The SEC’s Office of Investor Education and Advocacy warned in a May 29, 2024 investor alert that a promoter may tout a meme coin, including through a purported presale, to raise its price and then sell before the hype ends, after which the price may fall rapidly. Its advice is direct: “Never make investment decisions based solely on information from social media platforms or apps.”
The CFTC likewise warns that buying a token solely in the hope of selling it for more is speculation with considerable risk, and advises extensive research rather than reliance on promises or guarantees of future value. These warnings do not establish that every meme coin is fraudulent; they do mean that popularity, a presale pitch, or a claim of guaranteed gains is not evidence of a sound investment.

What to check before comparing a meme coin
If the original three picks are independently identified, assess evidence from the relevant period separately from present-day facts. The CFTC identifies several factors worth investigating:
- Identity: Confirm the exact token and network from a reliable source before comparing it with another coin. A name or meme alone does not establish which asset is being discussed.
- Liquidity: Check whether there was meaningful trading activity at the time being assessed, and whether buyers could reasonably trade without relying on a promotional claim. Liquidity can affect a token’s value.
- Custody and theft exposure: Consider how tokens are held and the possibility of theft. A coin’s popularity does not remove custody risk.
- Adoption and demand: Look for evidence of actual adoption or prospective demand, rather than assuming online attention will translate into lasting buyers or uses.
- Technology-change risk: Consider whether changes in the underlying technology could affect the token or its use.
- Claims and incentives: Treat guaranteed future value, pressure to buy quickly, and social-media promotion as reasons to investigate further, not proof of quality.
These are comparison questions, not a checklist that can certify a coin as safe or predict its returns. No comparable coin-specific figures or evidence are established for the unidentified December 2024 picks.
