FCC Prison Phone Rate Rules: What Took Effect and When

A 2025 FCC pause was superseded by a revised order with a general compliance date of April 6, 2026. The rules set limits and protections, not one price for every prison call.

The FCC’s broad delay of its 2024 prison-phone rules did not remain in effect until April 2027. A later FCC order replaced that date, and the general compliance date for the affected rules was April 6, 2026. The rules set limits and requirements for incarcerated people’s communications services; they are not a single nationwide price for every call, facility, or provider.

What the FCC’s current timeline means

The headline’s “won’t enforce” framing comes from a temporary 2025 pause, not a permanent decision to abandon the rules. On June 30, 2025, the FCC’s Wireline Competition Bureau waived deadlines for certain rate-cap, site-commission, and per-minute pricing provisions until April 1, 2027, or another date set by the Commission. In October 2025, the Commission adopted a revised order that expressly superseded that general date. The revised order was published on December 5, 2025, and made the general compliance date 120 days later: April 6, 2026. That date is the general deadline for the specified rules, not proof that every service at every facility is subject to identical treatment. Facility circumstances and any service- or provider-specific waiver can matter. The available FCC record describes a Securus request for additional relief from the per-minute pricing rule for video service through April 30, 2027, citing implementation and operational challenges; the record available here does not establish whether the FCC granted it or which facilities it would cover. What the 2024 rules changed

The Martha Wright-Reed Just and Reasonable Communications Act of 2022 expanded the FCC’s authority over incarcerated people’s communications. In July 2024, the Commission adopted rules covering intrastate, interstate, and international audio and video services in correctional facilities. The order addressed more than a price cap: it also changed how certain fees and costs may be handled and set requirements involving commissions, accessibility, disclosures, alternative pricing, and reporting.   • Rate limits: The FCC lowered audio rate caps and revised related pricing rules. The 2025 order later revised interim caps and calculations; the caps are ceilings, not a single price that all callers pay.
  • Fees and cost recovery: The 2024 rules included ancillary-service costs in rates while barring separate ancillary charges, and constrained which safety and security costs providers could pass through.
  • Site commissions: The order prohibited providers from making site-commission payments and preempted state and local requirements for such payments.
  • Other protections: The rules strengthened accessibility and consumer disclosures, revised reporting obligations, and allowed conditional alternate pricing plans. States may keep rates below federal caps.

The 2024 order originally set staggered compliance dates, from January 1, 2025, for prisons and larger jails without legally mandated site commissions to July 1, 2025, for facilities where commissions were mandated. It also retained a waiver process for providers that could demonstrate an inability to recover used and useful service costs. Those original dates were subsequently affected by the 2025 actions; they are not the general deadline now. Federal Register summary of FCC 24-75.

Why the rules matter to household budgets

The FCC’s 2024 order reported that, in 2021, the average cost of a 15-minute phone call from prison was $5.74—more than nine times the cost of a 15-minute call elsewhere in the United States. That is an FCC-reported 2021 average, not a current nationwide price. What a family pays today can depend on the service, facility, applicable rate category, and any lower state or facility rate. For a specific bill, identify whether the charge is for audio or video service and check the facility’s rate information and fee schedule. A federal cap does not establish the exact amount charged at a particular facility, and a comparison with a cap is meaningful only if it uses the matching service, date, and rate category.

What the October 2026 court ruling did—and did not—decide

On October 6, 2026, the First Circuit ruled on challenges to the FCC’s 2024 order. It dismissed provider petitions, dismissed some state challenges and denied others, denied some nonprofit challenges, and held certain cost-calculation challenges in abeyance while the 2025 order is reviewed. The opinion records that petitions challenging the 2025 order were pending. It did not decide those challenges or vacate the 2025 rules nationwide. First Circuit opinion, October 6, 2026.

Accordingly, the court decision should not be read as restoring the general April 2027 date or as eliminating the revised rules. The 2025-order litigation and facility-specific waiver questions are separate from what the First Circuit decided about the 2024 order.
