Why the DOJ Is Suing Visa Over Rival Debit Networks

The DOJ’s Visa lawsuit alleges that contracts and incentives restricted rival debit networks. The case survived a motion to dismiss, but no liability finding followed.

The U.S. Department of Justice sued Visa on September 24, 2024, alleging that the company used its reach and contracts to protect its position in debit-network services and make it harder for rival payment platforms to compete. The claims are allegations, not findings: a federal judge denied Visa’s motion to dismiss on June 23, 2025, allowing the case to proceed without deciding whether Visa broke the law.

Why is the DOJ suing Visa?

The DOJ filed United States v. Visa, Inc. as a civil antitrust case in the U.S. District Court for the Southern District of New York. The complaint alleges violations of Sections 1 and 2 of the Sherman Act, the federal laws that address agreements restraining trade and monopolization. The government’s central claim is that Visa used its position in debit payments to limit how much transaction volume could flow over smaller networks and to deter potential competitors.

Debit-network services route a card transaction between the participants involved in processing it. The DOJ complaint identifies two U.S. markets: general-purpose debit network services and general-purpose card-not-present debit network services, the latter covering transactions made without presenting a physical card, such as many online purchases. The complaint alleges Visa had at least 60% of the first market and 65% of the second by payment volume. Those market definitions and shares are the government’s allegations, not court-established facts. The DOJ case page lists the complaint and subsequent court filings.

What does the DOJ say Visa did?

The complaint describes a combination of contractual terms and incentives. DOJ says agreements with merchants and banks included volume requirements and could impose higher fees or penalties when customers routed transactions through other networks. It also alleges Visa offered financial incentives to potential entrants to partner with Visa rather than build competing networks independently.

The government’s theory is that Visa’s broad acceptance and relationships gave it “must carry” leverage: merchants and banks may need to support Visa because customers and trading partners expect it to be available. In the DOJ’s account, a merchant could technically have access to a rival network yet face higher costs across Visa transactions if it routed too much volume elsewhere. The complaint argues that this could make an alternative harder to use at meaningful scale. Whether the contracts had those effects, and whether Visa used them unlawfully, remains for the case to establish.

What does the case mean for consumers and rival platforms?

The DOJ alleges that limiting rival networks’ ability to win transaction volume can hinder entry and competition in debit processing. The government’s concern is that fewer viable alternatives could weaken pressure to improve prices, service, or technology. These are asserted competitive effects, not findings that consumers have already paid a particular amount more or that a specific innovation was blocked.

In announcing the lawsuit, Attorney General Merrick B. Garland said, “In the United States, over $4 trillion of debit card transactions take place every year.” The figure underscores the scale the DOJ says is at stake; it does not by itself prove that Visa’s conduct violated antitrust law. DOJ also said more than 60% of U.S. debit transactions run on Visa and that Visa collects over $7 billion in annual fees on U.S. debit transactions. Those figures appear in the department’s description of its complaint, not as independent court findings. The DOJ announcement sets out the government’s allegations.

Did the judge decide Visa blocked rival payment platforms?

No. On June 23, 2025, the district court denied Visa’s motion to dismiss. That means the complaint survived Visa’s request to end the case at the pleading stage. It does not mean the judge found that Visa monopolized debit markets, that the alleged contract terms had the effects DOJ describes, or that Visa is liable. The court’s opinion addresses whether the case could proceed, not the ultimate truth of the allegations. The DOJ’s case page provides the June 23, 2025 memorandum opinion and order.

What happened after the motion to dismiss?

A later discovery dispute indicates that litigation activity continued. A July 2, 2026 order, reproduced by the secondary legal case index Midpage, denied the government’s motion to compel after a conference set by an order dated June 26, 2026. A discovery ruling is procedural; it is not a decision on the antitrust claims and does not establish that the case ended. The cited order alone does not establish the complete docket status as of October 8, 2026 or a trial date. Midpage reproduces the July 2 order.
