The phrase “copying Temu’s copyright lawsuit” is shorthand for this back-and-forth—not a court finding that Shein copied Temu’s lawsuit or that either company infringed the other’s rights. The U.S. courts have made procedural rulings on some claims; those rulings do not establish that the alleged conduct occurred.
What does “copying Temu’s copyright lawsuit” mean?
It describes the resemblance in the companies’ litigation strategies: each accused the other of unlawful conduct involving intellectual property and competition. But the cases are separate, involve different allegations, and have their own procedural histories. The UK case is separate again, brought under English law.
What happened in the U.S. cases?
Temu’s 2023 lawsuit against Shein
Temu alleged that Shein used copyright enforcement to impede a rival, including by sending DMCA notices that misrepresented copyright ownership or authority to act for rights holders. Temu also alleged copying of its intellectual property and other competitive conduct.
In September 2025, the U.S. District Court for the District of Columbia allowed Temu’s claims alleging DMCA violations, copyright and trade dress infringement, fraud on the U.S. Copyright Office, and unfair competition to proceed beyond dismissal. It dismissed Temu’s trade-secret, antitrust, tortious-interference, and abuse-of-process claims. The court also dismissed Shein Technology LLC from the case because Temu had not attributed specific conduct to that subsidiary. These were decisions about which claims could proceed, not findings that Shein was liable.

A February 2025 opinion recounted Temu’s account that Shein employees had taken photographs in about 3% of listings in Temu’s review. That figure describes Temu’s account of its sampled listings; it is not a court-verified rate of invalid notices or infringement. The court noted that, without discovery, Temu had not said whether Shein otherwise owned the images or had authority to act for their owners.
Shein’s 2024 U.S. lawsuit against Temu and PDD Holdings
In a separate case, Shein alleged that Temu obtained and shared confidential “Best Seller Data,” directed suppliers to copy popular Shein products, used Shein images, and engaged in other conduct, including trademark-related advertising and influencer claims. These remain allegations, not established findings.

On January 7, 2026, the D.C. court dismissed PDD Holdings from the case for lack of personal jurisdiction. It granted in part and denied in part WhaleCo’s motion to dismiss, determining which claims could proceed at that stage. The ruling did not establish that Temu copied Shein’s products or misused its data. The court described the dispute this way: “Each platform has accused the other of engaging in unlawful, multifaceted campaigns to interfere with the other’s competitive posture.”

Shein’s UK case is not one of the U.S. actions. It concerns Shein’s allegation that Temu displayed Shein-branded fashion product photographs on its UK website without permission. Shein’s June 2023 letter before action listed 8,036 Temu URLs alleged to contain infringing material. That is the number of URLs in Shein’s allegation—not a finding that every URL infringed copyright.

How should you interpret the court decisions?
- A claim surviving dismissal is not proof. A motion-to-dismiss decision assesses whether pleaded claims may proceed; it does not decide whether the allegations are true.
- Jurisdiction is not the merits. Dismissing PDD Holdings for lack of personal jurisdiction addresses whether the court could hear the case against that company, not whether the underlying allegations were valid.
- Keep the cases and numbers in context. Temu’s roughly 3% figure concerned its account of a sample and image-taking; Shein’s 8,036 figure counted URLs it alleged were infringing. Neither number is a court-established measure of infringement.
