Can You Email a W-2 to an Employee? IRS Rules and Security

An employer may furnish a W-2 electronically with informed employee consent and required disclosures, but the IRS warns against sending attachments in email.

Yes—but only if you meet the IRS rules for electronic delivery. The employee must affirmatively consent, show they can access the W-2 in the format you provide, and receive required disclosures. That does not make an ordinary email attachment a good choice: the IRS warns that email is not secure and says not to include taxpayer identification numbers or attachments in emails.

When electronic W-2 delivery is allowed

The IRS permits employers to furnish Form W-2 electronically instead of on paper when its requirements are met. The employee must agree to electronic receipt, and the employer must establish that the employee can access the file or system used to deliver the statement. Consent must not have been withdrawn before the W-2 is furnished. See the IRS Internal Revenue Bulletin 2026-32 and the IRS W-2 FAQ.

Consent must be electronic in a way that demonstrates the employee can access the format. If the employer changes the hardware or software needed to access the W-2, it must notify employees before furnishing the statement; new consent is required after the new hardware or software is put into service.

What the employer must disclose and provide

Before or when obtaining consent, provide a clear and conspicuous explanation of the terms. The disclosures must cover:

  • The scope and duration of the consent.
  • How to request a paper copy, and whether doing so also withdraws consent to electronic delivery.
  • How to withdraw consent, when withdrawal takes effect, and how the employer will confirm it in writing. Withdrawal does not apply to forms already issued.
  • When electronic W-2s will no longer be provided, such as after employment ends.
  • How to update contact information and how the employer will notify employees of changes to the employer’s contact details.
  • The hardware and software needed to access the W-2 and how long it will remain available online.
  • That the employee may need to print the W-2 and attach it to a tax return.

The electronic statement must meet the IRS’s content and format requirements. If it is posted on a website, the employer must separately tell the employee—in person, electronically, or by mail—that it is available and explain how to access and print it. Under the IRS’s 2026 guidance, the online statement must be available by the January 31 due date and remain accessible through October 15 of that year.

Why an ordinary email attachment is risky

In Internal Revenue Bulletin 2026-32, Section 2.3, the IRS warns: “Do not include taxpayer identification numbers (TINs) or attachments in emails because email is not secure.” A W-2 contains sensitive identifying and financial information, so sending it as an unprotected attachment can expose it if an email account or message is accessed by the wrong person.

This security warning is separate from the IRS rules that allow compliant electronic furnishing. It is not a ban on electronic W-2 delivery. A prudent option is to use an established, access-controlled payroll or document-delivery process, with appropriate notice and employee access. The IRS materials cited here do not require a particular vendor or technology, and password-protecting an attachment alone does not establish that the consent and disclosure requirements have been met.

Electronic delivery or paper: what should you choose?

Method When it fits What the employer must do
Electronic furnishing The employee has affirmatively consented, can access the format, and has not withdrawn consent. Provide the required disclosures, a compliant statement, and usable access. For website posting, notify the employee how to access and print it.
Paper furnishing The employee does not consent or needs a paper copy. Furnish the paper W-2 under the applicable deadline. Explain whether requesting a paper copy also withdraws electronic consent.

The IRS permits electronic furnishing only when its conditions are satisfied; the rules do not require an employer to use a particular delivery provider. The employee-facing disclosures should make the paper option and the process for requesting it clear.

W-2 deadlines depend on the tax year

For 2026 Forms W-2, the IRS instructions state that the general deadline to furnish employee copies is January 31. For an employee whose employment ends before December 31, 2026, the employer may furnish the copies after employment ends, but no later than February 1, 2027. The instructions also describe a 30-day rule when the employee requests a W-2 in the stated circumstances. Check the 2026 General Instructions for Forms W-2 and W-3 for the details, and use the instructions for the applicable tax year because deadlines and circumstances matter.

Practical checklist before furnishing a W-2 electronically

  1. Obtain the employee’s affirmative consent and confirm they can access the delivery format.
  2. Give the required disclosures before or when consent is obtained, including paper-copy and withdrawal procedures.
  3. Confirm the employee has not withdrawn consent and that the W-2 meets IRS content and format requirements.
  4. If posting the W-2 online, notify the employee that it is available, explain how to access and print it, and keep it accessible for the required period.
  5. Use an appropriately secure delivery process rather than sending a W-2 attachment in ordinary email.
  6. Check the current IRS instructions for the applicable tax year and consider any additional state-law, collective-bargaining, or employer-policy requirements.

This guidance addresses federal IRS requirements; additional rules or policies may apply to a particular employer or employee.
