The Supreme Court’s 2018 decision removed a federal barrier to states authorizing sports betting; it did not make esports betting legal nationwide. Whether you can legally wager on an esports event depends on your state’s law, the regulator’s rules, and the particular operator, event, and market.
What the Supreme Court decided
On May 14, 2018, the Supreme Court decided Murphy v. National Collegiate Athletic Association, 584 U.S. 453 (2018), and invalidated the Professional and Amateur Sports Protection Act (PASPA). PASPA had made it unlawful for states to authorize sports-gambling schemes. The Court held that its anti-authorization provision unconstitutionally commandeered state legislatures by directing them to keep a particular policy in place. It also held the related anti-licensing provision unconstitutional and found PASPA’s provisions nonseverable. Read the Court’s opinion.
The ruling was about the division of authority between the federal government and the states. As Justice Samuel Alito wrote for the Court, “Congress can regulate sports gambling directly, but if it elects not to do so, each State is free to act on its own.” The opinion did not create a national licensing system or address esports specifically.
Did the ruling make esports betting legal where you live?
No. The ruling removed PASPA’s restriction on state authorization; it did not require any state to permit sports wagering. A state may allow it, prohibit it, or set conditions, and the applicable law and regulator determine what is available in that jurisdiction. The legality of a particular esports wager cannot be inferred from the Supreme Court decision alone.

Before placing a wager, check the gaming regulator for your state and confirm each of these details:
- Sports wagering is permitted: A state’s overall policy determines whether licensed wagering can operate there.
- Esports is an allowed event category: Permission for conventional sports does not, by itself, establish that esports events are eligible.
- The event and market are covered: Rules may depend on the specific game, tournament, or type of wager.
- The operator is licensed: Check that the sportsbook is authorized in your jurisdiction, not just available through an app or website.
- You meet local requirements: Follow applicable age, identity-verification, and responsible-gambling rules.
How a state can handle esports events
State rules can treat esports as an event category subject to regulator approval rather than making every game and wager automatically available. For example, North Carolina’s State Lottery Commission lists “eSports” among event types that may be approved for interactive sports wagering. That illustrates a state-specific permission framework; it does not mean every esports event, operator, or market is approved in North Carolina, much less elsewhere. What “step out of the shadows” does—and does not—mean
The phrase describes the possibility that wagering may move into licensed channels where state law allows it. It is not language from the Court’s holding, and the ruling does not prove that esports betting as a whole is regulated. State variation, event approval, publisher control, game integrity, and safeguards such as age verification remain relevant questions for any legal market.
Alito put the institutional limit plainly: “The legalization of sports gambling requires an important policy choice, but the choice is not ours to make.” That choice belongs to lawmakers and regulators unless Congress directly regulates sports gambling. No current, reliable market-size figure is established here, so old forecasts should not be mistaken for a current measure of esports wagering.
