19 states sued over DOGE access to Treasury payment systems. Here’s what happened next

A 19-state coalition sued after DOGE-affiliated personnel gained access to Treasury payment systems. Here is what the courts ordered, what data was at issue and why the case’s status remained unsettled in August 2026.

Short answer: Nineteen Democratic state attorneys general filed State of New York et al. v. Donald J. Trump et al. on February 7, 2025, after Treasury gave DOGE-affiliated personnel access to Bureau of the Fiscal Service payment systems. Those systems process Social Security, Medicare-related payments, tax refunds, veterans’ benefits, grants and other federal payments, and contain sensitive personal and financial information.

A federal judge issued a temporary restraining order the next day and a preliminary injunction on February 21, restricting DOGE-affiliated access to payment records and systems containing personally identifiable or confidential financial information. The injunction was later modified and appealed. As of August 18, 2026, the district court was asking whether the case had become partly or entirely moot after Executive Order 14,158’s scheduled July 4, 2026, end date for DOGE.

What happened

President Donald Trump’s Executive Order 14,158, issued January 20, 2025, established the administration’s DOGE initiative. Soon afterward, personnel associated with DOGE’s Treasury team obtained access to systems operated by the Treasury Department’s Bureau of the Fiscal Service.

New York and California led a coalition of 19 state attorneys general. The coalition sued Trump, Treasury Secretary Scott Bessent, the Treasury Department and DOGE-related defendants in the U.S. District Court for the Southern District of New York, case No. 1:25-cv-01144. California’s announcement describes the filing, defendants and the states’ allegations about access to bank-account information and Social Security numbers (California attorney general announcement).

The states challenged the decision to grant access, not a proven mass identity-theft event. Nothing in this case alone establishes that every recipient’s records were viewed, copied or misused.

Which states sued?

The complaint was brought by 19 state attorneys general, with New York and California in the lead. The complete coalition appears in the filed complaint’s caption and allegations (filed complaint). Coalition membership in later DOGE cases was different, so those proceedings should not be treated as the same lawsuit.

Timeline of the case

March–May 2025 The injunction and related orders were clarified and modified, including an order excluding the Payment Processing System software from certain restrictions.
July 2025 Federal defendants pursued an interlocutory appeal; Delaware’s official tracker records a July 31 filing.
July 7, 2026 Judge Jeannette Vargas ordered the parties to address whether DOGE’s scheduled end left live issues or made some claims moot.
August 18, 2026 The case’s ultimate disposition still required careful docket checking; the available record did not justify declaring a final dismissal or that all restrictions had vanished.

What Treasury systems were at issue?

The case concerns the Bureau of the Fiscal Service’s payment infrastructure, not unrestricted access to every federal database. The infrastructure processes:

  • Social Security and Medicare-related payments;
  • tax refunds;
  • veterans’ benefits;
  • grants;
  • payments to contractors and other recipients.

The states said the systems contained or could expose Social Security numbers, bank-account details, payment and payee records, and information about state governments’ own transactions. The presence of that information in a system does not prove that each DOGE-affiliated worker could see every record or that every recipient’s complete file was available.

What the states alleged was unlawful

According to the complaint and state filings, Treasury allegedly expanded access without the safeguards normally required for sensitive payment systems. The states argued that:

  • Treasury lacked authority to give DOGE-affiliated personnel access on this scale;
  • some personnel allegedly lacked appropriate background checks, clearances, information-security training or a demonstrated job need;
  • the arrangement threatened the confidentiality of state and individual payment information;
  • access could allow interference with congressionally authorized payments; and
  • the administration violated the Administrative Procedure Act and constitutional limits on executive power.

The preliminary-injunction order describes the states’ requests for declaratory and injunctive relief under the Administrative Procedure Act and the Declaratory Judgment Act (district-court docket).

What the federal government argued

The federal defendants disputed the states’ characterization of the access and argued that controls limited what DOGE personnel could do. Their position was that the personnel were executive-branch workers supporting efforts to identify fraud, waste or improper payments. The government also challenged the states’ standing and the breadth of the requested orders, arguing that the court should not manage ordinary executive administration or block payment operations more broadly than necessary.

Those are litigation positions, not findings that the systems were risk-free. Likewise, the states’ allegations were not a final merits judgment.

What the courts actually ordered

February 8 temporary restraining order

The TRO generally barred Treasury from giving prohibited personnel access to payment records, payment systems or other Treasury data containing personally identifiable or confidential financial information. An exception covered qualifying career Bureau of the Fiscal Service civil servants who had a job need and appropriate checks, training and clearances. The order also required personnel who had accessed the systems in violation of the restrictions to destroy downloaded copies, if any (February 8 TRO).

February 21 preliminary injunction

The preliminary injunction substantially continued limits on DOGE-team access to Treasury payment records and systems containing personally identifiable or confidential financial information (February 21 opinion and order). The judge did not grant the states’ broader request to prohibit every automated or manual process that could potentially stop payments. The order therefore restricted access to sensitive systems; it did not find that DOGE had already stopped Social Security or Medicare payments.

Later modifications and appeal

Subsequent orders changed the injunction’s scope, including an order excluding the Payment Processing System software from certain restrictions. The federal defendants’ interlocutory appeal and additional procedural developments are summarized in Delaware’s official litigation tracker (Delaware Department of Justice tracker).

What was the status on August 18, 2026?

Status as of August 18, 2026: The district court had issued a preliminary injunction, and the federal government had appealed. On July 7, 2026, Judge Vargas asked the parties whether the apparent dissolution of DOGE left any live controversy because Executive Order 14,158 scheduled DOGE to end on July 4, 2026 (July 7 order).

That question concerns mootness—whether a court can still grant effective prospective relief—not whether the original access was lawful. A case may lose a live need for an injunction while leaving disputes about past access, records, or accountability. The record available by August 18 did not support saying without qualification that the case was dismissed, that the injunction fully remained unchanged, or that every restriction had disappeared.

Could DOGE see your Social Security number or bank account?

The states argued that DOGE-affiliated personnel were given access to systems containing such information. That establishes a disputed access decision and a claimed exposure risk, not proof that Elon Musk personally viewed or downloaded individual records. The litigation does not establish that all Americans were exposed, that a mass public breach occurred, or that identity theft resulted.

“Access,” “copying,” and “misuse” are separate factual questions. The TRO’s destruction-of-copies requirement addressed the possibility that prohibited personnel had downloaded material; it was not a finding that a mass download occurred.

What did this mean for payments?

The states argued that people with access might be able to interfere with federal payments. The court’s injunction did not establish that payments were actually withheld or stopped. Recipients of Social Security, veterans’ benefits, tax refunds or grants should not infer from this case alone that their payments were automatically at risk.

Treasury payment systems are also different from Social Security Administration, IRS tax-return, Office of Personnel Management and other agency systems. A person’s records in one system do not prove access to every file held by another agency.

How this case differs from other DOGE lawsuits

Other proceedings involved different plaintiffs, agencies and requested remedies:

  • The state coalition case focused on Treasury and Bureau of the Fiscal Service payment systems, including asserted state interests.
  • Labor-union and retiree cases challenged access involving Treasury, Social Security or other agencies.
  • Privacy organizations brought separate challenges involving Treasury, OPM and other departments.
  • SSA litigation focused on Social Security Administration systems and records, not necessarily the payment infrastructure at issue here.

Those cases may produce different factual records and legal outcomes. They should not be merged into one “DOGE data lawsuit.”

What to watch next

  • Any final district-court ruling on mootness after DOGE’s scheduled end date.
  • Appellate decisions concerning the preliminary injunction and its modifications.
  • Evidence about what records were accessed, copied or retained, as distinct from the authority to grant access.
  • Whether successor personnel or a newly named executive-branch initiative receives comparable access.

The central lesson is narrow but important: the states obtained early judicial limits on DOGE-affiliated access to sensitive Treasury payment systems, while the legality of the original arrangement and its lasting consequences remained unresolved as of August 18, 2026.
