If a GST adjudication order imposes a penalty but no tax, you generally challenge it by filing FORM GST APL-01 under section 107 of the Central Goods and Services Tax Act. The ordinary deadline is three months from the date the order was communicated. For a genuinely penalty-only order, the current section 107(6) proviso requires a pre-deposit of 10% of the penalty, in addition to payment of any amount you admit as payable. The correct appellate authority, limitation date and portal calculation depend on the order, your jurisdiction and the law in force when you file.
What is a penalty-only GST order?
A penalty-only order demands a monetary penalty without making a tax demand. It may still follow a show-cause notice, reply and hearing, and it may identify a specific penalty provision, period, transaction or alleged failure. “No tax demand” does not mean that no payment is required to appeal: the current statutory text expressly provides a special pre-deposit rule for an order demanding penalty without involving a tax demand.

First read the complete order and its demand summary. Confirm whether the amounts shown under tax, interest, fine, fee and penalty are actually zero for tax and interest, or whether another part of the order contains a tax liability. A penalty described as separate from tax is not automatically a penalty-only order if the same order also determines disputed tax.
How do I appeal a GST penalty order?
The first appeal is normally made to the Appellate Authority under section 107(1), using FORM GST APL-01. Your filing should identify the challenged order, explain why the penalty is wrong on the facts or law, show the required payments, and ask for specific relief. The appeal is an administrative and legal record: preserve the order, notice, reply, hearing material, evidence, payment proof and the final acknowledgment.

Identify the order and officer
- Record the order number, order date and the date and method by which it was communicated.
- Note the designation and jurisdiction of the officer who passed the order.
- Write down the statutory provision used to impose the penalty and the period or issue involved.
- Reconcile every amount in the order and demand summary, separating tax, interest, fine, fee and penalty.
The officer’s designation and the applicable rules or notification determine which Appellate Authority has jurisdiction. Do not select an authority by guessing from the taxpayer’s address. State GST and Union Territory GST proceedings may use the corresponding State or UT statute and authority rather than the central route, so check the statute, order and jurisdictional assignment.
What is the time limit to file a GST appeal?
Section 107(1) gives three months from communication of the order for the ordinary first appeal. The clock is tied to communication, not merely the date printed on the order. Keep evidence of communication, such as the portal entry, email delivery or other official transmission, because it supports your limitation calculation.
Section 107(4) permits the Appellate Authority to admit an appeal filed within a further period of up to one month if sufficient cause prevented timely filing. This is a discretionary extension, not an automatic extra month. File within the ordinary period whenever possible. If you need the extension, explain the cause precisely, give dates and attach evidence showing why the appeal could not be filed earlier.
Make a limitation worksheet
- Enter the official communication date.
- Calculate the date falling three months later under the applicable calendar and statutory interpretation.
- Count the remaining days before filing and leave time for payment, document preparation and portal problems.
- If the ordinary period has passed, prepare a separately reasoned request for admission based on sufficient cause and do not assume the authority must accept it.
Because limitation outcomes can turn on the exact communication record and jurisdictional rules, obtain case-specific advice before relying on an extension or filing after the ordinary period.
Do I need to pay a pre-deposit for a penalty-only GST order?
Yes, under the current enacted text checked in 2026, an order demanding penalty without involving a tax demand requires payment of 10% of the penalty before the appeal can be filed. This is the special penalty-only proviso in section 107(6). It applies to the penalty amount demanded by that order, not to a hypothetical tax amount.
Section 107(6) also requires full payment of amounts arising from the order that the appellant admits. Therefore, calculate two things separately: admitted amounts that you accept, and the statutory pre-deposit for the disputed penalty. If you admit part of the penalty or another amount, the admitted portion must be paid in full, while the 10% rule applies to the penalty-only demand as prescribed by the current law.
Penalty-only versus tax-plus-penalty
| Order category | Amount to address before filing | Key rule |
|---|---|---|
| Penalty without a tax demand | Full payment of admitted amounts, plus 10% of the penalty demanded | Special penalty-only proviso to section 107(6), current text checked in 2026 |
| Tax and penalty both disputed | Full payment of admitted amounts, plus the general pre-deposit calculated on disputed tax | General section 107(6) rule; the penalty-only proviso does not replace the disputed-tax calculation |
A GST Portal FAQ’s general explanation of a 10% pre-deposit refers to disputed tax. That explanation should not be treated as the complete answer for a penalty-only order. Check the current statute, the exact order and the live portal calculation before paying. If the portal amount appears inconsistent with the order or current law, preserve screenshots and seek professional assistance rather than submitting an unverified figure.

Which form is used for a GST appeal?
Use FORM GST APL-01 for the first appeal under section 107. The form requires case information that allows the Appellate Authority to understand what is challenged and what relief is sought.
Information APL-01 asks for
- Appellant identity and GSTIN details.
- Order number, date, communication date and the officer who passed the order.
- The issue and period under dispute.
- Separate amounts for tax, interest, fine, fee and penalty, including admitted and disputed amounts.
- A statement of facts, numbered grounds of appeal and a prayer specifying the relief requested.
- Whether the appellant wants a personal hearing.
Draft the statement of facts as a short chronology, then use numbered grounds that connect each error to evidence and the legal provision applied. The prayer should say exactly what you want—for example, setting aside the penalty, reducing it where legally available, or remanding a defined issue for proper consideration. Do not ask for relief that the order or statute cannot support.
How to prepare the appeal record
The prescribed form requires facts, grounds and supporting material, but the exact attachments depend on the order and penalty provision. Build a file that lets the authority verify both the procedural history and your response to each finding.
Core documents
- The impugned order and demand summary.
- Proof of communication, including the relevant portal or email record.
- The show-cause notice and documents relied on by the officer.
- Your reply, written submissions and hearing correspondence or record.
- Invoices, ledgers, returns, reconciliations, contracts, challans or other evidence that addresses the findings in the order.
- A chronology, statement of facts, grounds and prayer prepared for APL-01.
- Payment challans or other evidence for admitted amounts and the applicable pre-deposit.
- Authorization and representative details, plus any additional documents requested by the portal or jurisdictional rules.
Label files consistently, keep searchable copies where possible and make sure the documents uploaded are legible. Do not describe this list as a universal mandatory checklist: the order, penalty section and portal instructions may require different or additional material.

How to frame grounds against a penalty-only order
A penalty-only appeal is not won merely by pointing out that no tax was demanded. Section 107 expressly contemplates appeals from such orders. Grounds must answer the officer’s actual findings and the statutory basis for the penalty.
Test the legal provision
Quote or accurately identify the penalty section used in the order, then check each statutory condition. Explain which condition is absent, misinterpreted or unsupported. Distinguish a finding that a requirement was breached from a finding that the particular penalty provision authorizes the amount imposed.
Challenge factual findings with records
For every material factual conclusion, identify the evidence considered by the officer and the evidence that was overlooked or misunderstood. Use a reconciliation or chronology where it resolves a numerical or date issue. Point to the page or annexure in the uploaded record so the authority can verify the assertion quickly.

Address procedure and natural justice
Explain any defect in notice, opportunity to reply, hearing, reliance on undisclosed material or reasons given in the order. A procedural ground should state what opportunity was denied and how that affected the result, rather than making a general allegation of unfairness.

Recalculate the penalty from the figures and period used in the order. If the governing provision gives a range, discretion or conditions, show how the order applied them. State the precise correction sought and attach the calculation. Whether a reduction or waiver is legally available depends on the particular penalty section; do not assume that absence of tax automatically eliminates the penalty.
How do I file GST APL-01 online?
The GST Portal FAQ describes the following route for starting an appeal: Services > User Services > My Applications, then choose the appeal application and start a new application. Labels can change, so follow the live instructions displayed for your taxpayer account and order type.
- Sign in to the GST Portal using the taxpayer account associated with the order.
- Open
Services > User Services > My Applications. - Select the appeal application, start a new application and choose the relevant order type.
- Enter the order, communication, jurisdiction, issue, amount and representative details in APL-01.
- Insert the statement of facts, numbered grounds and prayer. Indicate whether you request a personal hearing.
- Upload the order, communication proof, notice, reply, evidence, payment proof and other documents requested for the case.
- Review admitted and disputed amounts and the pre-deposit shown by the portal against your calculation and the current section 107 text.
- Authenticate and submit using the method available to the taxpayer.
- Download the submitted form, attachments and acknowledgment immediately.
When the order is not uploaded
The portal FAQ describes a situation in which a self-certified copy of the order must be submitted within seven days when the order is not uploaded. Treat that as a case-specific portal instruction, not a universal deadline for every appeal. If the portal displays this requirement, upload or provide the copy within the stated period and retain proof of submission. A late copy may affect the filing date or processing.
Provisional versus final acknowledgment
Portal guidance distinguishes a provisional acknowledgment from the final acknowledgment or appeal number. Keep both status records, the final appeal number, the submitted files and payment references. A screenshot of a draft or provisional submission is not a substitute for confirming that the appeal received its final acknowledgment.
Do these 3 things before closing this tab:

Monitor the application status using the appeal number and respond to any deficiency, document request or hearing notice within the time stated. Keep the original files and proof of every upload. If a hearing is offered, prepare a short speaking note tied to the numbered grounds and the evidence already filed. Do not introduce a new factual case at the hearing without explaining why the material was not filed earlier.
An appeal does not automatically erase the underlying order. The consequences of recovery, stay, payment and any further remedy depend on the applicable statute, rules and directions issued in your case. Ask the jurisdictional authority or qualified Indian GST counsel about protective steps if recovery action is threatened.

Common filing mistakes and fixes
Starting from the order date instead of communication
Problem: The appeal is calculated from the date printed on the order even though it was communicated later.
Fix: Preserve the official communication record and calculate the three-month period from that date, subject to the applicable legal computation.
Assuming no tax means no deposit
Problem: The appellant enters zero because tax is not demanded.
Fix: Apply the current penalty-only proviso: 10% of the penalty, plus full payment of admitted amounts, unless the order is not genuinely penalty-only or another rule changes the calculation.
Using the wrong authority
Problem: The appeal is addressed to an authority selected by location rather than by the adjudicating officer’s designation and jurisdiction.
Fix: Verify the order, applicable rules or notification and the State or UT counterpart where relevant before submitting.
Uploading a narrative without grounds
Problem: A long chronology does not identify the legal and factual errors.

When to obtain professional help
Get case-specific Indian GST advice when the limitation period is disputed, the order combines tax and penalty, the penalty section has discretionary or conditional language, the authority is unclear, the portal calculation conflicts with the statute, recovery has started, or the record contains complex factual or constitutional issues. The correct grounds cannot be determined from the penalty amount alone; they require the order, notice, reply, evidence and governing provision.
