The U.S. government holds seized Bitcoin because a seizure is usually temporary custody during a criminal or civil forfeiture case—not proof that the government already owns the coins. Department of Justice policy generally keeps cryptocurrency in the form in which it was seized until forfeiture becomes final, preserving the asset for possible return and avoiding losses caused by converting it while its value is changing.
After a final forfeiture order, the U.S. Marshals Service (USMS) can arrange liquidation. The March 6, 2025 executive order creating a Strategic Bitcoin Reserve adds an important qualification: qualifying forfeited BTC deposited in that Reserve is directed not to be sold, subject to court orders, statutory requirements and specified public-purpose exceptions.

Seized, forfeited and sold are three different stages
News reports often call coins in federal custody “government Bitcoin,” but that shorthand can obscure the legal status. The distinction matters because the government’s authority changes at each stage.
| Status | What it means | Can it ordinarily be liquidated? |
|---|---|---|
| Seized | Agents have taken control of cryptocurrency they allege is evidence, proceeds of crime or property connected to a crime. Ownership can still be contested. | Generally no. DOJ policy says to preserve the cryptocurrency in the form seized while the forfeiture process is unresolved. |
| Finally forfeited | The applicable criminal, civil or administrative forfeiture process has transferred title to the United States, subject to valid third-party claims and legal requirements. | Usually yes. USMS may arrange disposition unless a court order, statute, victim claim or another controlling rule requires a different outcome. |
| Sold or otherwise disposed of | The government has converted the cryptocurrency to dollars or another permitted form, or transferred it for an authorized public purpose. | The asset is no longer held in its original form, although proceeds may remain subject to statutory distribution rules. |
A balance shown in a government-controlled wallet therefore does not necessarily represent final government ownership. The case may still involve a conviction, a civil forfeiture proceeding, notice and claims deadlines, appeals, or a third party asserting that the coins belong to it.

Why authorities keep Bitcoin instead of selling it immediately
The DOJ Asset Forfeiture Policy Manual (2025) states: “Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.” That policy addresses both legal and financial risk.
Preserving the possibility of return
If a court rejects forfeiture, or a valid claimant proves ownership, the government may have to return the property. Returning the same Bitcoin avoids a dispute over whether officials returned the wrong asset or an inadequate amount of value. The manual warns that premature conversion could expose the government to claims for price movements if the cryptocurrency must be returned.
Avoiding price-fluctuation disputes
Bitcoin’s dollar price can change substantially between seizure, litigation and final judgment. Selling before title is resolved would lock in a price that might later prove disadvantageous to the government or the claimant. Keeping the coins preserves the asset itself rather than forcing officials to manage a speculative cash position during the case.

Control of the cryptocurrency can be important evidence in a civil forfeiture case. Secure custody helps establish that the government still possesses the property described in the complaint and can transfer it if forfeiture is ordered. It also prevents an early sale from complicating tracing, valuation and ownership arguments.

Who holds seized Bitcoin?
For Department of Justice cases, the Justice Manual gives USMS primary authority over management and disposal of seized assets in its custody that are subject to forfeiture, or have been forfeited, under DOJ-enforced laws and certain interagency arrangements. That does not mean every federal agency sends every digital asset to the Marshals immediately.
Temporary agency custody
The 2025 DOJ manual directs agencies to use a government-controlled self-custodial or cold-storage wallet for temporary cryptocurrency storage before custody is transferred. Agencies are expected to consult USMS about whether the particular cryptocurrency can be stored and liquidated by USMS or its contractor. The wallet may be operated by the government or a service provider under government procedures; it should not be confused with a retail wallet bought by an individual investor.
Treasury-related assets
The Justice Manual separately explains that assets seized by Treasury agencies are generally handled by property custodians, often contractors, under Treasury guidelines. The applicable agency, governing statute and interagency agreement can therefore determine who controls the keys, who maintains records and who conducts a sale.

What happens from seizure to disposition
- Agents seize and secure the cryptocurrency. Investigators identify the addresses and transaction history, take control of the private keys or arrange a transfer, and record the quantity and condition of the asset. A government-controlled wallet or approved cold-storage arrangement may be used during this stage.
- The government pursues forfeiture. A criminal case may seek forfeiture as part of sentencing. A civil case proceeds against the property itself, while an administrative forfeiture can become final when statutory notice and claim procedures expire without a qualifying claim.
- Potential owners and lienholders receive an opportunity to claim. Notice, deadlines and court procedures determine whether someone other than the defendant can establish an interest. Those claims can affect how much property is ultimately forfeited and what can be sold.
- A final forfeiture decision resolves title. DOJ guidance identifies a final judicial order or final administrative forfeiture as the ordinary point after which cryptocurrency may be liquidated. Until then, the preservation policy generally applies.
- USMS or another authorized custodian arranges disposition. The custodian determines the permitted method, handles security and records, and follows any distribution rules for victims, equitable sharing, law-enforcement needs or other statutory purposes.
- The coins are sold, transferred or retained under a controlling policy. A sale can produce dollars for the applicable forfeiture fund, but a court order, victim-compensation requirement, statutory use or the Strategic Bitcoin Reserve policy can require a different result.
How the Marshals Service sells forfeited Bitcoin
Once forfeiture is final, USMS may liquidate cryptocurrency in its custody. The precise method and timing depend on the case, the asset, the contractor arrangement and applicable law. It is unsafe to treat older auction descriptions as a permanent public schedule.
Rank #3
Historical timing is not a current deadline
A 2022 Department of Justice Office of the Inspector General audit found that USMS typically sold cryptocurrency 30 to 60 days after forfeiture during the period examined. The same audit described a planned contractor requirement to liquidate within five business days. Those figures are historical findings and a reported contract plan, not a universal deadline or a guarantee of present performance.
Periodic or pooled sales
The Asset Forfeiture Policy Manual describes an auction-liquidation process in which cryptocurrency from one case may be pooled with assets from other cases and offered periodically. Pooling can make custody and execution more efficient, but the manual does not establish a single public auction calendar for every future sale. Current sale mechanics should therefore be confirmed from the responsible agency for a specific case.
What a sale does to the proceeds
Sale proceeds do not automatically become unrestricted federal revenue. Forfeiture statutes and court orders can require compensation for identifiable victims, equitable sharing with state or local partners, payment of expenses or other specified uses. The amount realized also reflects the market price and execution conditions on the sale date, not the value of the coins when they were seized.

Executive Order 14233, signed March 6, 2025, directed the Treasury Department to establish custodial accounts known collectively as the Strategic Bitcoin Reserve. The Reserve is to be capitalized with qualifying BTC held by Treasury that was finally forfeited and is not needed for statutory requirements or released under the order. The order states that “Government BTC deposited into the Strategic Bitcoin Reserve shall not be sold and shall be maintained as reserve assets of the United States utilized to meet governmental objectives in accordance with applicable law.”
Rank #4
The scope is narrower than the phrase “the government’s Bitcoin” suggests. The order concerns qualifying assets and actual Reserve deposits. It does not say that every coin held by every federal agency has already been transferred, and it does not eliminate the underlying forfeiture process or third-party rights. The order also directed agencies to review their authority to transfer qualifying holdings and to report their digital-asset holdings.
Exceptions and other authorized uses
The order generally restricts agencies from selling or otherwise disposing of Government Digital Assets outside specified channels. It preserves disposal through Treasury’s lawful stewardship of the non-BTC United States Digital Asset Stockpile, a competent court order required by law, or a determination by the Attorney General or another relevant agency head that the assets or proceeds can and should be used for identifiable and verifiable victims, law-enforcement operations, equitable sharing with state and local partners, or listed statutory requirements.
That means “not sold” is not an absolute promise covering every possible legal situation. A court order, a victim-compensation obligation or another applicable statute can control what happens to particular property. The White House’s 2025 digital-assets report likewise treats statutory objectives and victim compensation as continuing constraints.

Example: the Silk Road-related Bitcoin seizure
The James Zhong case shows why the legal stages should not be collapsed into one headline. DOJ reported that agents seized more than 50,676 Bitcoin in November 2021 in connection with Silk Road. Later DOJ releases reported final forfeiture orders covering Bitcoin in the case.
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
The dollar figure quoted in the 2022 case announcement was a valuation at the time of seizure. It is not a current market value and should not be used to estimate what the coins would be worth today or what a later liquidation would have realized. The case illustrates the progression from investigative seizure to adjudicated forfeiture, not a promise that every seizure follows the same timetable.
How to interpret headlines about government-held Bitcoin
- Ask whether the report says “seized” or “forfeited.” Seized coins may still have to be returned; finally forfeited coins generally can be disposed of.
- Check the custodian and agency. DOJ and Treasury can operate under different custody frameworks, and state cases follow state law rather than the federal rules described here.
- Look for a date on every valuation. A value at seizure, indictment or auction is a snapshot, not a standing estimate of the government’s holdings.
- Do not assume a transfer to the Reserve has occurred. Executive Order 14233 required accounting and review; it did not announce that all federal holdings had already moved into Reserve accounts.
- Look for claims and statutory purposes. Victim compensation, equitable sharing and court orders can change the amount available for sale or require proceeds to be used in a particular way.
Why government cold storage is different from personal self-custody
Both a government-controlled wallet and a consumer cold-storage wallet can keep private keys offline, but the purposes and controls differ. Federal custody involves evidence handling, chain-of-custody records, access approvals, legal authority and eventual transfer to an authorized custodian. A person using a hardware wallet is managing personal access and recovery procedures. The similarity is technical storage; the governance, accountability and legal consequences are not the same.
Federal overview, not a rule for every seizure
This explanation covers the federal framework reflected in DOJ and Treasury materials. State forfeiture statutes, agency-specific agreements and court orders can produce different procedures. Even within a federal case, the final outcome depends on the charging statute, the forfeiture theory, notice and claims, appeals, victim interests and any later executive or court direction.
