Why Do You Have to Be 18 to Trade in GameStop?

The 18 limit comes from brokerage account rules, not GameStop. Here is how account agreements, state law and custodial UGMA/UTMA accounts fit together.

The 18 threshold does not come from GameStop. Buying GameStop stock means using a brokerage account, and opening one is a contract. In the United States, 18 is a common age at which a person can open and control an individual brokerage account in their own name, so a younger person usually cannot do that alone. A minor can still own GameStop shares through an adult-managed custodial account, but that is a different arrangement with different rules.

Why the age limit attaches to the account, not the stock

GameStop shares are a security, and the company does not set who may buy them. The practical gate is the brokerage account you use to place the order. When you open a brokerage account, the SEC notes that you must sign a new account agreement, and that agreement sets out your legal rights and obligations. Because the account is a contract, the question becomes whether the person signing it has legal capacity to enter that contract. That is why the age limit appears in the brokerage context even though no rule is aimed at GameStop specifically.

Why state law sets the edge

Federal securities law does not itself declare that everyone under 18 may not own shares. A Federal Register publication from September 1, 2021 describes contract capacity as generally a matter of state law rather than something federal securities rules fix at a single age. In practice, brokerage firms decide who they will open an ordinary account for, and they write that into their eligibility terms. Those terms can differ from firm to firm and from one arrangement to another, so the age you see at one broker is not a universal rule. If you are checking a specific firm, read its current agreement rather than relying on a general figure.

How a minor can hold GameStop through a custodial account

Some brokers offer custodial accounts, which let an adult open and run an account for a child. The two common forms in the United States are UGMA (Uniform Gifts to Minors Act) and UTMA (Uniform Transfers to Minors Act) accounts. FINRA describes these as accounts that a parent or other adult can establish for a minor. (FINRA, “Ways to Invest for Children,” June 30, 2026)

Who owns and who controls the account

The assets belong to the minor, but the adult custodian manages the account until the child reaches the age of majority set by the state. FINRA states that the transfer age varies by state, so the age at which control passes to the young person depends on where the account is established.

What the custodian may and may not do

FINRA says these accounts have no contribution limits or withdrawal penalties. The main restriction is that the money must be used for the minor’s benefit. That restriction is the reason custodial accounts are not a way to let a minor trade freely with someone else’s login.

Why a custodial account is not a shared login

A custodial account is a separate legal arrangement. The adult is acting in a fiduciary-type role for the child, not lending their personal account to the young person. A minor should not be described as independently trading in an adult’s account, and an adult who simply trades in their own account and invests with a child’s future in mind is still the owner of that account. Comparing your options

The three realistic paths are waiting until you can open an individual account under the firm’s rules, having a parent or guardian set up a custodial account, or having an adult invest through an account that adult owns. The table compares them on the points that matter most.

Steps before you open or fund an account

  1. Confirm what the firm allows. Check the broker’s eligibility terms and whether it offers custodial accounts. Ask the firm directly rather than assuming the answer from another broker.
  2. Read the account agreement. The SEC says the agreement determines your legal rights, so review it before you sign.
  3. Find the state rule. For a custodial account, check the state-specific age of majority, since that is when control passes to the minor.
  4. Decide who is making decisions. Confirm who places trades and who can request withdrawals, and make sure that matches what you intend.
  5. Check cash versus margin. Most custodial and beginner setups are cash accounts; confirm the account type before you place an order.

Cash accounts and margin

The SEC’s account guidance covers cash accounts and margin borrowing. Margin means borrowing from the broker to buy securities. Borrowing can magnify losses, and you may owe repayment and interest regardless of how the investment performs. Buying GameStop shares does not require margin, and a young investor should understand the borrowing risk before any account is set up to use it. (SEC, “Accounts — Opening A Brokerage Account”)

What is not established here

The available sources do not establish the current minor-account policy of any named broker, or a single age that applies in every state or to every account arrangement. Treat the age 18 figure as a common threshold for ordinary accounts, not a legal guarantee, and confirm the rule with the firm and your state before acting.
