The jury awarded $425,651,947. This was a data-collection and privacy case—not a conventional cyberattack in which hackers stole a Google database—and consumers have not been promised immediate payments.
What the jury found
The case is Rodriguez et al. v. Google LLC, case no. 3:20-cv-04688-RS in the U.S. District Court for the Northern District of California. The jury found Google liable for invasion of privacy under the California Constitution and intrusion upon seclusion. The court’s January 30, 2026 post-trial order records compensatory damages of $425,651,947—often rounded in headlines to $425 million.
The plaintiffs alleged that Google continued receiving, retaining, and using activity information generated inside non-Google mobile apps after users had turned off relevant Google activity settings. The official class-action description identifies data flows involving Google software-development tools, including the Firebase SDK and Google Mobile Ads SDK: official case FAQ.
The verdict was not a voluntary settlement. Google denied wrongdoing and said it intended to challenge the decision. The jury rejected some of the plaintiffs’ claims and found no malice for purposes of punitive damages; the plaintiffs had sought more than $31 billion.

Why “massive privacy breach” is an inaccurate shorthand
This matter does not describe an outside attacker breaking into Google, stealing passwords, or publishing a database. It concerns alleged collection of app-activity information despite users’ privacy choices and the accuracy of Google’s explanations of those choices.
That distinction matters. A conventional security-breach response might involve password resets, credit monitoring, or a breach-notification number. The materials in this case instead describe a dispute over data flows from apps and Google services. There is no finding here that Google users’ credentials were exposed by hackers.
What Web & App Activity controls do—and do not do
Web & App Activity is a Google Account control for saving certain activity associated with Google services. The litigation also involved supplemental Web & App Activity (often called sWAA), covering Chrome history and activity from sites, apps, and devices that use Google services.

Turning off one account setting is not the same as making a phone invisible to Google. It is useful to separate three categories:
- Account-saved activity: information stored with a Google Account under the relevant activity control.
- App-integrated data: events sent by a third-party app through an embedded SDK, such as analytics or advertising tools.
- Other product data: diagnostic, security, advertising, or service information handled under separate product terms.
Ad-personalization controls and Android app permissions are also different from Web & App Activity. Disabling personalization does not necessarily disable every analytics or app-data flow.
Who may be covered?
The official case site describes two certified classes of people whose relevant activity settings were disabled or paused while activity from qualifying non-Google mobile apps was transmitted to Google. The described class period runs from July 1, 2016, through September 23, 2024, with distinctions involving device type, the Google SDK involved, and the particular setting.
Reuters reported the broader certified population as approximately 98 million users and 174 million devices. Those are attributed class-size figures, not a guarantee that every person or device will receive money, and they are not interchangeable counts.
Eligibility depends on the court’s definitions and historical records—not simply on remembering that a setting was switched off. Potential edge cases include:
- The relevant app may not have used one of the Google SDKs covered by the class definitions.
- A user’s device, country, date, or activity-setting history may not match the certified class.
- Some classes have Android-related requirements; ownership of an iPhone or another device does not automatically include or exclude someone.
- Turning off ad personalization is not necessarily the same as disabling Web & App Activity.
- Settings may have changed over time, so eligibility cannot be determined from a current screenshot alone.

How much could an individual receive?
No reliable per-person figure has been announced. Dividing $425,651,947 by 98 million users would be misleading because the award may be allocated among different classes and devices, and deductions or later court orders can change the distributable amount.
Attorneys’ fees, litigation expenses, interest, taxes, administration costs, appeals, and the eventual allocation formula can all affect a payment. A future court-approved process might use records, claim forms, or both. Do not treat the headline award as a personal entitlement.

Has Google paid users?
Not according to the payment warning on the official case website. The site says class members will not be paid until the court resolves Google’s post-verdict request and any appeal. Therefore, a verdict or judgment should not be confused with money already distributed.
The key procedural milestones are:

The official case site remains the safest source for a claim deadline or payment notice: googlewebappactivitylawsuit.com. Do not provide bank passwords, cryptocurrency, Social Security numbers, or an upfront fee to an unofficial “claims” website.

Google denied that it violated users’ privacy. Its defense, as reported by Reuters and Axios, included arguments that the data was pseudonymous or nonpersonal, stored in segregated and encrypted systems, and not linked to users’ Google Accounts or identities in the manner alleged by the plaintiffs. Google also said its products honor users’ choices when personalization is turned off.
Those are Google’s litigation positions, not a replacement for the jury’s liability finding. The verdict reflects the jury’s conclusion on the claims it decided.

What happened after the verdict?
The January 30, 2026 order kept the classes certified by denying Google’s request for decertification. That matters because losing certification could have forced affected users to pursue many individual cases. The same order denied the plaintiffs’ request for a permanent injunction; retaining class certification does not itself establish a payment date or guarantee that every person in the reported population qualifies.

Practical steps for Google users
- Open your Google Account privacy controls at myaccount.google.com and review Web & App Activity and any supplemental activity options. Google’s labels can change, so follow the current interface.
- Review apps signed in with Google or using Google services, and revoke access that you no longer need.
- Check Android app permissions, especially location, physical-activity, and background access.
- Turn off ad personalization if you do not want ads tailored to your activity.
- Delete stored Google activity where appropriate, understanding that deletion of account history does not necessarily control every separate app or diagnostic record.
- Use only the official case website or court notices for class-action information. These privacy steps may reduce future collection but do not prove class membership or increase a possible payment.
Privacy tools: what they can and cannot fix
A password manager can reduce account-takeover risk, and a privacy-focused browser can limit some web trackers. A VPN can protect traffic from local-network observers and hide an IP address from some websites. None of these tools prevents an authenticated app or an embedded SDK from sending data generated inside that app. They also do not change eligibility in this case.
Readers who want to stay in Google’s ecosystem can review Google One and Google Password Manager, but Google’s own products are not a complete solution to the conduct alleged here.
