That means the claim that it would “destroy California’s nascent industry” remains an untested prediction, not a measured outcome. The proposal could have imposed significant costs and legal uncertainty on developers of the most powerful AI models, but it did not target every company using AI—and its defeat does not prove that the feared costs or promised safety benefits were inevitable.
What SB 1047 proposed
SB 1047, formally the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act, was a California proposal focused on developers of certain frontier models and their derivatives. It was not a general rule for every business that used a chatbot, an AI API or machine-learning software. Coverage depended on the bill’s definitions and thresholds, including the resources used to develop a model. The final text is available in the California Legislature’s bill text.
The proposal would have required covered developers to establish written safety and security procedures, assess and mitigate specified risks, and maintain the ability to promptly shut down a covered model. It also included reporting and enforcement provisions, with a role for the California Attorney General and a proposed state Frontier Model Division. The requirements were aimed at preventing models from causing or materially enabling defined “critical harms,” including grave threats involving weapons and cyber capabilities.
That framework put obligations on model development, not only on the later use of AI products. A company training a model that met the statutory criteria could have been in a different position from an application startup using another company’s hosted API. A downstream business was not automatically subject to the same model-developer duties just because it incorporated AI into a service.

Why model distribution mattered
A hosted API gives its provider control over access to the service. An open-weight release distributes the model’s trained parameters, which other people can download, modify or fine-tune. Once weights are outside the developer’s systems, the original developer cannot reliably control later users or retrieve every copy. Open-source software, open-weight models, closed APIs and modified derivatives are related but not interchangeable categories; the practical ability to monitor or shut down a model varies substantially among them.
Why supporters wanted mandatory safeguards
Supporters argued that a small number of developers building exceptionally capable systems could create risks severe enough to warrant obligations before a catastrophe occurred. Their case was that developers are better placed than individual users to test models, secure them, document safeguards and prepare for incidents. Voluntary commitments and remedies after harm, they said, might come too late for risks involving catastrophic misuse.
- Responsibility at the source: Model developers make choices about training, access and release that can affect how readily a system can be misused.
- Baseline practices: Mandatory evaluations, security procedures and incident response could set a common floor rather than depend on each company’s voluntary policies.
- Public-interest leadership: Senator Scott Wiener and other supporters argued California should help shape AI governance because major developers and research institutions operate in the state. Wiener’s response to the veto is published by his Senate office.
- Room for smaller innovators: The bill’s findings said access to compute and AI innovation should remain available to startups and academic researchers, rather than being reserved for large firms.
On this view, rules targeted at the most powerful systems could reduce the chance that a severe incident undermines public trust or imposes costs on the wider economy. A clear safety framework might also help responsible firms demonstrate that they meet expectations from customers and investors.

Why opponents warned of economic damage
Opposition was substantial, but the technology sector was not a single bloc. Large companies, trade groups, open-model advocates, founders and researchers raised overlapping but distinct concerns. Some participants supported the goal of AI safety while objecting to the bill’s design; contemporary reporting, for example, described Anthropic as seeking changes rather than simply rejecting safeguards (Axios).

Critics worried that developers might face legal exposure when a model was misused downstream, even if they did not control the user, application or deployment setting. Uncertainty about what counted as reasonable care, a covered derivative or a material contribution to harm could make it difficult to estimate legal risk before release. For a young company, that uncertainty could affect whether it launches, limits access or seeks costly legal advice.
Open weights and derivatives
Developers distributing weights argued that a shutdown requirement is easier to implement for a hosted service than for copies already downloaded and changed by third parties. Fine-tuning can alter a model’s behavior, and a derivative may be integrated into a system the original developer never sees. This creates a genuine control problem: the developer may be responsible for risk mitigation while lacking the technical ability to control every later use.

Fixed costs and competition
Testing, documentation, audits, security engineering and legal review can require substantial resources. If the rules applied to a startup’s model, the same fixed costs might weigh more heavily on it than on a major company with established compliance teams. That could favor incumbents, discourage releases or lead some firms to move covered development elsewhere.
The reverse possibility also matters. Predictable rules could help smaller firms show customers that their systems meet credible safety standards, while a lack of accountability might let companies externalize risks. Whether regulation would help or entrench incumbents depends on the scope, clarity, enforcement and cost of the rules—not simply on whether they exist.

Why the “destroy” claim is hard to test
The headline’s forecast could mean fewer startups, lost jobs, reduced investment, relocation, fewer model releases or less access for California users. Those outcomes are not equivalent, and a claim of “destruction” is difficult to assess without a defined measure. Opponents’ proposed mechanism was plausible: compliance costs and liability uncertainty might influence where firms build models. But the law never took effect, so there is no direct evidence that SB 1047 caused companies to leave, investment to fall or California’s AI sector to shrink.

Why Newsom vetoed the bill
Newsom vetoed SB 1047 on September 29, 2024. His message described the bill as well-intentioned but argued that it was not sufficiently targeted. In particular, he objected to using model size or development compute as a central proxy for risk, rather than focusing more directly on high-risk deployment settings, critical decisions and sensitive data. The governor’s full explanation is in the official veto message.
That distinction is consequential. A model’s training scale may help identify systems worth scrutinizing, but it does not by itself tell regulators how a system is deployed or what decisions it influences. Conversely, focusing only on deployment can leave questions about development, release and misuse unaddressed. Newsom’s veto rejected this particular model-centered framework; it was not a claim that AI risks were unimportant or that California should abandon safeguards. On the same day, his administration announced other AI initiatives, including measures aimed at safe and responsible AI and protections for Californians (Governor of California).

SB 1047 created no enforceable obligations. Its proposed shutdown, safety-protocol, reporting and liability provisions did not take effect. The legislative record identifies the bill as vetoed, not current law (California bill status).

For a California business, the practical takeaway is narrow: SB 1047 itself is not a compliance regime to follow. The broader questions it raised remain relevant to founders and investors evaluating frontier-model development—who bears responsibility for misuse, how open-weight models can be governed, whether state-by-state rules create location costs, and how to distinguish frontier training from ordinary AI application development. The veto settled the fate of one proposal, not those policy questions.
Was the bill a threat to California’s AI industry?
It could plausibly have created a meaningful burden for some frontier-model developers, particularly companies with limited compliance resources or developers distributing weights they could not later control. Unclear obligations and state-specific rules might also have influenced investment and location decisions. Those are credible risks to examine, not proven consequences.
At the same time, the bill’s scope was not every AI startup, and safety rules might have supported trust and reduced risks that could harm the sector as a whole. Because Newsom vetoed the measure before it became operative, neither the forecast of industry damage nor the forecast of safety benefits received a real-world test. The claim that SB 1047 would destroy California’s nascent industry should therefore be read as a contested 2024 prediction—not as a report of what happened.
