On January 7, 2025, the Department of Defense added Tencent Holdings Limited and Contemporary Amperex Technology Co., Ltd. (CATL) to its statutory list of Chinese military companies under Section 1260H of the FY2021 National Defense Authorization Act. Both companies remained on the Defense Department’s latest listed-entities document, dated June 8, 2026.
For most consumers, gamers and ordinary investors, the listing did not by itself shut down Tencent services, ban CATL batteries or block all private-sector business. Its more immediate significance is national-security, government-contracting and supply-chain risk. Separate laws and agency actions can create additional restrictions.

The short version
- What happened: The Pentagon added Tencent and CATL to its Section 1260H list on January 7, 2025.
- What the list means: The Defense Department classified the companies under a statute covering certain entities linked to China’s People’s Liberation Army, Central Military Commission or military-civil fusion system.
- What it does not automatically mean: It is not, by itself, an OFAC blocking sanction, a Commerce Department Entity List placement, a blanket import ban or a consumer-services shutdown.
- Current status: Both companies appeared on the official list dated June 8, 2026.
- Where the risk is greatest: Defense contracts, government procurement, lobbying relationships, supply-chain diligence and the possibility of future restrictions.
The important distinction is between a statutory Defense Department classification and a separate legal prohibition. Calling Tencent or CATL “sanctioned” without identifying another sanctions authority is misleading.
What Section 1260H actually is
Section 1260H directs the Defense Department to identify certain “Chinese military companies” operating directly or indirectly in the United States. The statutory category is broader than the everyday meaning of a military contractor.

- WORKS WITH EVERY NON-TESLA EV: Standard J1772 connector plugs straight into Ford, Chevrolet, Hyundai, Kia, Nissan, BMW, Volkswagen, Audi, Rivian, Lucid and every other EV or plug-in hybrid sold with a J1772 port - no adapter needed. Tesla drivers can charge too, using the J1772 adapter that comes with the car.
- PLUG IN, NO HARDWIRING: Level 2 charger delivers up to 40A to fully charge most EVs overnight. Plugs into a 240V, 4-prong NEMA 14-50 outlet (the RV/range type - NOT a dryer outlet) on a dedicated 50A circuit. The extra-long 25 ft cable easily reaches across a garage or driveway. Before ordering, check your car's port type and that you have the right outlet.
- CONTROL & SAVE FROM YOUR PHONE: A stronger built-in antenna keeps the charger online even in a garage or basement. Use the free app to start/stop charging, set speed (6-40A), get reminders, and track energy use and cost. Schedule off-peak overnight charging to cut your electric bill. Requires 2.4 GHz WiFi.
- SAFETY-CERTIFIED & WEATHERPROOF: Independently tested and certified (UL, ETL, FCC, Energy Star). A fully sealed IP66 / NEMA 4 housing stands up to rain, snow, heat and dust indoors or out, and internal steel shielding protects the electronics for years of reliable use.
- GLOW-IN-THE-DARK HOLSTER: The included high-visibility holster glows in the dark so you can find and dock the plug easily at night. Holds the connector securely when not in use.
The covered entities can include companies that the Pentagon determines are:
- Owned or controlled by, or acting as an agent of or on behalf of, the People’s Liberation Army or another component of China’s Central Military Commission; or
- Military-civil fusion contributors to China’s defense industrial base; and
- Operating directly or indirectly in the United States while providing commercial services, manufacturing, producing or exporting.
China’s military-civil fusion policy seeks to connect civilian technology, research, companies and expertise with military modernization. The Pentagon says its list is intended to help counter that system. Inclusion therefore represents the Defense Department’s statutory classification; it is not necessarily a finding that a company manufactures weapons or knowingly supplies military hardware.
The Pentagon’s January 2025 release announced the update, while the accompanying Federal Register notice provided the official list and a reconsideration process.
Why Tencent and CATL were included
The initial 2025 public notice named the companies but did not give a detailed, company-by-company explanation of the evidence behind every listing. The latest Defense Department document supplies the clearest official descriptions currently available.
Tencent
The June 8, 2026 list describes Tencent as indirectly affiliated with the People’s Liberation Army. That is the Pentagon’s stated statutory rationale. It should not be rewritten as a proven finding that Tencent is a conventional arms supplier.
Tencent is a major technology company with businesses and investments spanning social and messaging services, online games, cloud computing, artificial intelligence, digital payments and other online services. Those activities explain why a military-civil-fusion designation can matter beyond traditional defense procurement: policymakers may view civilian technology and data infrastructure as relevant to national-security capabilities.
CATL
The same Defense Department list describes CATL as indirectly affiliated with China’s Ministry of Industry and Information Technology and directly and indirectly affiliated with the State-owned Assets Supervision and Administration Commission.
Recommended Free Tools
CATL is a major electric-vehicle and energy-storage battery manufacturer. Its position in the battery supply chain makes the designation relevant to automakers, storage developers, battery integrators, government agencies and defense contractors—even though the listing does not automatically make every CATL-related battery unlawful.
The official list can be read in the Defense Department’s June 8, 2026 PDF.
How the companies responded
Tencent disputed the characterization and said the listing did not affect its business, according to contemporaneous reporting. CATL called the designation a mistake and said it had never engaged in military-related business or activities. Those statements are the companies’ positions, not a replacement for the Pentagon’s formal classification.

| Issue | Effect of the Section 1260H listing alone |
|---|---|
| OFAC sanctions | It is not automatically an addition to the Treasury Department’s Specially Designated Nationals list or a blocking order. |
| Commerce Department export controls | It is not automatically an Entity List placement. |
| Consumer services | It does not by itself prohibit Americans from using Tencent-related games, messaging services, cloud products or other commercial offerings. |
| Private-sector purchases | It does not automatically prohibit every private company from buying Tencent services or CATL batteries. |
| U.S. government business | Separate statutes, contract clauses and procurement rules may restrict particular contracts, products, services or relationships. |
| Future action | The Defense Department has reserved the ability to use authorities other than Section 1260H. |
These distinctions matter because “blacklisted,” “sanctioned” and “banned” are not interchangeable legal terms. A company can appear on one U.S. government list while remaining absent from another, with different consequences for exports, investments, procurement and private commerce.
Why the listing matters for defense contractors
Lobbying-related contracting restrictions
The Defense Department’s current CLEAR guidance says Section 851 of the FY2025 NDAA restricts certain Department contracts when a contractor, its parent or a subsidiary has a covered lobbying relationship involving a company on the 1260H list. The guidance says the provision is in effect and may affect a contractor’s ability to enter, renew or extend Department contracts.
The exact result depends on the contract, the entities involved, the lobbying relationship and the applicable clause. A listed parent, subsidiary, subcontractor and portfolio investment should not automatically be treated as legally identical.
Product-specific procurement rules
Other NDAA provisions impose or phase in restrictions concerning particular products and procurement categories. Legal analysis has identified a CATL-related Defense Department battery procurement restriction with an effective date reported as October 1, 2027. Other reporting has described broader prohibitions beginning in June 2026.

A contractor must identify the specific statute, product category, agency, contract language and effective date that apply to its transaction.
Supply-chain consequences
Even when a rule does not directly prohibit a private purchase, defense primes and government suppliers may avoid listed companies because of flow-down requirements, security reviews, reputational risk, disclosure obligations, bid concerns or the possibility of future eligibility restrictions.
For a defense contractor, the practical question is often not simply “Is this company listed?” It is “What is the relationship, what product or service is involved, who is the customer and what does the contract require?”
What it means for CATL batteries and electric vehicles
CATL’s importance makes this more than a corporate-label issue. Companies assessing exposure may need to distinguish among:
Free tools Windows power users keep installed

- Cells manufactured by CATL;
- Battery packs assembled by another company using CATL cells;
- CATL technology licensed to another manufacturer;
- Components sourced from CATL affiliates;
- Products sold to private customers; and
- Products purchased by the Defense Department or another government agency.
A private automaker, energy-storage developer or consumer is not automatically prohibited from using a product containing CATL-origin materials solely because CATL appears on the 1260H list. Government procurement rules, domestic-content requirements, contract terms and other national-security authorities may nevertheless make the supplier commercially unacceptable for a particular project.

Consumers and gamers
The listing is not itself a consumer-services shutdown order. U.S. users were not automatically barred from Tencent-related games, WeChat or other services. Nor does Tencent’s designation automatically transfer to every company in which Tencent owns an investment.
Riot Games, Epic Games and other companies with Tencent investment relationships must be analyzed under their own ownership, control, contractual and regulatory facts. A parent-company designation, a subsidiary and a minority portfolio investment are not automatically interchangeable.
Investors
For investors, the designation can increase political, reputational and regulatory uncertainty. Markets may price the risk of future contracting restrictions, investment limits or sanctions, but the Section 1260H listing itself does not automatically block Tencent securities or require delisting from a U.S. market.
Investors should distinguish the Pentagon’s 1260H list from Treasury’s investment-related Chinese military-company lists and from OFAC sanctions. They should also check the exact security, exchange, currency and trading date before drawing conclusions from any reported market move.
Timeline
- January 7, 2025: The Defense Department added Tencent and CATL to its Section 1260H list, which contained 134 companies at the time.
- 2025: Tencent and CATL disputed the designation. Listed entities had a process for requesting reconsideration.
- June 8, 2026: The latest official Defense Department list located for this article continued to include both companies.
- 2026 onward: Separate contracting and procurement restrictions become increasingly important, depending on the applicable provision and transaction.
- October 1, 2027: A CATL-specific battery procurement restriction has been reported with this effective date; the precise rule and product scope must be checked against the applicable statute and implementing requirements.
The list is not fixed. The 2025 notice also removed several previously listed entities, including Megvii, China Marine Information Electronics, China Railway Construction Corporation, China State Construction Group, China Telecommunications Corporation and Shenzhen Consys. Removal can reflect a determination that an entity no longer meets the statutory requirements, including the requirement to operate directly or indirectly in the United States.
Practical checklist for businesses
- Check the dated list: Use the latest Defense Department publication rather than relying on an old database or headline.
- Map the corporate structure: Identify parents, subsidiaries, affiliates, joint ventures, licensees and contract manufacturers.
- Classify the transaction: Separate private commerce from federal procurement, Defense Department contracting and subcontracting.
- Review contract language: Look for applicable representations, flow-down clauses, disclosure duties and lobbying restrictions.
- Trace the product: For batteries, document cell maker, pack assembler, technology licensor, component suppliers and manufacturing location.
- Assess future risk: Consider whether a customer, prime contractor or lender may impose requirements broader than the current minimum legal rule.
- Get specialized advice: Government-contracting, export-control, sanctions or foreign-investment counsel may be appropriate for an active transaction.
Enterprise risk platforms such as Exiger, Sayari and OneTrust may help organizations investigate ownership and third-party exposure, but software does not replace transaction-specific legal analysis. Enterprise pricing is generally quote-based.
Frequently Asked Questions
Can Americans still use Tencent games and services?
Yes, the Section 1260H listing alone does not prohibit U.S. consumers from using Tencent-related games, messaging services or other commercial products.
Can a company still buy CATL batteries?
The listing alone is not a blanket private-sector purchasing ban. Government procurement rules, contract clauses and product-specific restrictions may produce a different result.
Are Tencent shares automatically blocked or delisted?
No. A 1260H listing is not automatically an OFAC blocking order or a requirement that securities be delisted.
Can Tencent and CATL challenge the designation?
Listed entities can request reconsideration and submit evidence and arguments to the Defense Department. Both companies remained listed on the official June 8, 2026 document.
