In January 2023, Engadget reported that law-enforcement personnel with access to the Transaction Record Analysis Center (TRAC) could query its repository of money-transfer records without obtaining a warrant for each lookup. That describes access to records already collected—not whether the process used to put those records in the database was lawful. The available accounts are historical and do not establish TRAC’s status today.
What “warrantless access” means
A database lookup is different from collecting the records
TRAC was described as a shared repository of money-transfer records. The reported warrantless access concerned law-enforcement users searching information already in that repository. It does not mean officers had access to every transfer, every company’s records, or every customer’s financial accounts.
There are two separate questions: what legal process was used to obtain and submit records, and what process a user needed to search records already held by TRAC. A lack of a warrant for each reported lookup does not settle the legality of the earlier collection.
TRAC was not a warrant for an individual investigation
The reporting described a database used by law-enforcement agencies for investigations, not a requirement that every customer’s transfer receive an individual warrant before being recorded. Engadget reported that the stated investigative aims were fraud and money laundering. That rationale does not by itself resolve whether collecting records in bulk was lawful or proportionate.

Which transfers and companies were reported to be included
The original settlement scope and later reported coverage were not identical. The 2010 arrangement described by the ACLU applied to transfers above $500 to or from five named jurisdictions: Arizona, California, New Mexico, Texas, and Mexico. Engadget’s January 2023 account described a broader program, including some domestic transfers and more than 20 other regions.
Engadget named Western Union, MoneyGram, and Viamericas among the businesses associated with the program. It also reported that Wyden said Apple Cash, Cash App, PayPal, Venmo, and Zelle had not provided data to TRAC. That statement reflects Wyden’s position as reported in January 2023; it is not a current or independently refreshed list of participating services.

What the historical access figures show
The ACLU’s 2023 account drew on TRAC records and described the following figures for earlier periods. They are not current totals.

Why the legality is disputed
The ACLU’s description of the 2006 appellate decision concerns a particular earlier subpoena. It does not establish that the court invalidated every later subpoena or settlement. The ACLU separately argues that Arizona’s later subpoenas were illegal, based on the records it reviewed and the history of the earlier dispute. That is the ACLU’s legal conclusion, not a verified judgment covering each subpoena.

The same distinction applies to the subpoenas the ACLU says Homeland Security Investigations issued after 2019 and later withdrew. The ACLU calls them unlawful under federal law; its account says they were withdrawn after Wyden’s 2022 inquiry. Withdrawal is not, by itself, a court ruling on the legality of every record collection or database search.
The ACLU argues that bulk collection can expose ordinary transactions without individualized suspicion and can particularly affect communities that rely on money-transfer services. The law-enforcement purpose reported by Engadget—investigating fraud and money laundering—does not answer that privacy concern or decide the legal question.

What a customer can and cannot conclude
- The reports describe a repository containing records from participating money-service businesses; they do not show that every transfer service or transaction was included.
- The existence of a database does not establish that a particular person’s record was in it or that an officer searched that record.
- The historical reports do not establish TRAC’s operational status, current participants, record totals, or current user access as of October 2026.
