The employees examined IP-address information to compare the journalists’ approximate locations with those of suspected sources inside ByteDance. Four employees were removed from the company or lost their jobs.
That admission documented an internal misuse of user data. It did not, by itself, prove that Chinese government officials ordered the operation, received the data, or monitored every American TikTok user. The U.S. government nevertheless cited the episode as evidence that ByteDance personnel could access and misuse Americans’ information when it defended a forced-divestiture law before the Supreme Court.

What ByteDance admitted in 2022
ByteDance’s Internal Audit and Risk Control personnel were investigating suspected leaks of confidential company information. During that investigation, employees accessed TikTok account data associated with a former BuzzFeed News reporter, a Financial Times reporter and a small number of people connected with them through TikTok.
The employees used IP-address information to compare the journalists’ approximate network locations with locations associated with ByteDance employees suspected of leaking information. ByteDance said the access violated company policy, that four employees were no longer with the company, and that it restructured the relevant audit and investigations functions. Reuters’ account and Washington Post reporting described the episode.

What “tracking” meant here
The strongest documented description concerns account information and IP addresses, not confirmed GPS surveillance or interception of private messages. An IP address can indicate a household or workplace network, internet provider and rough geographic area. It generally cannot, by itself, establish a person’s exact physical position.
The episode therefore is most accurately described as unauthorized access to TikTok data to compare journalists’ approximate locations. Calling it proof that “China spied on Americans” goes beyond what this incident establishes.
What the incident did—and did not—prove about China
The evidence supports several conclusions:
- ByteDance employees carried out the access.
- The company acknowledged the conduct and punished the employees.
- Personnel had technical or administrative access that could be misused.
- The investigation involved two journalists and a limited number of connected users, not millions of people individually monitored.
It does not establish that Chinese officials directed the investigation, knew about it, obtained the information or used it for intelligence purposes. Broader allegations about possible Chinese-government access to U.S.-person data were separate from the admitted journalist incident.

The U.S. government’s theory was based on risk: foreign-adversary control could create opportunities to obtain data, influence operations or make company assurances difficult to enforce. Its Supreme Court filings cited the journalist episode as a concrete example of access and misuse, alongside classified and other public evidence. How the episode entered the Supreme Court dispute
President Joe Biden signed the Protecting Americans from Foreign Adversary Controlled Applications Act on April 24, 2024. For TikTok and ByteDance, the law required a “qualified divestiture” and set January 19, 2025, as the operative deadline unless statutory conditions for an extension were met. If those conditions were not satisfied, app stores and internet-hosting services could no longer support the covered application. The Congressional Research Service summarizes the statute and litigation in its overview.
The government argued that separating TikTok from ByteDance would remove Chinese control and reduce continuing relationships involving U.S. data, operations and recommendation technology. The journalist case was supporting evidence for why internal policies and promises might not be sufficient; it was not the entire legal basis for the statute.

What TikTok and ByteDance argued
- The law singled out TikTok and burdened protected speech and association.
- Creators and users relied on the platform for expression, audiences and livelihoods.
- A forced sale could impair the recommendation algorithm, which the challengers characterized as part of the service’s expressive character.
- Transferring the relevant technology might be impractical if ByteDance could not license or transfer key algorithmic systems.
- The law functioned as a ban while being described as a divestiture requirement.
The challengers also argued that concerns about data collection could not justify every restriction in the law. The case was TikTok Inc. v. Garland, docket numbers 24-656 and 24-657. The Court heard argument on January 10, 2025; the public docket is available here.
What the Supreme Court held on January 17, 2025
The Court upheld the challenged provisions against the First Amendment claims brought by TikTok, ByteDance and related petitioners. It accepted that Congress was pursuing an important interest in preventing a foreign adversary from collecting data about tens of millions of Americans and concluded that the law did not burden substantially more speech than necessary to advance that interest. - The Court did not find, as a factual matter, that ByteDance had conducted Chinese-government espionage against Americans.
- It did not hold that every TikTok data practice was unlawful.
- It upheld a divestiture-based regime, not a categorical declaration that TikTok itself is illegal.
- It did not endorse covert content manipulation as an independent justification for the law.
- It did not create a general constitutional rule for commercial data collection by all social-media companies.
In practical terms, the decision allowed the law to operate unless a qualified divestiture occurred. It did not resolve every factual dispute about ByteDance’s data handling or Chinese state involvement.

What happened after the ruling
Post-decision ownership and governance must be analyzed separately from the 2022 incident and the Court’s holding. The Justice Department’s Office of Legal Counsel currently describes the TikTok USDS joint venture as majority-owned by American investors, operating independently of ByteDance, and using a revised recommendation algorithm and cybersecurity program intended to insulate federal-government information from the concerns behind the original restrictions. Why this was not a general TikTok privacy case
The Supreme Court dispute focused on whether Congress could condition continued U.S. operation on separation from foreign-adversary control. It was not a comprehensive consumer-privacy proceeding and did not decide whether commercial data collection by TikTok or other platforms is acceptable.
That distinction matters because other large platforms also collect behavioral, device and network data. The statute targeted ownership and control rather than establishing nationwide limits on data minimization, retention or sale. A finding that foreign control creates a national-security risk is different from a finding that a company has violated every user’s privacy.
Practical steps for TikTok users and journalists
The incident is a reminder to treat any social platform as unsuitable for confidential source work or highly sensitive communications. Sensible precautions include:
- Review TikTok’s permissions for location, contacts, microphone, camera and photos, and disable permissions that are not needed.
- Use a unique password and multifactor authentication; a password manager can help prevent reuse across services.
- Keep the operating system and TikTok updated.
- Consider a separate device or account for sensitive professional activity.
- Use TikTok’s current account-access and deletion controls, while recognizing that deleting an app does not necessarily delete previously collected server-side records.
- Remember that IP addresses, device identifiers, usage information and server activity may be handled separately from operating-system permissions.
A VPN may hide an IP address from some network observers, but it does not make a TikTok account anonymous or stop TikTok from receiving account, device or in-app activity data. Data-broker removal services address commercial people-search databases, not TikTok’s historical server records.
The answer to “Did ByteDance spy on Americans?”
There was a real, documented case in which ByteDance employees improperly used TikTok data to compare journalists’ approximate locations during a leak investigation. That episode strengthened the government’s argument that ByteDance’s access to Americans’ data posed a national-security risk. It did not, on its own, prove that the Chinese government ordered the surveillance, received the information or individually monitored every American. The Supreme Court upheld the divestiture law—not a finding that TikTok had been proven to be a Chinese espionage operation.
