Before signing, identify exactly what each party supplies, how payment is calculated, whether it can cover your costs, and what happens if placements or performance fall short.
What contract pig feeding means
USDA describes a swine production contract as an arrangement in which a person or business raises and cares for pigs according to another party’s instructions. The contractor does not have to own the pigs for the arrangement to fall within USDA’s definition. See USDA’s Packers and Stockyards Act FAQ for the federal definitions and context.
In a common wean-to-finish arrangement, the contractor supplies weaned pigs, feed, transportation, veterinary services and medicine. The grower supplies housing, labor and utilities, and receives payment for those services. Pigs may remain in the barn for five to six months before harvest in the Wisconsin Extension example; that is an example, not a promise about every contract. The parties’ actual duties are set by the agreement.
Another common allocation has the grower investing in and maintaining the buildings and site, providing labor and management, hauling manure, and keeping specified records. The contractor typically supplies animals, feed ingredients, technical support, veterinary services and transportation, and may specify the recordkeeping system. The proposed contract—not a general description of customary practice—controls who bears each cost and responsibility.

How growers are paid—and what can affect the amount
Payment may be based on pig space per year, pigs marketed, or a combination. It may arrive monthly, when a group leaves the barn, or on a mixed schedule. Rates vary with factors such as facility age, location, competition for facilities and negotiation; the available Extension guidance does not establish a reliable current rate to use as a quote.
Some contracts add incentives or deductions tied to measures such as death loss, cull percentage, days to market or feed efficiency. Those results can depend on incoming pig condition, genetics, feed, health inputs and other factors. If your compensation depends on performance, ask which variables you control and how the contract treats poor incoming pigs, culling and medication decisions.
Test the economics before committing
Build a budget for your own facility and proposed terms. Count principal and interest even if you plan to use cash: Wisconsin Extension recommends including them to assess the return on the facility investment. Include recurring costs too, such as utilities, insurance, property taxes, repairs, labor and management. Discuss the assumptions with your lender early.

Missouri Extension recommends comparing the contract term with the facility loan and checking for minimum payment guarantees. A payment tied to animals placed, shipped or weight gain can leave you exposed if the barn is not filled. A performance bonus may rely on feed quality or pig genetics that you do not control.
- Will expected payments cover debt service and recurring costs?
- When are payments made in relation to loan payments and operating expenses?
- Is there a minimum placement level or payment guarantee, and what exceptions apply?
- What happens to payments and costs if the contractor takes over barn management after poor performance?
- Does the contract last long enough to support the facility investment, and how does its term compare with the loan?
Ask your lender and farm adviser to review the budget and the consequences of a shortfall, termination or management change. Do not assume a full barn, a bonus or a particular payment schedule unless the written agreement supports that assumption.
Check facilities, labor and operating responsibilities
Determine whether your existing buildings meet the contractor’s specifications, whether remodeling or new construction is needed, and what future upgrades could cost. Assess whether you have enough labor and management capacity—and whether pig feeding competes with other uses of your farm’s labor, land, capital or credit.

Waterers and feeders are examples of equipment that a contract may require to be updated. If specifications call for a pig nipple waterer or other equipment, verify the required model or performance criteria, water system and barn compatibility with the contractor before buying. No single product is established as a universal contract requirement.
Clarify who owns or manages manure and mortality compost, who pays for handling, and who is responsible for proper use and disposal. Estimate the acreage needed for manure application with a county Extension educator or nutrient-management specialist. Also assess equipment needs or custom-hauling rates, available land, environmental requirements and acceptable dead-pig disposal methods and costs.
Review these contract terms before signing
Inputs, duties and records
List who supplies pigs, feed, medication, veterinary care, transportation, labor and utilities, and who pays for repairs. Put manure management, mortality disposal and recordkeeping responsibilities in the same review. Confirm which records the contractor requires and how you can access the information used to calculate settlements.

Payment formula and performance measures
Check the exact formula, payment dates, minimum placements or guaranteed payments, benchmarks, and data used for any bonus or deduction. Ask how the agreement handles factors outside your control, including pig condition on arrival, genetics, feed quality and medication decisions.
Facility investment and upgrades
Compare the contract term with your financing period and ask what upgrades may be required. USDA’s current guidance defines an “additional capital investment” to exclude original construction and ordinary repair and maintenance, while including qualifying upgrades and goods and services directly attributable to them. USDA defines a large investment as totaling $12,500 or more per structure over the contract’s life. Where applicable, the contract must disclose on its first page whether additional large capital investments may be required. The $12,500 threshold is a regulatory definition, not an estimate of typical grower spending. Consult USDA’s contract guidance for details.
Cancellation and arbitration
USDA says a grower may cancel a covered contract by written notice within three business days after execution unless the contract gives a later deadline; the agreement must disclose the right and how and when to exercise it. USDA also says a grower may decline a mandatory arbitration provision before signing, with required disclosure and opt-out language where applicable. Confirm whether the particular agreement is covered and follow its stated process; get legal advice rather than relying on a general summary.

USDA says the dispute forum must be in the federal judicial district where the principal performance takes place, generally the grower’s farm. Review arbitration costs, process, deadlines, discovery and available remedies before deciding whether to accept the clause.
Default, cure periods and management changes
Understand what constitutes default, how notice is delivered, and what opportunity either party has to fix an alleged breach. USDA’s criteria for assessing a reasonable cure period include written notice that identifies the alleged breach and contract section, explains how it may be remedied, and allows reasonable time. Food-safety or animal-welfare concerns may affect a contractor’s rights under the contract. Separately, establish what happens to payments, operating expenses and barn management if the contractor takes control, and what happens if either party defaults.
Keep your own records
USDA’s FAQ says contractors must maintain records that correctly disclose transactions for at least two full years and recommends that growers keep records in case of a dispute or alleged violation. Keep copies of each contract version, settlement statements, performance reports, notices, input records and communications.

USDA’s Packers and Stockyards Act provisions apply to swine contractors and contract growers who meet the statutory definitions. They include prohibitions against certain unfair, discriminatory or deceptive practices and contractor recordkeeping duties. USDA’s FAQ also clarifies that these provisions do not establish prompt-payment requirements, bonding or registration requirements, or a trust for contract growers.
Federal guidance does not resolve every question about a specific contract or legal claim. State law, contract language and the facts matter. Have an attorney familiar with agricultural production contracts review the agreement before signing.
