France did not give Huawei unrestricted permission to build its 5G networks. In November 2019, Emmanuel Macron argued against automatically excluding the company, but French law required prior state authorization for covered network equipment. Subsequent reviews refused or limited some Huawei deployments.
What Macron said about Huawei and 5G
On November 4, 2019, during a meeting in China with French and German business representatives, Macron said that 5G required neither “stigmatization” nor “naivety.” He called for European coordination and transparent technological cooperation. His remarks described a political approach—not a specific authorization for Huawei equipment or a guarantee that any operator could deploy it. The Élysée account of the meeting records the comments.

Macron had made a related point in an August 27, 2019 speech to France’s ambassadors: the choice should not be reduced to “American or Chinese” technology. He argued for European technological sovereignty and cautioned against stigmatizing individual actors. That position left room for Huawei to compete, while also emphasizing Europe’s interest in developing its own technology suppliers. The speech is available from the Élysée.

Law No. 2019-810, dated August 1, 2019, established a prior-authorization regime for specified equipment used in mobile networks beyond 4G. The framework was aimed at protecting security interests, including network continuity, integrity and availability, and the confidentiality of communications. It did not name Huawei in the statute as a company-wide ban.

The prime minister held the legal authority to grant or refuse authorization; the state’s technical-security review involved ANSSI. Authorization could be conditional and time-limited, with a maximum period of up to eight years under the applicable framework. That maximum was not a promise that every application would receive an eight-year approval. The CADA summary of the law describes the authorization requirement, and the Constitutional Council’s February 5, 2021 decision upheld the relevant provisions after a constitutional challenge.
Spectrum access was not equipment approval
France’s telecom regulator Arcep qualified Bouygues Telecom, Free Mobile, Orange France and SFR to participate in the 3.4–3.8 GHz 5G frequency process on April 2, 2020. That qualification concerned an operator’s ability to take part in the spectrum process. It did not approve a particular equipment supplier or override the separate security-authorization regime.

| Decision or permission | What it covered | What it did not establish |
|---|---|---|
| Arcep qualification for the 3.4–3.8 GHz process | Whether an operator could participate in the spectrum process | Permission to deploy Huawei or any other specific supplier’s equipment |
| Security authorization under the 2019 law | Whether covered network equipment could be operated, potentially with conditions or a limited term | A spectrum award or unrestricted approval for an operator’s entire network |
Arcep’s announcement on operator qualification and its 5G regulatory chronology document the spectrum process. Keeping spectrum and equipment decisions separate is essential to understanding what “participate” meant.
What the 2020 decisions showed
In a July 21, 2020 decision, the Conseil d’État record described ANSSI refusing an eight-year authorization for Huawei equipment in early July and discussed refusals and shorter authorizations. The case involved operators Bouygues Telecom and SFR, which challenged the framework amid concerns about its consequences for 5G planning and competition. The record shows that the law’s neutral wording did not mean all suppliers received equivalent outcomes. The Conseil d’État decision provides the details.

A National Assembly information report gives a broader snapshot of 2020: among 157 ANSSI requests it examined, all 22 refusals and all 53 authorizations for the maximum duration concerned Huawei equipment. Those figures are the report’s account of requests examined in 2020; they should not be read as a count of all French 5G equipment or as a statement made by Macron. The parliamentary report contains the figures.
Why the policy was contested
Security and strategic dependence
French authorities’ concerns included the resilience and confidentiality of communications, possible foreign-state interference, and dependence on suppliers outside Europe. A 2023 Paris administrative-court ruling records government concerns relating to Huawei’s alleged obligations under Chinese intelligence law, state subsidies and ownership transparency. These were government-cited risk factors, not a judicial finding that Huawei had spied through French networks. The 2023 ruling sets out that context.

Competition, cost and network planning
Operators and proponents of supplier choice had different practical concerns: competition among vendors, equipment costs, the disruption of replacing or working around existing infrastructure, and the difficulty of planning investments when approvals were limited in duration. Those considerations help explain why authorization length mattered commercially, but they do not establish that one supplier was cheaper or that a particular deployment would have been more efficient.
What “Huawei could participate” means in practice
- No automatic exclusion by name: Macron opposed treating a supplier’s nationality alone as the entire policy decision.
- No guaranteed deployment: Covered equipment required prior French authorization, which could be refused or limited.
- No blanket conclusion about every network segment: The rules concerned specified equipment, and security review depended on the equipment and its role; “Huawei in France” was not a single all-or-nothing technical question.
- No proof of spying from the policy itself: Security controls reflected assessed risks, not a publicly established finding that Huawei had conducted espionage on French networks.
Nokia, headquartered in Finland, and Ericsson, headquartered in Sweden, were European alternatives in the wider debate. Macron’s sovereignty argument concerned strengthening European capacity as well as avoiding a simple U.S.-versus-China choice; it does not establish which supplier equipped every French operator or network segment.
