Türkiye’s additional 40% duty on electric vehicles from China began on 4 March 2023; it was not newly imposed in 2026. A WTO panel found the EV duties inconsistent with Türkiye’s tariff commitments, but the panel report had not been adopted as of the WTO’s 25 September 2026 update. The WTO’s Dispute Settlement Body postponed consideration until 27 October 2026, and the available notices do not say the duty has been withdrawn.
What the 40% EV duty covers
The measure at the center of the WTO dispute is an additional 40% duty on electric vehicles imported from China. Türkiye’s Ministry of Trade said the duty started on 4 March 2023. The figure describes the additional duty; it is not, by itself, a complete calculation of all charges an importer may owe on a particular vehicle.
The WTO case, DS629, is titled “Türkiye — Measures Concerning Electric Vehicles and Other Types of Vehicles from China.” China challenged several measures, including the additional EV duties, an import-permit certificate scheme, and duties on other vehicles. The WTO panel’s findings on the EV duties should not be mistaken for a ruling on every measure included in the dispute.
What the WTO panel found
The panel report, circulated on 28 July 2026, found that the EV duties were inconsistent with two provisions of the General Agreement on Tariffs and Trade (GATT). Under Article II:1(b), the panel found that the duties exceeded the tariff bindings in Türkiye’s schedule. Under Article II:1(a), it found that Chinese imports received less favorable treatment than that schedule allowed. The WTO’s DS629 dispute record sets out the panel findings.

A tariff binding is a ceiling on the customs duty a WTO member has committed to apply to covered imports. The panel’s finding therefore concerns whether the additional EV duties went beyond Türkiye’s scheduled commitments and provided less favorable treatment—not whether Türkiye is barred from regulating or taxing vehicles in general.
Has the duty ended, or has the WTO issued a final ruling?
No automatic end to the duty is established by the panel report. A panel finding is distinct from an adopted WTO ruling, and the report was still awaiting consideration by the Dispute Settlement Body (DSB) in the latest procedural notice available here.

On 25 September 2026, the WTO reported that China and Türkiye had jointly requested more time for consideration. The DSB postponed consideration of the report until 27 October 2026. Türkiye’s Ministry of Trade said on 15 September that it disagreed with aspects of the panel’s assessment and was considering the timing of appeal or review procedures; that statement did not say an appeal had been filed. The ministry also said the report did not itself create an automatic compensation or payment obligation.
Accordingly, the panel’s finding should not be described as a final adopted resolution, an automatic tariff repeal, or an order that Türkiye pay China compensation. The WTO notice and ministry statement do not confirm that the duty has been withdrawn. They also do not establish what the DSB did after the 27 October date.

The separate 2024 duty on other Chinese passenger cars
A different measure is often confused with the 2023 EV duty. Decision 8639, dated 8 June 2024, introduced a separate additional duty on China-origin passenger cars classified under tariff heading 8703. It took effect on 8 July 2024. The rate is 40% or US$7,000 per vehicle, whichever is higher, according to the Turkish Union of Chambers and Commodity Exchanges (TOBB) notice on the decision.

These are distinct measures with different dates, stated scopes, and rate formulas. The 2024 measure is not simply another description of the 2023 EV duty, and the WTO panel’s EV finding should not be extended to it without a separate basis.

What an importer should check before estimating a vehicle’s duty
A headline percentage cannot determine the customs bill for an individual vehicle. Türkiye’s current consolidated Decision 3351 page lists amendments through 11 July 2026 and includes tariff tables, but those tables alone do not settle every tariff-line question or provide a complete landed-cost calculation.
- Confirm the vehicle’s exact tariff classification, including whether it falls under the relevant EV line or heading 8703.
- Verify the applicable origin rule and whether the vehicle qualifies as China-origin for the measure at issue.
- Check the current official schedule and any applicable exemptions against the vehicle and import circumstances.
- Use the current customs treatment for the specific entry rather than assuming the headline rate is the full amount due.
The Turkish Ministry of Trade’s consolidated Decision 3351 is the official reference for the current framework and tariff tables. For an importer-specific charge, classification, origin, exemptions, and the current schedule all need to be checked together.
