The rule behind this headline is India’s recycled-content schedule under the Plastic Waste Management Rules. An amendment issued by the Ministry of Environment, Forest and Climate Change on 23 January 2025 sets recycled-content targets by packaging category and financial year. For rigid plastic packaging (Category I), the target is 30% in 2025–26, 40% in 2026–27, 50% in 2027–28, and 60% from 2028–29 onward.
The “legal recourse” line came from an unnamed industry executive quoted by The Economic Times on 5 March 2025, ahead of an April 1 deadline that year. The available reporting and official material do not show that Coca-Cola or PepsiCo filed a case, obtained an anticipatory stay, or received an exemption. The rules have also been amended since then, so the March 2025 article is not a complete picture of current obligations.
What the rule requires, year by year
The January 2025 amendment does not apply one percentage to all plastic packaging. It sets a separate schedule for each packaging category. The Category I schedule, which covers rigid plastic packaging, is shown below.

Categories II and III have their own targets under the same amendment. Those figures are not reproduced in the material this article draws on, so check the amendment text before applying any of them to other packaging types.

Which beverage packaging the March 2025 report covered
The Economic Times report of 5 March 2025 said the order covers manufacturers of soft drinks, water, and juices sold in PET bottles. It also said PET bottles account for about 70% of beverage packaging. That is the newspaper’s own estimate, reported in 2025, and it has not been independently verified as a current figure.
The report does not name any company as a party to the order. Coca-Cola and PepsiCo are not named in it either, so the link between those two companies and the rule rests on the scope described above rather than on any statement from either company.

What the “legal recourse” quote does and does not show
The quote
The sentence “We may have to take legal recourse and take anticipatory stay if the deadline is not extended” was attributed to an unnamed top executive at a large company. The report did not name the executive or the company.
The second remark
A second anonymous line in the same report, “The timing is bad, ahead of peak summer,” was attributed to the same unnamed executive. It describes the industry’s timing concern, not an official position.

What it means
Neither remark is an official company statement. Both describe a possible course of action or a concern, not a case that was filed. Treat them as reported industry testimony from March 2025.
Did beverage makers challenge the April 1 deadline?
The available sources do not establish that they did. The March 2025 report described beverage makers as considering legal options. It did not report a petition, a court order, an anticipatory stay, or an exemption. No official or company statement confirming any of those steps was found, so the claim that Coca-Cola or PepsiCo challenged the rule should be treated as unconfirmed.

The food-grade recycled PET supply question
The March 2025 report named limited availability of certified food-grade recycled PET as the main practical concern for the deadline. That was a claim made at the time, not a verified assessment of 2026 supply.
Figures that circulate in secondary coverage, such as a count of approved food-grade rPET plants or a share of demand that domestic capacity meets, are not established by the official or primary material available. They should not be cited as current facts.

What has changed since March 2025
The June 2025 draft proposal
A June 2025 draft proposed carry-forward treatment for a 2025–26 shortfall in food-contact packaging, which would have allowed an unmet year’s target to be carried into a later year. Because it was a draft and later rules have since been issued, it should not be described as the final provision.
The 2026 amendment
The Central Pollution Control Board’s national dashboard lists the Plastic Waste Management (Amendment) Rules, 2026. The listing confirms that the framework was updated after the March 2025 report. The dashboard page does not explain what the amendment changes, so the detailed effect on the 2025 schedule cannot be established from it.

How to check the obligation that applies to a given package
- Start from the current amendment text published by the Ministry of Environment, Forest and Climate Change, not from news reports. Under the 2025 schedule, rigid plastic packaging falls in Category I.
- Identify the financial year in which the obligation falls. Indian financial years run from April to March, so 2026–27 covers April 2026 to March 2027.
- Note whether the packaging is used for food contact. The June 2025 draft treated food-contact packaging differently, and the effect of the 2026 amendment on that treatment is not established here.
- Check the 2026 amendment through the Central Pollution Control Board’s national dashboard, then open the notified text to confirm its operative provisions.
- Confirm any carry-forward, exemption, or deadline extension in the final notified rules. A press report of a proposal or a company’s legal threat does not establish that the change took effect.
