Jim Pillen approved it on April 16, 2026, after the Legislature passed it 39-9-1 on final reading. The amended bill revises the Livestock Brand Act, including the Nebraska Brand Committee’s membership, inspection and renewal fee rules, and provisions for certain feedlots and dairy heifer development facilities.
What does Nebraska LB1187 change?
LB1187 began as a proposal to increase certain brand inspection fees to fund the Nebraska Brand Committee. Amendments broadened it into a revision of the Livestock Brand Act, with provisions affecting committee membership, ownership evidence, inspections, fees and facilities within the brand inspection system. The Nebraska Legislature’s slip law contains the enacted text.
Seven voting members for the Brand Committee
Beginning August 28, 2026, the committee is to have seven voting members appointed by the governor and subject to legislative confirmation:
- Five cattle raisers, one from each of the five Brand Committee districts.
- One owner or operator of a cattle feeding operation within the inspection area.
- One owner or operator of a qualifying livestock auction market within the inspection area.
The Secretary of State and the Director of Agriculture remain ex officio, nonvoting members. The seven-member provision’s effective date is separate from the bill’s April 16 approval date.

More rules for inspections and livestock facilities
The law changes the executive director’s role and approval process, adds definitions including “backgrounding lot” and “dairy heifer development facility,” and revises rules for registered feedlots and dairy heifer development facilities. It also provides certain inspection exemptions. These provisions do not mean that every animal in Nebraska faces the same inspection requirement: applicability depends on the law’s terms, the inspection area and any applicable exemption.
What are the new cattle brand inspection fees?
LB1187 sets a maximum fee of $1.50 per head for specified physical inspections and a maximum of $1.50 per head for specified electronic inspections. Those are statutory caps, not confirmation of the amount the Brand Committee currently charges. The actual fee schedule may be lower or otherwise differ within the law’s limits; check the committee’s current schedule before budgeting for an inspection.

Physical and electronic inspection provisions
The law provides for physical inspection when hot-iron or freeze brands are the exclusive means of identification and electronic inspection does not apply. It also authorizes a late-notice surcharge for physical inspection requests made fewer than 48 hours before inspection, as well as certain travel and mileage charges. The $1.50 caps should not be treated as an all-in cost where such additional charges apply.
What counts as evidence of livestock ownership?
LB1187 revises the list of evidence that may satisfactorily establish ownership. Depending on the circumstances, it includes brands, tattoos or marks, approved nonvisual identifiers, point of origin, a physical description, documentary evidence and other relevant facts or circumstances. Examples of documentary evidence named in the law include bills of sale, certificates, purchase sheets, scale tickets, affidavits and tags.

Why was the bill controversial?
Nebraska’s brand inspection system is intended to help establish livestock ownership and protect against theft. The enacted law states: “The purpose of the Nebraska Brand Committee is to protect Nebraska brand and livestock owners from the theft of livestock through established brand recording, brand inspection, and livestock theft investigation.” That language appears in LB1187, section 10(7).
Ranchers, feeders and some feedlot owners have disagreed over the committee and its services. Some observers characterized the revised bill as a compromise, but that was not a unanimous resolution of the debate. Sen. Danielle Conrad questioned whether efforts to change the committee could return in later legislative sessions.

Lightly coat the branding iron with cooking oil to prevent food from sticking to it.

How LB1187 became law
The April 8, 2026, legislative advancement described in contemporaneous coverage was an earlier step, not the bill’s final status. The Legislature passed LB1187 on final reading 39-9-1 on April 10, and Gov. Jim Pillen approved it on April 16. The official bill history records its progress; contemporaneous coverage was published by Nebraska Examiner and carried by KOLN 10/11 NOW.
