The best car accident lawyer for you is one whose experience fits your type of collision, who will clearly explain their role and communication process, and whose written fee agreement answers what you will pay—including expenses if there is no recovery. Compare more than one candidate when practical, verify any claimed specialization in the state where the case will be handled, and read the contract before signing. Legal rules and referral-service requirements vary by state; this guide is general information, not a determination of your rights or a recommendation of a particular attorney.
What to look for in a car accident lawyer
Experience with cases like yours
Ask whether the lawyer regularly handles motor-vehicle injury cases similar to yours, and what experience they have with that kind of case. A lawyer’s general years in practice may tell you less than whether they have handled matters with relevant features. The American Bar Association (ABA) identifies expertise and prior experience as practical considerations and recommends asking what kinds of cases a lawyer generally handles (ABA consumer guidance on evaluating a lawyer).
The lawyer’s actual role
Find out who will handle routine work, who will be your day-to-day contact, and which lawyer will make important case decisions. Ask how the firm divides responsibilities and how you can reach the person responsible for your matter. These are useful interview questions, not universal standards for how quickly a lawyer must respond.
Specialization claims you can verify
Ask whether the lawyer is claiming a formal specialization, who certifies it, and how you can verify the credential in your state. The ABA reports that 18 states have lawyer specialization programs on its consumer-guidance page, updated September 18, 2026; programs and requirements can change. That count does not establish that a particular lawyer is certified or that a credential is recognized where your case will be handled. Where formal certification is unavailable, you can ask what areas of practice the lawyer concentrates on (ABA guidance on expertise and specialization).

Questions to ask in consultations
Use the same core questions with each candidate so their answers are easier to compare:
- How much of your practice involves car-accident or other motor-vehicle injury cases like mine?
- What kinds of cases do you usually handle, and what experience do you have with cases like mine?
- Who will be my day-to-day contact, who will handle routine work, and who will make important case decisions?
- Are you claiming a formal specialization? If so, who certifies it, and how can I verify it in this state?
- How will you update me, and how should I reach the person responsible for my case?
- What percentage would you charge if the case settles before a lawsuit, after a lawsuit is filed, or at trial?
- Are expenses deducted before the fee is calculated or after it? Which expenses could I owe if there is no recovery?
- Will the agreement explain how any recovery, fee, and expenses are accounted for at the end?
- If I found you through a referral service, what criteria does it use to select or refer lawyers?
The ABA sources support questions about experience, credentials, fees, expenses, and referral screening, but they do not prescribe one ideal answer or a universal communication response time. Consider whether each lawyer answers clearly and whether the proposed arrangement fits your needs.

How to compare contingent-fee agreements
Many personal-injury matters use contingent fees: the lawyer’s fee is tied to a recovery rather than billed as a fixed amount for each hour. The ABA describes a fixed percentage of a recovery as a common arrangement. Its consumer materials give descriptive examples of often one third, and often one third to 40 percent; these are not a current statewide fee survey, a required rate, or a universal standard. Do not assume a particular percentage is mandatory or appropriate for your case (ABA consumer guidance on contingent fees and expenses).
Compare the actual written terms, not just the headline percentage:

The ABA Model Rule 1.5(c) says a contingent-fee agreement must be in a writing signed by the client. It describes the fee calculation, percentages for settlement, trial, or appeal, expenses deducted from a recovery, and whether those expenses are deducted before or after the fee is calculated. It also says the agreement must clearly notify the client about expenses they may owe regardless of whether they prevail. At the conclusion, the lawyer must provide a written statement of the outcome and, if there is a recovery, show the remittance and how it was calculated (ABA Model Rule 1.5: Fees).
The ABA Model Rules are models, not automatically the controlling rules in every state. Check the rules that apply where the lawyer is licensed and the case will be handled; local requirements may differ. Before signing, make sure you understand how a fee schedule works in the possible stages of your case and what expenses you could owe if there is no recovery. Finding lawyers and using referral services
A local or state bar referral service can help you find candidates, sometimes by practice area. The ABA says some services have competency requirements for participating lawyers; criteria vary, so ask how a particular service screens or refers attorneys. A referral is a starting point, not a substitute for asking the lawyer about relevant experience, responsibilities, communication, and contract terms (ABA consumer guidance on local referral services).
ABA Model Rule 7.2 generally restricts lawyers from giving or promising something of value for a recommendation, while recognizing exceptions such as reasonable advertising costs and usual charges of a qualified lawyer-referral service. It also addresses nonexclusive reciprocal referrals, including client disclosure, and claims of specialist certification, including identifying the certifying organization. These are model provisions: state adoption and amendments may differ. If a lawyer’s referral or specialization claim matters to your decision, ask for the details and check the applicable state rules (ABA Model Rule 7.2: Communications Concerning a Lawyer’s Services).

A practical way to make your choice
- Identify your priorities. Note the features of your collision or injury that make relevant experience important to you, and decide what you need to know about the lawyer’s role and communication.
- Compare candidates consistently. Ask each lawyer the same core questions about case experience, who will handle the matter, credentials, and communication.
- Compare complete fee terms. Put each proposed percentage, stage-based change, expense obligation, deduction order, and final accounting side by side. Do not compare percentages without checking what expenses may be charged separately.
- Verify claims and local rules. Check any specialization through the named certifier and confirm the fee and referral rules applicable in the state where the case will be handled.
- Read the written agreement before signing. Ask the lawyer to explain any term you do not understand, especially what you may owe if the case ends without a recovery.
