Federal agents do not take ownership of Bitcoin merely by moving it. A seizure gives the government control of cryptocurrency while it pursues a legal basis to keep it. Forfeiture is the later process that can transfer ownership to the United States. The route—criminal forfeiture, civil judicial forfeiture, or administrative forfeiture—determines who is named, which court or agency handles the matter, and how an owner or other claimant must respond.
This explainer covers federal practice and Department of Justice guidance. State proceedings, the statute used in a particular case, and a court’s orders can produce different procedures. An official notice and the law governing that case control over any general timeline described here.

Seizure and forfeiture are different legal events
A seizure is an intervention in possession or control. Investigators may secure digital assets so they cannot be moved while the government investigates suspected crime or prepares a forfeiture case. The seizure itself does not decide that the Bitcoin is forfeited, does not establish that an owner committed a crime, and does not prove that the government will ultimately keep the asset.

In a criminal case it is generally imposed as part of a sentence after conviction. In civil judicial forfeiture, the United States sues the property and interested people can make claims. In administrative forfeiture, the seizing agency can declare property forfeited when no one files a compliant claim within the required period. A seizure announcement or complaint therefore should be read as an interim step, not a final ownership ruling.

The Department of Justice describes the three federal tracks in its overview of Types of Federal Forfeiture.
The three federal forfeiture tracks
| Track | What the case is against | Key prerequisite or trigger | How an interested person participates |
|---|---|---|---|
| Criminal forfeiture | A criminal defendant and the defendant’s property interest | A conviction; forfeiture is part of the sentence and tied generally to the convicted counts | The defendant litigates in the criminal case. Third parties can use a separate ancillary proceeding to assert their interests after the court enters a preliminary forfeiture order. |
| Civil judicial forfeiture | The property itself; the United States is the plaintiff | A civil complaint alleges that the property is forfeitable under an applicable federal statute. A criminal prosecution of an owner is not required, including when a wrongdoer is unidentified or unavailable. | An owner or other interested person files a claim and then an answer or a Rule 12 motion under the notice and court rules. |
| Administrative forfeiture | Property handled by the seizing agency | No one files a timely, legally sufficient claim contesting the forfeiture | The potential claimant must follow the notice’s claim instructions. A qualifying claim generally moves the dispute toward judicial proceedings rather than allowing the agency to finalize the administrative forfeiture. |
These categories are not interchangeable. The named party, the forum, the deadline, and the way a third party proves an interest all depend on the track. The precise forfeiture statute and the case’s procedural posture can add requirements not captured by a general summary.
How a federal Bitcoin seizure works in practice
1. Investigators establish authority and technical access
Under the DOJ’s Asset Forfeiture Policy Manual 2025, agents should consult the U.S. Marshals Service (USMS) about whether the targeted cryptocurrency can be stored and liquidated through available procedures. Where required, law enforcement obtains seizure authority such as a seizure warrant. Existing search-warrant authority or valid consent can provide a different legal basis.

A warrant involving a domestic self-custodial wallet may cover a device or location where the wallet and private keys are accessible. The blockchain does not hand control to the government by itself. Agents need lawful authority plus the technical ability to use the private key, seed phrase, exchange account, device, or other access method that can transfer the coins.
2. The agency transfers the cryptocurrency to a controlled wallet
Once authorized, the seizing agency should move the cryptocurrency promptly to a government-controlled wallet. The policy manual explains the practical reason: other people may hold copies of a private key, so delay can allow competing transfers. The agency records the asset in its forfeiture system and temporarily stores it under current procedures.

3. Custody can move within the federal program
Custody may later transfer to a USMS wallet or an approved contractor wallet. The DOJ identifies USMS as the program’s primary custodian for seized and forfeited property, subject to stated exceptions. Cryptocurrency handling is specialized, so ordinary assumptions about cars, cash, or other physical evidence do not necessarily apply. DOJ’s description of program responsibilities is available at Asset Forfeiture Program Participants and Roles.
The manual also cautions that an agency’s ability to hold or liquidate one type of cryptocurrency does not guarantee that every token, network, wallet, or custody arrangement is supported. Consultation before seizure is intended to identify those operational limits.
What happens after the seizure
Administrative notice and the claim deadline
For an administrative forfeiture, the Justice Manual says written notice is generally sent as soon as practicable and no later than 60 days after seizure, subject to statutory exceptions and limited waiver rules. The notice states the deadline and method for filing a claim. If a potential claimant did not receive direct notice, the general publication-based rule described in the 2025 policy manual is 30 days after the last day of publication.
Those figures are not a license to calculate from a news article or from the date a transaction appeared on a blockchain. The notice, the applicable statute, and proof of when notice was received determine the operative deadline.
What makes an administrative claim effective
A claim contesting forfeiture must identify the specific property and the claimant’s interest. It must be submitted under oath and subject to penalty of perjury, using the delivery method and form required in the notice. A message that merely asks for information, a late submission, or a statement that does not identify an ownership or other legally recognized interest may not stop the administrative process.

A claim is different from a petition for remission or mitigation. A remission or mitigation petition asks the government to exercise discretionary relief under its rules; it is not the same as litigating whether the property is legally forfeitable. The DOJ’s Asset Forfeiture Management Staff provides pending notices and claim or petition information through Forfeiture.gov.

Under 18 U.S.C. § 983(a)(3), after a qualifying administrative claim the government generally has 90 days to file a civil forfeiture complaint, include the property in a criminal indictment, return the property, or obtain a court-approved extension. The alternatives and any extension depend on the statute and the judge or agency handling the matter. Missing a statutory requirement can have consequences, but whether a particular filing qualifies is case-specific.
Deadlines in a civil judicial case
For a civil judicial forfeiture, the DOJ policy manual describes notice with a claim deadline of at least 35 days after notice is sent. After a claim is filed, an answer or Rule 12 motion is generally due no later than 21 days, subject to the governing rules and court orders. The complaint, summons, notice, and docket—not a generalized timeline—tell a claimant exactly what to file and when.
How to contest a Bitcoin forfeiture
If the notice is administrative
- Preserve the notice and delivery evidence. Save the envelope, email headers, publication details, attachments, and any seizure or asset-identification number.
- Identify the exact asset and your legal interest. Match the notice’s wallet address, transaction, account, or property description and explain whether you claim ownership, possessory rights, or another recognized interest.
- Follow the notice’s oath, signature, and delivery instructions. Send the claim to the listed agency or office by the stated deadline and keep proof of delivery.
- Obtain advice promptly if the value or facts are significant. A lawyer can determine whether the claim is sufficient, whether another person should claim an interest, and which forfeiture statute applies.
Filing a claim does not itself decide who wins. It preserves a route to judicial review and triggers the government’s next procedural choices under the statute.
If the United States files a civil complaint
Read the complaint and summons for the court, case number, deadline to file a claim, and deadline to answer or make a Rule 12 motion. A person who misses the claim step may lose the ability to contest the property. The claimant generally must establish a legally cognizable interest and respond to the government’s allegations under the Federal Rules of Civil Procedure and the applicable forfeiture statute.

If forfeiture is part of a criminal case
The defendant addresses forfeiture through the criminal prosecution and sentencing process. A person who is not the defendant but asserts an ownership or superior interest ordinarily uses the ancillary proceeding after a preliminary forfeiture order. That proceeding is separate from deciding whether the defendant is guilty.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Does the government sell seized Bitcoin immediately?
Not ordinarily under DOJ’s current policy. The 2025 manual states:
“Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.”
The reason is financial as well as legal. Bitcoin and other cryptocurrencies can change value sharply. Converting before forfeiture is final could leave the government owing an owner more than the sale proceeds if the asset must be returned after a successful challenge.

The policy describes limited situations for an interlocutory sale or pretrial conversion, consultation with DOJ’s Money Laundering and Asset Recovery Section, and special approval for certain alternative cryptocurrencies. The accurate rule is therefore neither “the government always holds the coins” nor “the government immediately sells them.” A final forfeiture order or final administrative forfeiture permits disposition under the program’s legal procedures; an exception may permit an earlier transaction.

Which agencies do what?
- Investigating and seizing agency: conducts the investigation, executes the seizure authority, gives administrative notice when that route applies, and manages the initial forfeiture process.
- U.S. Attorneys’ Offices: prosecute federal criminal and civil forfeiture matters on behalf of the United States.
- U.S. Marshals Service: serves as the program’s primary property custodian in most situations and disposes of property in its custody as the law permits. Cryptocurrency may move through specialized wallets or contractors under current procedures.
Because custody can change, the agency that announced a seizure may not be the office currently holding the Bitcoin. The official notice should identify the contact and claim channel for the particular asset.
What a recent DOJ announcement does—and does not—prove
On June 18, 2025, the DOJ announced a civil forfeiture complaint against more than $225.3 million in cryptocurrency allegedly connected to investment-fraud proceeds and money laundering. The amount describes the property listed in that complaint, not a general annual seizure statistic. The allegations remain allegations unless and until the court enters the appropriate orders. The release is at United States Files Civil Forfeiture Complaint Against $225M in Funds Involved in Cryptocurrency.
A complaint can begin the civil judicial track while ownership remains contested. It should not be reported as proof that the Bitcoin has already been forfeited or that every person associated with the wallet is liable.
Can victims receive recovered cryptocurrency or money?
Victim compensation may be available when federal law authorizes it and when assets are actually identified, seized, and forfeited. The sequence matters: investigators must locate and secure property, the government must complete the applicable forfeiture process, and an authorized distribution procedure must identify eligible victims and allocate available funds or assets. Recovery can therefore take time and is not guaranteed by a seizure announcement.
Potential victims should keep fraud reports, transaction records, communications, and proof of loss, then follow the instructions in the relevant DOJ or court notice. A victim’s eligibility, priority, and amount depend on the statute, the case, and the assets ultimately forfeited.
Federal scope and practical limits
This framework concerns federal DOJ practice. State and local agencies may use different statutes, deadlines, notice rules, custodians, or court procedures, and a federal investigation can involve parallel state action. A particular seizure may also be governed by a specialized statute, a sealed warrant, a court order, or an agreement between agencies.
If your Bitcoin or wallet was seized, do not wait for a general news story to supply a deadline. Locate the official notice, determine whether the matter is administrative, civil judicial, or criminal, preserve access and transaction records without moving or destroying evidence, and seek qualified legal advice or legal aid quickly. Only the notice, docket, governing statute, and case-specific orders can establish the response required in your situation.
