Trump Signs Law Allowing Whole Milk in School Meals—But Schools Decide

A 2026 USDA rule lets participating child nutrition programs offer whole and 2% milk, but schools decide whether to add them to menus.

Yes. President Donald Trump signed the Whole Milk for Healthy Kids Act on January 14, 2026. A USDA final rule effective June 8, 2026, allows participating schools and other child nutrition operators to offer whole and 2% milk alongside 1% and fat-free milk. It does not require schools to serve whole milk: local operators choose what goes on their menus.

What the law and USDA rule changed

The law changed federal rules that had limited milkfat options in school meals. USDA first issued implementation guidance for school lunch, then finalized a broader rule covering additional child nutrition programs. The final rule took effect June 8, 2026. The rule permits participating operators in the National School Lunch Program (NSLP), School Breakfast Program (SBP), Child and Adult Care Food Program (CACFP), and Special Milk Program (SMP) to offer whole, 2%, 1%, or fat-free milk. It also covers NSLP afterschool snacks, preschool meal patterns, and eligible competitive beverages sold under Smart Snacks.

Which milk options are allowed by age?

Age Allowed milk under the final rule Flavor

Age six and older, and adults Whole, 2%, 1%, or fat-free milk Flavored or unflavored

USDA guidance also allows children between 24 and 25 months to receive unflavored whole or reduced-fat milk while transitioning to lower-fat options. (USDA age-specific milk guidance)

The law separately permits nondairy beverages that meet statutory nutritional-equivalence requirements. The milkfat changes described above concern the options and programs covered by USDA’s final rule.

Does every school have to serve whole milk?

No. The rule gives operators flexibility; it does not guarantee whole milk will appear on a particular school’s menu. USDA says operators may consider student preferences, product availability, costs, and other local factors. Its final-rule summary states: “Program operators are not required, but are encouraged, to make changes to menus under this provision.” (USDA guidance for program operators; USDA final-rule summary)

So the policy establishes what participating programs may offer, not what a district has actually adopted. The reviewed official sources do not provide a measured estimate of district adoption or student uptake. Families looking for a particular option will need to check with their school or district.

How saturated-fat accounting changes

The law allows school food authorities to exclude saturated fat from fluid milk when calculating the weekly average saturated-fat requirement for lunch. USDA’s final rule extends that accounting treatment to breakfast calculations under the SBP. This changes how the weekly average is calculated; it does not require schools to serve whole milk or alter what a given school chooses to offer. (USDA law overview; USDA final rule)

Whole milk permission does not erase added-sugar standards

Milkfat flexibility is separate from school-meal added-sugar standards. USDA’s April 2024 announcement said limits on added sugars in school meals would begin in fall 2025 and reach full implementation by fall 2027. It also described a new added-sugar limit for flavored milk served at breakfast and lunch beginning in fall 2025. What the nearly 30 million figure means

USDA said in April 2024 that K–12 schools serve nutritious breakfasts and lunches to nearly 30 million children each school day. That figure describes the reach of school meals overall. It is not a count of children who drink whole milk, nor a measure of how many schools will add it to menus. (USDA, April 24, 2024)
