Yes. California’s Public Employment Relations Board (PERB) certified the California Gig Workers Union (CGWU) on September 9, 2026, to represent a statewide unit of drivers for covered transportation network companies (TNCs), currently Uber and Lyft. That gives CGWU authority to bargain over work terms; it does not mean the companies and union have reached a contract or that drivers’ pay and benefits have changed.
What California’s unionization framework does
Assembly Bill 1340 created the Transportation Network Company Drivers Labor Relations Act. Governor Gavin Newsom signed the law on October 3, 2025, and it took effect on January 1, 2026. The Act recognizes covered drivers’ rights to form, join and participate in driver organizations and collective bargaining, as well as the right to refrain from those activities. PERB’s TNC Act rulemaking page describes the framework.
PERB oversees the procedures for organization designation, representation and bargaining under the Act. The law sets quarterly 10-day periods for organizations to apply for or renew designation as a TNC driver organization; the first period in 2026 ran January 20–29, as PERB announced in its January 20 notice.
What PERB’s certification means
PERB certified CGWU on September 9, 2026, as the bargaining organization for the statewide unit of drivers at covered TNCs. The agency says the certification followed evidence that at least 30% of active TNC drivers authorized CGWU to act as their bargaining representative. That is the support threshold reported for this certification—not a majority vote. PERB did not publish the number of active drivers or the raw number of authorizations in its certification notice.

The certification authorizes CGWU to represent all drivers in the unit and bargain over terms and conditions of work. PERB identifies Uber Technologies, Inc. and Lyft, Inc. as the currently covered companies. The notice establishes bargaining authority, not that formal negotiations have begun or that either company and CGWU have agreed to terms.
What it may—and may not—mean for drivers’ finances
For drivers, the immediate change established by the notice is representation and the ability to bargain. A union certification alone does not set a new pay rate, guarantee benefits, or show that any specific expense or working condition has changed. Drivers should distinguish that legal status from a contract: financial terms would depend on what, if anything, is negotiated and agreed.

The certification notice concerns representation and bargaining rights. It does not say that drivers’ worker classification has changed. It also applies to the covered TNC driver unit, not every person who earns money through an app or every category of gig worker.

The Governor’s August 17, 2026, announcement quoted Newsom saying, “Today is a new day for rideshare drivers who have spent a decade fighting for a stronger voice on the job.” That announcement referred broadly to hundreds of thousands of drivers, but PERB’s certification notice does not give a precise active-driver count, authorization total or unit size. The Governor’s announcement is not a substitute for those figures.
