Did the U.S. Sell the 69,370 Silk Road Bitcoin? What Trump’s Reserve Order Says

A senator’s letter described a planned disposal of about 69,370 Silk Road bitcoin, but does not prove a sale occurred. Trump’s Reserve order bars sale of deposited BTC; the specific coins’ status remains unresolved in the cited records.

A January 2025 letter from Senator Cynthia Lummis described a U.S. Marshals Service plan to dispose of about 69,370 bitcoin connected to a Silk Road theft case. That letter does not establish that the coins were sold. President Donald Trump’s March 2025 executive order later barred the sale of bitcoin deposited in the Strategic Bitcoin Reserve, but the available official records do not show whether this specific bitcoin entered the Reserve or what ultimately happened to it.

What happened to the reported 69,370 bitcoin?

The claim that the U.S. was preparing to sell roughly 69,000 bitcoin comes from a January 15, 2025 letter by Senator Cynthia Lummis to U.S. Marshals Service Director Ronald L. Davis. Its title was “Planned Sale of 69,370 Bitcoin Seized from Silk Road Case,” and Lummis wrote that she was seeking information about the Service’s “planned disposition” of the bitcoin.

The letter is evidence that Lummis described a planned sale and sought details about it. It is not a Marshals Service sale record, proof of a completed transaction, or confirmation of the coins’ eventual disposition. The documents available for this account do not resolve whether the reported sale was completed, halted, or left pending after the administration changed.

Lummis estimated the bitcoin’s value at more than $6 billion at market prices in the context of her January 15, 2025 letter. That is a dated estimate, not a current valuation.

Where did the bitcoin come from?

The 69,370 BTC civil forfeiture case

The bitcoin traces to a separate alleged theft from Silk Road. In a civil forfeiture complaint filed November 5, 2020, the U.S. Department of Justice alleged that a person it called “Individual X” hacked Silk Road and moved cryptocurrency from it. The government’s complaint said 70,411.46 BTC had moved from Silk Road addresses and that 69,370.082201 BTC remained in a wallet in its account of the case.

Those statements are allegations in a civil forfeiture filing. The complaint did not publicly identify Individual X by name, and the allegation should not be described as a criminal conviction.

A separate Silk Road-related forfeiture

Another Justice Department filing, dated November 7, 2022, concerns 51,351.89785803 BTC located and obtained in 2021 and 2022. The filing describes those coins as traceable to Silk Road and to an earlier forfeiture judgment involving Ross Ulbricht; it says an individual had obtained approximately 50,000 BTC from Silk Road through a 2012 scheme.

That is a separate proceeding and a different quantity from the 69,370 BTC in the 2020 civil complaint. The two figures should not be combined or treated as the same wallet.

What Trump’s Strategic Bitcoin Reserve order changed

Executive Order 14233, signed March 6, 2025, directed the Treasury Department to establish a Strategic Bitcoin Reserve. It provides for the Reserve to be capitalized with bitcoin held by Treasury that has been finally forfeited, subject to specified statutory requirements and releases under the order. It states: “Government BTC deposited into the Strategic Bitcoin Reserve shall not be sold and shall be maintained as reserve assets of the United States utilized to meet governmental objectives in accordance with applicable law.”

The key condition is deposit into the Reserve. The order does not identify the 69,370 BTC in the civil forfeiture case or say that those coins were transferred to Treasury or deposited in the Reserve. The supplied official records therefore establish the general policy, not the specific coins’ status under it.

The order is not a blanket ban on every government crypto sale

The order also restricts agencies from selling or otherwise disposing of government digital assets, while describing exceptions. These include disposition connected with Treasury’s lawful stewardship of the separate Digital Asset Stockpile; a competent court order where required by law; and a determination by the Attorney General or another relevant agency head that disposition or proceeds can and should be used for victim returns, law-enforcement operations, equitable sharing with state and local partners, or specified statutory requirements.

So the policy is not simply “the government can never sell bitcoin.” The no-sale rule specifically covers BTC deposited in the Strategic Bitcoin Reserve, while the order also sets out circumstances in which government digital assets may be disposed of. Which rule applies to a particular group of coins depends on their custody, forfeiture status, any Reserve deposit, and whether an authorized exception applies.

What would determine whether these coins could be sold?

The public documents establish the Reserve framework and the earlier reported sale plan, but they do not answer all the case-specific questions needed to reconcile them. For the 69,370 BTC, the relevant facts are:

  • Which proceeding governs the coins? The 69,370 BTC belongs to the 2020 civil forfeiture matter, not the separate Ulbricht-related proceeding.
  • Were the coins finally forfeited and held by Treasury? The order’s Reserve provisions concern qualifying BTC held by Treasury and finally forfeited, subject to the order’s terms. The cited documents do not establish the specific coins’ later custody or status.
  • Were they deposited in the Strategic Bitcoin Reserve? The order’s explicit no-sale rule applies to BTC deposited there. The cited order does not say these coins were deposited.
  • Did a lawful exception or court order authorize disposition? The order identifies certain bases for government-asset disposition, but the available records do not establish whether one was invoked for this group.

Without those case-specific facts, it is not possible to conclude from the cited records that the executive order automatically stopped the reported sale—or that the sale went ahead.

What this means for taxpayers and bitcoin holders

The immediate issue is government custody and policy, not a confirmed market transaction. A sale of a large bitcoin holding could matter to markets depending on its size, timing, and method, but the records cited here do not establish that a sale occurred or provide a basis for estimating a price effect. Likewise, the January 2025 valuation in Lummis’s letter should not be used as a current measure of the coins’ worth.

For taxpayers, the documented distinction is between an announced policy framework and the unresolved fate of a specific asset group. The executive order describes how qualifying Reserve bitcoin is to be treated; it does not, in the cited text, provide a transaction history for the 69,370 BTC.
