The change applied to qualifying goods entered for consumption—or withdrawn from a warehouse for consumption—on or after November 13, 2025. It did not eliminate every U.S. tariff on Brazilian goods.
What the November 2025 order changed
Executive Order 14361, titled “Modifying the Scope of Tariffs on the Government of Brazil,” revised the scope of an additional tariff imposed under an earlier Brazil emergency action. The White House described the change as a modification of reciprocal tariffs and identified qualifying “coffee and tea” and “beef” among the agricultural products removed from those tariffs. The executive order and White House fact sheet explain the measure.
The scope matters: this was a change to a particular additional tariff, not a blanket repeal of all duties on Brazilian products. Whether a shipment qualified depended on its product classification, origin, and entry date, along with the applicable tariff rules.
When the change applied
Although Trump signed the order on November 20, 2025, its modifications applied to qualifying goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. Eastern Standard Time on November 13, 2025. The effective date therefore preceded the signing date.

Why the administration said it made the change
The order says officials recommended removing certain agricultural imports from the additional duty in light of initial progress in negotiations with Brazil, among other considerations. The White House also cited progress in reciprocal trade negotiations, domestic demand, and domestic capacity. These are the administration’s stated reasons; the official materials do not establish a specific consumer-price effect attributable to the order.
Did the order guarantee refunds?
No. The order says: “To the extent that implementation of this order requires a refund of duties collected, refunds shall be processed pursuant to applicable law and the standard procedures of U.S. Customs and Border Protection for such refunds.” That is conditional language, not a promise of an automatic refund to every importer. Refund eligibility and processing depend on applicable law and CBP procedures. Importers should consult CBP refund guidance and their customs broker about a specific entry.

Why Brazilian coffee and beef are not categorically tariff-free now
A separate U.S. Trade Representative action imposed an additional 25 percent tariff on covered Brazilian goods effective July 22, 2026, subject to specified exemptions. This is a distinct measure from the November 2025 reciprocal-tariff change. The USTR described the investigation as involving issues including digital trade and electronic payment services, preferential tariffs, anti-corruption enforcement, intellectual property protection, ethanol market access, and illegal deforestation. Its final notice added exemptions that include unflavored instant coffee. That narrow, classification-specific exemption does not establish that every coffee product is exempt from every tariff.
The Federal Register notice and USTR materials describe the later action and its exemptions. For a particular shipment, check the current Harmonized Tariff Schedule of the United States (HTSUS) classification and CBP guidance rather than relying on an everyday product description. Origin, tariff classification, entry date, and any applicable exemption all matter.

What the 2026 proceeding figures describe
USTR reported that its 2026 Section 301 proceeding received more than 360 written submissions and included testimony from 77 witnesses at a public hearing on July 6–7, 2026. Those figures concern the later proceeding, not the November 2025 order.
