Why Invenergy Asked to Narrow a Proposed Transmission Corridor Through Kansas

Invenergy sought a narrower federal corridor for the Grain Belt Express route. DOE later dropped the Kansas-area proposal, while the project’s state approval process continued.

In September 2024, transmission developer Invenergy asked the U.S. Department of Energy (DOE) to narrow its proposed Midwest-Plains National Interest Electric Transmission Corridor (NIETC) from five miles wide to 0.5 miles where it followed the Grain Belt Express route. The request concerned a proposed federal geographic designation—not the physical line or its state-approved route. DOE later dropped the corridor from its final group of proposed NIETCs; Kansas regulators said Grain Belt Express’s existing state approvals remained unchanged.

What Invenergy asked DOE to change

DOE’s preliminary Midwest-Plains proposal covered an approximately 780-mile area through parts of Kansas, Missouri, Illinois and Indiana, following the Grain Belt Express route. Kansas Reflector reported that the proposed corridor was five miles wide and that Invenergy sought a 0.5-mile width along the project route. Those figures describe the proposed federal corridor, not the transmission line’s easement, tower footprint or construction width. Invenergy’s stated rationale, as quoted by Kansas Reflector from the Grain Belt Express website, was that a narrower corridor “will balance the needs of states to access additional power while also addressing the concerns and uncertainty stakeholders along the path of the project are expressing.” That was the developer’s explanation, not an independent finding about the effects of either width. What a NIETC is—and what it is not

A National Interest Electric Transmission Corridor is a geographic area DOE identifies as having present or expected transmission-capacity constraints or congestion that harms consumers. It is not a transmission line, a construction permit or an easement. Federal law allows the Energy Secretary to designate such an area when inadequate transmission harms consumers and new transmission would improve reliability and reduce consumer costs. The proposed corridor therefore did not itself redraw Grain Belt Express’s route or automatically authorize construction across private land. The project had a separate Kansas regulatory history and state approvals. The federal designation mattered because it could create a path to federal backstop siting authority in specified circumstances; that possibility is distinct from the corridor’s boundaries and from the project’s state approvals.

Why the proposal raised landowner and state-authority concerns

The corridor debate intersected with concerns about who could make siting decisions and how private land might be acquired. Kansas Farm Bureau president Joe Newland said the organization opposed giving the Federal Energy Regulatory Commission backstop authority to override state siting decisions and opposed eminent domain in the corridors. Kansas Reflector also reported Invenergy’s position that it first seeks voluntary easement agreements and compensates owners if land is condemned. These are attributed positions; they do not mean that the federal corridor proposal itself authorized a taking. (Kansas Reflector)

The Kansas Corporation Commission’s FAQ describes the circumstances in which FERC may issue a siting permit within a NIETC: a state may lack siting authority, may not have acted on an application for more than a year, or may have denied an application. The FAQ also says Kansas has statutory siting jurisdiction over lines of 230 kilovolts or higher and longer than five miles. Those provisions concern potential authority under particular conditions; a NIETC does not, by itself, transfer a project to federal control. (Kansas Corporation Commission FAQ)

What happened after Invenergy’s request

In December 2024, DOE reduced its proposed NIETC projects from ten to three, and none of the three ran through Kansas. The Kansas Corporation Commission said Grain Belt Express had been included in one proposed corridor, but the DOE decision did not change the project’s previously approved status in Kansas or the state’s regulatory jurisdiction and approval processes. The commission said federal backstop siting authority and federal eminent domain were no longer options following DOE’s decision. (Kansas Corporation Commission, December 19, 2024)

Missouri Independent reported on December 17, 2024, that Grain Belt Express had been removed from the federal program. Invenergy public-affairs executive Patrick Whitty said, “This designation was not required for the project to continue to advance toward construction.” DOE’s removal of the corridor was therefore not a cancellation of Grain Belt Express; the project’s separate state regulatory path continued. The December 2024 decisions establish the federal corridor outcome and Kansas regulators’ description of the state process at that time. They do not establish Grain Belt Express’s construction or financing status as of October 2026.
