How a Lawyer Can Help After a Semi-Truck Accident

A truck-accident lawyer may investigate the crash, assess potential liability, document injuries and losses, and guide you through insurance or litigation steps. Deadlines and claims depend on state law and the facts.

A lawyer can investigate how a semi-truck crash happened, assess who may be legally responsible, preserve and evaluate relevant records, document your injuries and losses, and handle communications with insurers. If a claim cannot be resolved through negotiation, counsel can advise whether litigation is appropriate. These are possible legal services, not a promise of a particular result: liability, available claims, deadlines, and damages depend on the facts and the law in the state where the claim is handled.

What should you do after a truck accident?

Prioritize immediate safety and medical care. Once you are able, keep records that may help explain what happened and how the crash affected you. A lawyer can advise which additional steps make sense for your circumstances and jurisdiction.

  1. Get medical attention. Follow medical advice and keep copies of records, bills, prescriptions, and other documents related to your care.
  2. Keep information about the crash. Save the police report or information on how to obtain it, photographs, witness contact details, and any messages or paperwork you receive about the collision.
  3. Track financial effects. Keep records of missed work, expenses, and other losses connected to the crash. The categories of damages a claimant may recover depend on the facts and applicable state law.
  4. Speak promptly with a lawyer licensed in the relevant jurisdiction. A lawyer can assess deadlines and claim procedures that may apply before you decide how to proceed.

What can a lawyer do for your case?

Investigate the collision

Counsel can gather and assess available evidence, such as crash reports, photographs, witness accounts, and records related to the truck or driver. Depending on the case, a lawyer may send preservation requests and use discovery or other legal procedures to seek information. What exists, what can be obtained, and how it may be used depend on the circumstances and applicable law; not every record is available to a claimant simply by asking.

Identify potential claims and responsible parties

A lawyer can evaluate whether the evidence supports a claim against the truck driver, a motor carrier, or another person or company. A crash involving a commercial truck does not automatically make the carrier, shipper, maintenance provider, or manufacturer liable. Responsibility must be assessed using case-specific evidence and the law that applies.

Document injuries and losses

Counsel can organize medical and financial records to explain the harm connected to the collision. That may include documenting treatment and its effects on work and daily life. The evidence needed and the damages available vary by case and state.

Handle insurer communications and pursue a resolution

A lawyer can communicate with insurers, evaluate offers in light of the available evidence, and explain possible next steps. If negotiation does not resolve the claim, counsel can advise whether filing a lawsuit is appropriate and represent the client in litigation, subject to the applicable rules and deadlines.

What records might matter in a truck-crash investigation?

Federal rules require carriers to keep certain records, but those rules are not a complete inventory of evidence in a particular crash. The truck’s equipment, the carrier’s obligations, the circumstances, and the legal process available can all affect what records exist and can be obtained.

Police crash reports and other state records May provide information about the reported collision and can be among the source materials used in NHTSA’s Fatality Analysis Reporting System (FARS). FARS is a database of qualifying fatal crashes, not a substitute for investigating an individual claim. Its public data do not include personal identifying information. Carrier accident records and accident register Under 49 CFR § 390.15, a motor carrier must make accident records and information available to specified authorized investigators. The carrier must also keep an accident register for three years, including listed details such as the date and location, driver, injuries, fatalities, hazardous-material release, and required reports. The three-year period is a carrier recordkeeping requirement, not a general deadline for an injured person to file a claim. Availability to a particular claimant depends on applicable access rules and legal procedures. 49 CFR § 390.15.
Electronic logging device (ELD) records For carriers subject to ELD requirements, 49 CFR § 395.22 requires a backup copy of ELD records to be retained for six months. Section 395.30 sets duties concerning accurate records and prohibits carriers from altering or erasing original information and source data streams. These rules do not guarantee that a particular truck has a relevant record or that every useful record remains available. The six-month backup period is not a claimant’s filing deadline. 49 CFR § 395.22; 49 CFR § 395.30.
Supporting documents tied to records of duty status Federal rules cover supporting documents and prohibit destroying or altering existing information in a supporting document. Such material may be relevant to evaluating a driver’s records. Whether a particular document exists or can be obtained for a claim is case-specific. 49 CFR § 395.11.

Who can be held responsible?

The driver may be one potential defendant, but a truck crash can raise questions about other people or businesses depending on the evidence. A lawyer can investigate possible roles and claims without assuming that any particular party is at fault.

  • Driver: Evidence may bear on the driver’s actions and the circumstances of the collision.
  • Motor carrier: The carrier’s conduct or records may be relevant, but its involvement in the trip alone does not establish liability.
  • Other businesses or parties: A shipper, maintenance provider, manufacturer, or another party may warrant investigation if facts point to its role. Liability cannot be inferred simply because that party was connected to the truck or cargo.

Which claims are available, how fault is allocated, and what damages may be recovered depend on the facts and state law.

How long do you have to file a truck accident claim?

There is no single deadline that can be stated for every U.S. truck-crash claim. The crash state, date, claimant’s status, potential government involvement, and other circumstances can affect the statute of limitations, notice requirements, and procedural rules. The federal three-year accident-register requirement and six-month ELD-backup rule described above govern carrier records; neither sets the time an injured person has to file a lawsuit. Consult a lawyer licensed in the relevant jurisdiction promptly to identify the deadlines and procedures that apply to your situation.

How can you evaluate a lawyer for a truck-crash case?

Ask questions that clarify who will handle the matter, what the process may involve, and what the fee arrangement means for you. Confirm the answers and all terms directly with the lawyer.

  • What experience do you have with commercial-truck collision cases?
  • Who will investigate and handle my matter, and how will you provide updates?
  • What records or experts might be needed in my case?
  • What fee agreement applies, what costs may be charged, and how are costs handled if there is no recovery?
  • Are there any conflicts of interest or other limitations I should understand?

How common are fatal crashes involving large trucks?

NHTSA reported 5,788 deaths in U.S. traffic crashes involving large trucks in 2021; 72% of those fatalities were occupants of vehicles other than the large truck. NHTSA published those figures in March 2023, and they describe 2021—not a current-year estimate. The statistics provide national context, not a prediction about any individual collision or claim.
