Why Johnny Gioeli Sued Sega Over “Live and Learn” — and What the Court Decided

Johnny Gioeli’s lawsuit over “Live and Learn” turned on whether the 2001 Sonic Adventure 2 credits and copyright notice put him on notice of Sega’s ownership position. The court ruled the remaining claims were filed too late, without broadly deciding every question about the song’s ownership.

Johnny Gioeli sued Sega of America over “Live and Learn,” the song he wrote for Sonic Adventure 2, after alleging that Sega used the track without properly recognizing or compensating him. The court ruled for Sega on the claims still before it, but on a deadline: it found that the game’s 2001 credits and copyright notice gave Gioeli notice of Sega’s position, so his composition-ownership claim was filed too late under the applicable three-year limitations period.

What was the dispute about?

“Live and Learn,” associated with Sonic Adventure 2 and the band Crush 40, became the subject of a rights and compensation dispute between Gioeli and Sega of America. Gioeli filed suit in December 2024, alleging that Sega’s use of the song extended beyond the original game and included re-releases and other titles. GameSpot reported that his complaint alleged use in at least 25 games; that figure is Gioeli’s allegation, not a court finding that every use occurred or was unauthorized.

The legal distinction at the center of the case was between the lyrics and the musical composition. The court record recounts a February 1, 2001 services agreement under which Gioeli was to write lyrics for the song. Gioeli conceded that he was not claiming ownership of the lyrics. His remaining ownership claim concerned the music and arrangement of the composition.

Why did Gioeli believe he had a claim?

Gioeli’s position was that the agreement dealt with his lyric-writing services and did not transfer the composition rights he claimed. Sega took the opposing view: the song’s credits and copyright notice in the 2001 game identified Sega contributors and Sega, rather than Gioeli, and thus made Sega’s position clear.

The dispute was not simply about whether the song appeared in later releases. Gioeli alleged broader reuse and compensation issues, but the court’s ruling focused on when his ownership claim accrued and whether he filed within the statutory deadline.

Why did the court rule for Sega?

The Copyright Act generally requires a civil action to be brought within three years after the claim accrues. For an ownership dispute, the court applied the “plain and express repudiation” standard: the limitations clock begins when a claimant receives clear notice that another party rejects the claimant’s ownership position.

The court concluded that the Sonic Adventure 2 credits and copyright notice in 2001 provided that notice. Because Gioeli did not bring the ownership claim within the resulting period, the court granted Sega summary judgment on that remaining claim. It also ruled against the related accounting and unjust-enrichment claims because they depended on the ownership claim.

Did Gioeli win, and did the court decide who owns the song?

Gioeli did not prevail in court: Sega received summary judgment on the claims that remained. But it is too broad to describe the ruling as a determination that Sega owns every right in “Live and Learn.” The decision was a limitations ruling based on the court’s conclusion that the 2001 materials gave notice of Sega’s position; it did not broadly resolve every question about the song’s ownership.

In September 2025, Gioeli publicly characterized the result as a dismissal based on timing rather than ownership and described the song as being in an “abyss of ownership.” That was Gioeli’s characterization, not the court’s holding.

What happened after the ruling?

Time Extension reported in January 2026 that Sega used a remix of “Live & Learn” in anniversary material and that Gioeli replied “all is good” to a fan. Those reports suggest a more positive public signal about the parties’ practical relationship or the song’s use. They do not establish that the parties disclosed a settlement, agreed on license terms, or obtained a new court ruling about ownership.

Can Sega still use “Live and Learn”?

The reported anniversary use shows that Sega used a remix in that material, but it does not establish the legal basis or terms for that use. The court’s limitations decision does not, by itself, answer every question about ownership, licensing, or the parties’ arrangements. No disclosed settlement or later judicial ownership ruling is established by the cited reporting.
