?

No. FDIC insurance protects eligible deposits at FDIC-insured banks under federal deposit-insurance rules; it does not insure cryptocurrency or protect customers from a non-bank crypto exchange or custodian defaulting, becoming insolvent, or filing for bankruptcy. The FDIC also says it does not insure crypto customers against theft or fraud.

A company may say it places customers’ cash with a bank. That does not make the customer’s exchange balance automatically insured. Coverage depends on the actual account arrangement, legal ownership, and required records. Identify the bank and the entity holding the funds, and check whether the account structure meets the conditions for any applicable pass-through coverage. Do not treat a crypto balance as an insured bank deposit merely because the platform uses a bank.

Does SIPC cover crypto?

Generally, SIPC is not a general fund for crypto losses. Its role is tied to liquidation of SIPC-member firms and missing customer securities or cash within the framework of the Securities Investor Protection Act (SIPA). SEC Division of Trading and Markets staff says SIPC protection does not apply to customer claims for non-security crypto assets held by a SIPC-member broker-dealer.

The staff FAQ also notes that some non-security assets may not be covered by SIPA or another specific insolvency regime. It discusses possible treatment under Article 8 of the Uniform Commercial Code that could, in some circumstances, help keep assets out of a broker-dealer’s estate. That possibility is conditional; it is not SIPC insurance or a promise of recovery. The SEC FAQ describes staff views, not Commission rules or statements, and says its responses have no legal force or effect and may be updated.

What happens to crypto if an exchange goes bankrupt?

There is no universal outcome. Customers’ practical and legal position may depend on who controls the private keys, how customer assets were recorded and segregated, which entity owes the customer, what the agreement says about lending or rehypothecation, and the applicable insolvency law. A dispute may arise over whether assets are customer property or part of the platform’s estate.

SEC staff warns that non-security crypto assets may lack a dedicated insolvency regime. That is a reason to examine the custody arrangement, not grounds to predict the result of a particular bankruptcy. A specific case depends on its facts and law.

What to look for in the account and custody terms

  • Legal entity: Identify the company that holds the asset and the entity that owes you a balance. A platform brand can involve separate exchange, custodian, bank, broker-dealer, or issuer entities.
  • Title and segregation: Check whether the terms describe assets as customer property, how they are segregated, and what records identify your holdings.
  • Use of assets: Look for terms allowing lending, rehypothecation, or transfers to another entity, and understand how they affect custody.
  • Withdrawal and claims provisions: Review when withdrawals can be suspended and what process applies if the custodian or platform becomes insolvent.

Does a regulated exchange protect my money?

“Regulated” does not mean “insured.” Securities-law obligations may apply to particular assets, products, or intermediaries, but they do not create a blanket promise that customers will recover crypto after theft, a hack, frozen withdrawals, or bankruptcy. Which rules apply can depend on an asset’s legal classification and the activity being performed.

A federal securities-law interpretation issued by the SEC on March 17, 2026, and effective March 23, 2026, with CFTC guidance, describes categories including digital commodities, collectibles, tools, stablecoins, and securities. It also addresses when a crypto asset that is not itself a security may become, or cease to be, subject to an investment contract. This regulatory framework is not a deposit-insurance scheme and does not guarantee customer recovery. The SEC’s 2026 interpretation should not be read as saying every crypto asset has the same legal status.

Does exchange insurance cover a hack or customer loss?

A platform’s private crime or cyber insurance is different from FDIC or SIPC protection. A policy may cover only specified events, and the exchange or custodian—not individual customers—may be the insured party. Even if a policy exists, a customer may not have a direct right to file a claim.

To assess a specific insurance claim, find the current policy or relevant account disclosures and check the named insureds, covered events, exclusions, limits, and claims process. A marketing statement that assets are “insured” is not enough to establish that a particular customer loss is covered. Commissioner Caroline A. Crenshaw warned in remarks on April 11, 2025, that investors may mistakenly assume FDIC or SIPC coverage applies to exchange-held crypto; her remarks are commentary, not a binding determination about every platform or its policies.

Consideration Exchange custody Self-custody
Who controls the private keys? The platform or its custodian generally controls them. You control them.
Main dependency The platform’s custody, records, account terms, and ability to process withdrawals. Your ability to secure, back up, and recover the keys.
Effect on FDIC or SIPC protection Custody does not itself make crypto FDIC insured or give non-security crypto SIPC protection. Self-custody does not create FDIC or SIPC protection.
Operational risk Reliance on the platform or custodian to safeguard assets and honor withdrawals. Loss or compromise of keys can prevent access; recovery depends on your backup and recovery arrangements.

A hardware wallet can be a physical aid for self-custody, but it is not insurance and does not prevent every theft or make lost keys recoverable. Self-custody changes who controls access; it also makes key security, backup, and recovery your responsibility.

How to check what protections apply to your account

  1. Identify the asset and product. Distinguish crypto from cash held in a bank account, and note whether the product involves a broker-dealer, a custodian, or another intermediary.
  2. Trace the entities. Find the legal names of the exchange, custodian, bank, broker-dealer, and—if relevant—stablecoin issuer involved in the arrangement.
  3. Read the current terms. Check custody, ownership, segregation, lending, withdrawal, and insolvency provisions rather than relying on a general “regulated” or “insured” label.
  4. Verify insurance at the policy level. Determine who is insured, what events are covered, what exclusions and limits apply, and whether customers can make a claim directly.
  5. Match the protection to the loss. FDIC coverage concerns eligible bank deposits; SIPC applies within its statutory framework and does not cover customer claims for non-security crypto assets, according to SEC staff. Neither is a general guarantee against crypto-market losses or platform failure.

State licensing and trust-company rules, platform agreements, insurance policies, stablecoin redemption rights, and protections for customers outside the United States can vary. The protections available to one customer or product should not be assumed to apply to another.
