Das Amtsgericht Osterode am Harz eröffnete es am 1. März 2009 unter dem Aktenzeichen 8 IN 3/09. Die historischen Meldungen belegen jedoch nicht, welchen rechtlichen Status die Gesellschaft heute hat.
Was geschah bei Fuba Printed Circuits?
FUBA PRINTED CIRCUITS stellte Leiterplatten für die Automobil- und Telekommunikationsbranche sowie für die Industrieelektronik her. Im Januar 2009 beantragte das Unternehmen die Eröffnung eines Insolvenzverfahrens. Das Verfahren wurde am 1. März 2009 eröffnet.
Vom Antrag zur Verfahrenseröffnung
Die Fachpublikation all-electronics berichtete am 16. Januar 2009 über den Insolvenzantrag. Geschäftsführer Hubert Beyrle erklärte damals, der globale Einbruch der Automobilindustrie und die zurückhaltende Kreditvergabe der Banken hätten die Lage verschärft. Das war die damalige Erklärung des Geschäftsführers, keine unabhängig festgestellte gerichtliche Ursachenbewertung.
Nach Angaben des Insolvenzverwalter-Teams eröffnete das Amtsgericht Osterode am Harz das Verfahren am 1. März 2009 und bestellte Rechtsanwalt und Diplom-Kaufmann Torsten Gutmann zum Insolvenzverwalter. Das Aktenzeichen lautete 8 IN 3/09. Antrag und Eröffnung sind unterschiedliche Verfahrensschritte: Der Antrag wurde im Januar gemeldet, die gerichtliche Eröffnung folgte am 1. März.

Was passierte nach der Verfahrenseröffnung?
Die Eröffnung bedeutete nicht, dass der Betrieb sofort eingestellt wurde. Laut einer Mitteilung der Kanzlei vom 24. März 2009 wurde der Geschäftsbetrieb zunächst fortgeführt, während nach einer Investorenlösung gesucht wurde.
Die Kanzlei nannte zu diesem Zeitpunkt 27 kontaktierte potenzielle Übernehmer, vertiefte Gespräche mit vier Interessenten und ein vorliegendes Kaufangebot. Diese Zahlen beschreiben den Stand der Suche in der damaligen Mitteilung; sie belegen nicht, dass ein Verkauf zustande kam.

Die Standortmeldung im April
Ein Bericht von dpa/lni, veröffentlicht am 29. April 2009, meldete, dass der Betrieb in Gittelde zum 30. Juni eingestellt werden solle. Nach damaliger Aussage des Insolvenzverwalters hatte sich kein Investor für den Standort gefunden. Für Dresden liefen laut demselben Bericht noch Gespräche mit einem Investor. Das war ein Zwischenstand der Verhandlungen und kein Beleg dafür, dass der Dresdner Betrieb später tatsächlich erhalten blieb.

Die Meldungen aus dem Jahr 2009 reichen nicht aus, um den heutigen Registerstatus der Gesellschaft festzustellen. Eine aktuelle amtliche Registerauskunft liegt hier nicht vor. Eine sekundäre Firmenseite führt Angaben zur Gesellschaft unter der Registernummer HRB 130891 auf und bezeichnet sie als aufgelöst; das ist keine aktuelle amtliche Bestätigung.

Auch ein fehlender alter Eintrag in den Insolvenzbekanntmachungen würde für sich genommen nicht beweisen, dass kein Verfahren stattgefunden hat. Das Europäische Justizportal erläutert den Zugang zu deutschen Insolvenzbekanntmachungen und deren Löschfristen: Abgeschlossene Insolvenzdaten werden spätestens sechs Monate nach Verfahrensabschluss gelöscht.
Wer den heutigen Rechtsstatus zuverlässig klären muss, sollte im Unternehmensregister und in den Insolvenzbekanntmachungen nach der Firma und der Registernummer suchen und die Abfrage mit Datum dokumentieren. Für eine belastbare aktuelle Aussage ist eine amtliche Auskunft maßgeblich, nicht allein eine alte Nachricht oder eine sekundäre Firmenseite.
