Apple’s $95 Million Siri Privacy Settlement: Who Qualified and What Happened

Apple agreed in January 2025 to a $95 million settlement resolving a proposed class action that alleged Siri sometimes activated unintentionally, recorded private conversations, and disclosed or exposed recordings to third parties. Apple denied wrongdoing, and the settlement was not a court finding that Apple intentionally eavesdropped on users.

The settlement was later approved. According to the official settlement website, payment distribution began January 23, 2026. However, the ordinary claim deadline was July 2, 2025, so new claims are generally closed.

What the Siri lawsuit alleged

The case, Lopez et al. v. Apple Inc., Case No. 4:19-cv-04577-JSW, was filed in the U.S. District Court for the Northern District of California. The plaintiffs alleged that Siri could be activated without a deliberate command, such as “Hey Siri.” They claimed that an unintended activation could cause audio from a private or confidential conversation to be sent for processing and potentially recorded or disclosed.

“Eavesdropping” describes the plaintiffs’ allegations, not an established court finding. Several separate events should not be treated as identical:

The settlement resolved the dispute without a trial determining which of those events occurred unlawfully.

What Apple agreed to

Under the settlement, Apple provided for a non-reversionary fund of $95 million. The agreement resolved covered claims without Apple admitting liability or wrongdoing. The settlement documents, including the approval order, judgment, and related filings, are available on the official documents page.

The settlement materials also included non-monetary provisions concerning Siri data. They required Apple to permanently delete relevant individual Siri audio recordings collected before October 2019 and provide clearer information about the “Improve Siri” program, including user choices and data handling. This was not a promise to delete every piece of Siri-related data ever collected.

Apple also said, in a post-settlement clarification, that it had never sold Siri data or used it to create marketing profiles. That was Apple’s stated position, not a separate judicial finding resolving every question about Siri’s data practices. Reuters reporting summarized the clarification.

Who was eligible?

The settlement generally covered individuals in the United States and its territories who, between September 17, 2014, and December 31, 2024:

  1. Owned or purchased a Siri-enabled device;
  2. had Siri enabled;
  3. experienced an unintended Siri activation; and
  4. experienced that activation during a conversation intended to be confidential or private.

Covered device categories included the iPhone, iPad, Apple Watch, MacBook, iMac, HomePod, iPod touch, and Apple TV. Simply owning an Apple device or using Siri was not enough. The claim process required an attestation addressing the unintended activation and private or confidential conversation. The settlement FAQs explain the eligibility requirements.

The settlement was limited geographically. It did not cover all Siri users worldwide. Used-device ownership and whether the claimant still possessed the device were not, by themselves, the decisive issues; the required experience and other class criteria mattered.

How much could claimants receive?

The settlement notice described a payment of up to $20 per eligible Siri device, with claims allowed for as many as five devices. That created a theoretical maximum of $100 per claimant, but neither amount was guaranteed.

Payments were to be calculated from the net settlement fund after approved attorney fees, litigation expenses, administration costs, taxes, service awards, and other deductions. The available amount could also be reduced if the number of valid claims and claimed devices exceeded the assumptions used for the maximum. In other words, “up to $20” was a cap—not a promise that every qualifying device generated $20.

The settlement materials said class counsel could seek fees of approximately 30% of the fund, litigation expenses of up to $1.1 million, and service awards of up to $10,000 for class representatives. The controlling amounts are those in the court’s final orders, rather than the initial requests.

People who filed claims but did not receive an expected payment should use the official settlement site rather than filing a duplicate claim. The claim lookup and reissue page may require the Claimant ID and Confirmation Code. Payments could be sent by physical check, ACH deposit, or digital check, and distribution having begun does not mean every payment was delivered or every dispute was resolved.

What happened if someone did nothing?

An eligible class member who failed to submit a valid claim generally received no settlement payment. But doing nothing was not necessarily the same as rejecting the settlement: unless the person timely opted out, they could still be bound by the settlement and release.

Class members who stayed in the settlement generally released related claims against Apple covered by the case. People who opted out retained whatever individual rights they might have had, but they were not eligible for settlement payments through this agreement.

Did Apple admit it listened to users?

No. Apple denied the allegations and denied doing anything unlawful or improper. The agreement was a negotiated compromise, not a verdict or admission of liability. It provided compensation and other settlement terms in exchange for resolving and releasing covered claims.

That distinction matters when reading headlines that say Apple settled an “eavesdropping” lawsuit. The lawsuit alleged unintended activations and resulting recording or disclosure of private communications; the settlement did not prove that Apple intentionally spied on users.

Do not confuse this with the separate Apple Intelligence case

The $95 million settlement concerns the Lopez v. Apple Siri privacy litigation involving alleged unintended activations. It is separate from a reported 2026 settlement involving delayed Siri-related Apple Intelligence features, which reportedly involved a $250 million fund and different iPhone eligibility criteria. The two cases have different allegations, class definitions, and settlement amounts. The Associated Press reported on the separate matter.
