Ranchers and industry groups disagreed over both measures, weighing consumer choice and market access against inspection, traceability, and competition concerns.
What South Dakota’s two meat laws do
The measures address different products and actions. Senate Bill 124 temporarily prohibits cell-cultured protein, while House Bill 1064 would allow a narrow category of direct sales of conventional meat if its federal-law trigger is met.

What the cell-cultured-protein moratorium covers
SB 124 defines cell-cultured protein as food made wholly or partly from a host animal’s cell culture or DNA, cultivated outside a live animal. It excludes certain biotechnology and fermentation uses when they are not intended to replicate meat or animal tissue for human consumption. The law also requires cell-cultured protein to be labeled “cell-cultured” or “lab-grown” adjacent to the food name under a 2025 labeling law.
Governor Larry Rhoden vetoed the broader HB 1077 proposal and supported an amended SB 124 compromise. In a June 24, 2026 notice, Rhoden said the moratorium would allow for further studies and for lawsuits in other states to proceed. The compromise, rather than the earlier proposal to treat cultivated protein as adulterated, is the measure that took effect.

The law’s food-service provisions provide for inspection after a complaint, stop-sale orders upon a violation, and licensing consequences after conviction. Violations are Class 2 misdemeanors. The moratorium is temporary; its stated statutory period ends June 30, 2031.
Why cattle-industry groups disagreed over cultivated protein
Supporters of restrictions argued that long-term health effects were not known, production processes were proprietary and insufficiently transparent, and the technology could consolidate food production at the expense of ranchers or rural communities. Those are stakeholder arguments, not established findings that cell-cultured products are unsafe or that those market effects will occur.

Opponents pointed to federal safety approvals for some products, consumer choice, and the risk of litigation if the state restricted a food category without evidence that it was contaminated or dangerous. Producer and senator Sydney Davis also warned that a broad restriction could invite costly interstate-commerce litigation. These positions were reported during the legislative debate; the available sources do not establish a comparative health risk.
The path to the final law illustrates the divide. South Dakota Searchlight reported an 18–16 Senate vote on the earlier restriction measure; that was not a vote on the final moratorium. Rhoden vetoed HB 1077 and urged the amended SB 124 compromise. His office reported support for the veto and compromise from the South Dakota Farm Bureau, South Dakota Cattlemen’s Association, and South Dakota Retailers.

What HB 1064 would allow—and what must happen first
HB 1064 was signed on February 17, 2026, but signing did not immediately authorize the described sales. Its sales section takes effect only when federal law allows direct sales of uninspected meat or a final federal-court decision invalidates the federal prohibition, and the South Dakota attorney general certifies that condition to code counsel. The reviewed materials do not establish whether that certification had been issued by October 8, 2026.
Eligibility and sales conditions
- The meat must come from cattle, sheep, swine, or goats that the producer raised for at least 90 days.
- The animal must be slaughtered and processed in South Dakota at a custom-exempt plant.
- Sales must be personal and direct to an end consumer in South Dakota, at the seller’s residence, a farmers market, a roadside stand, or another temporary sales venue.
- The package must disclose that the meat has not been inspected and is not regulated. It must also state that the buyer agrees not to resell, donate, or commercially redistribute it.
This is not a general authorization to sell uninspected meat through ordinary retail channels. It is a conditional pathway with specific livestock, processing, venue, and labeling criteria.

Why producers disagreed over direct sales
Supporters described HB 1064 as a way to expand consumer choice and give producers more direct-market opportunities, particularly where inspected slaughter facilities are distant or processing queues are long. The South Dakota Retailers Association also supported the measure, according to reporting on the debate.
The South Dakota Cattlemen’s Association and operators of inspected meat lockers raised concerns about competition with processors that pay for inspection, labeling, and recordkeeping systems. They cited federal controls, pathogen testing, recall systems, and more extensive documentation at inspected facilities. Those are concerns expressed by opponents, not proof that the permitted sales would cause harm or that market effects are certain.

HB 1064 passed the Senate 28–6 before it was signed. That vote concerns the direct-sales bill and should not be confused with the 18–16 vote on the earlier cell-cultured-protein restriction proposal.
How the measures affect different parts of the meat market
The legislation does not represent one unified policy toward meat alternatives or small producers. SB 124 restricts a defined category of food for a fixed period; HB 1064 creates a conditional, limited route for producer-to-consumer sales of conventional meat. The first centers on product regulation and competition concerns around cell-cultured protein. The second centers on market access, inspection systems, traceability, and the economics of inspected processors.
Neither debate establishes a general finding about food safety or the economic impact of either measure. The laws set legal conditions; the stakeholder arguments explain why industry participants supported or opposed them.
